They want produce a mobile phone (i think) that can play Spectrum games and
such.

I am far more intrested what their next move is once they obtain permission
to distribute games through their new gadget. Demanding that all other forms
of free distribution stops? Withdraw the permission for free use of Spectrum
Roms for emulators?

At this moment they have good idea, but indeed face the problems like anyone
else, you need permission to distribute those games, especially when you
want to start a commercial venture like Amstradt is planning.

If copyrightholders demand payement because their works are going to be used
in a commercial service than it could well mean that the current situation
of free distribution comes at a end. Not that it would stop distribution, it
only moves underground again.
