Have you really watched it in exactly the moment that this request is being issued? I'm asking because in 4917ff the file is created again. To me it looks as if in this snipped the server behaves right. What we need is two tcpdumps, one against Samba where it fails and one against Windows where it succeeds. If you can't send them without an NDA, then you might want to contact someone from http://www.samba.org/samba/support to make a contract with and NDA.
