ok. reproduced it. The problem is that the string handling in smbd/message.c assumes unicode strings rather than checking the negotiated capability bits. The message command you list works fine for messages from Windows 2000 client (which support unicode). While smbclient is sending the strings as ASCII.

And sorry for the misleading information about the correct behaviour in 2.2.12 and 3.0.8pre2:
I changed the option -U in
/usr/bin/smbclient -U 'eisfair Samba Server on TEST2' -M TEST2
with 3.0.9 from
-U 'eisfair Samba Server'
to
-U 'eisfair Samba Server on TEST2'
