I'm running samba Version 3.0.25c-SVN-build-23735 on FC5. Ext3 with journaling in ordered mode. No problems with duplicate name subdirs linking back to share point contents. I think you might want to interpret this error message exactly the way it reads. If I saw this on my system, I would lose confidence in the integrity of the filesystem.
