If your view is that merge is not necessary, that code should be removed. I'm against leaving code that can't work without manual intervention. I had also thought that the merge was used in any situation where your teamware workspace and hg baseline were out of sync (so I'm not certain it only matters when the gate moves, it could happen now. It's just likely to be used now).
