We have changed the default SELinux policy version to 26 (i.e. the default definition of POLICYVERS in external/sepolicy/Android.mk) in order to support newer policy features, in particular name-based transitions (used now by the manta sepolicy for the /data/.gps.interface.pipe.to_jni named pipe).

This requires a kernel >= 3.0, which is true for the kernels supported for 4.2.2 and current master for the Nexus devices and for the goldfish 3.4 kernel for the emulator. If you need to support an older kernel, then you can manually override POLICYVERS in your environment or on the make command-line in the same manner as HAVE_SELINUX used to be defined.
