[AI] A petition to Google on accessibility from the visually-challenged community
Dear all Access Indians, Software giant Google has been petitioned by J.P. Shandra, a blind user, to make each of its products accessible for people with visual disabilities. The petition, posted on global consumer campaigning site Change.org, identifies that the company is failing to keep up with its competitors on accessibility. While Google has made significant steps towards improving the accessibility of some of its applications, including Gmail and Chrome, Shandra says Google fails to integrate the needs of vision-impaired users into its product development. Shandra identifies the social network Google+ as an example of a product which has been released to the public with inaccessible buttons and form fields. Vision-impaired community is tired of hearing accessibility features are coming in updates. They must be there from the very beginning. Stop treating your vision-impaired customers as second-class citizens, said Shandra in the petition's description. Moreover, stop treat ing them like they don't exist at all. We have the right to live a productive life like everyone else, Shandra asserted. Conversely, Apple incorporates the accessibility into the development of its devices and software, making its products the first choice of the most blind and vision-impaired users the world-over. Apple designs their products with accessibility in mind right from the start. Even if the execution isn't perfect, the intention was clearly there, Shandra remarked. According to the World Health Organization, there are 285 million blind/vision-impaired people worldwide. This represents a significant market which Google is failing to reach. At the time of writing the petition on Wednesday, 22 May 2013, it had 125 signatures backing Shandra's representation, but many more are needed to exert pressure on Google to change its policies. If so many of us want to prove ourselves as champions for the cause of accessibility, let's not hesitate to carry the torch for our rights of accessibility and back Shandra by signing the petition to Google. She was some twenty years younger than her husband Captain Keller, a loyal southerner who had proudly served in the Confederate Army during the American Civil War. The house they lived in was a simple, white, clapboard house built in 1820 by Helen's grandparents. At the time of Helen's birth the family were far from wealthy with Captain Keller earning a living as both a cotton plantation owner and the editor of a weekly local newspaper, the North Alabamian. Hello, With regard to the first question there is a junior level civil judge in State of TN totally blind. Some of the list members may know him and may provide the contact details. Except this, I don't know any in present scenario. So far I know and seen in practice, judges have the right to issue the directions with regard to the filing. Such as filing the synopsis of the cases in advance, which party wishes to rely upon during the hearing, filing the CD/E-copy of the petition. Since you're holding a judicial post, you surely know better than me about it. However, I'm not sure whether civil judges have power to issue such directions or not. But as you know, in High courts this practice works well. Third question will take time to answer and I will revert as soon as possible. Ironically enough, a large proportion of this population suffers gross negligence in the hands of our public institutions. It is now estimated that nearly Fifteen Million visually-impaired and around Sixty-four Million other disabled have been subjected to the cruelties of daily life, and almost all of them are living without basic amenities such as food, decent clothing, a shelter of their own and minimum education. At a time our policy echelons are busy ensuring human rights for other marginalised groups, SCs, STs and Women, here are the minuscule minority who live away in a shear silence a life that falls below the standards any civilisation can ever think of. We hope his Excellency would agree with us in a candid admission that the socio-economic backwardness of persons with disabilities in our country stems from nowhere but our own constitution that fails to make any meaningful provision for the rights of this scattered community. While Articles 14, 15 and 16 of the Constitution took extra-care to ensure the right of equality for all citizens in India, with enough safeguards for such marginalised sections as SCs, STs and OBCs through affirmative policy in education and employment, persons with disabilities have been conveniently forsaken in this thwarted war of vote-bank politics. Look at, for example, the speed with which Governments in the recent past have moved swiftly and brought about 27% reservation for OBCs in education and employment through the constitutional Amendment, and the same swiftness that can be seen in the present regime's attempt to provide 33% reservation for women through another Constitutional Amendment. Persons wi th disabilities at times really feel let down in the present political climate where every community with a sizeable Vote-bank and social capital is frequently showered with all policy concessions, whereas, persons with disabilities, who are a scattered minority at best (with very little advantage for commanding vote-bank manoeuvring in a given place), are never taken seriously by our majoritarian democracy. Consequently, the real concerns of this genuinely deprived community hardly get any attention, whatsoever. The depiction briefly outlined above may give you an impression that the signatories of this letter are unaware of the recent initiatives being undertaken by the Governments in favour of persons with disabilities, which we wish to clarify in unequivocal terms in the following lines with as much precision as possible: The socio-economic deprivation of persons with disabilities and a well-found recognition that this deprivation is due largely to lack of constitutional safeguards is neither entirely new nor has been hidden from the ruling regimes of post-independent India. The Government of India under the leadership of Sri Rajiv Gandhi set up a committee to consider legislation for the physically challenged. If your question is regarding as a advocates, there are many visually challanged lawyer are there who are working as advocate and senior advocates. I am also trying to be a judge, and preparing for judicial services, however in my native state there is no reservation against the vacancies for recruitment for judicial officers. Nevertheless I have filed a case in Allahabad high court regarding the issue. I am also not very clear what kind of work a judge can perform efficiently being a totally blind person, thats why various state governments are reluctant to prefer a blind person to appoint as a judge, but in my view he can perform the duty of a judge quite efficiently if he is provided to work in friendly environment. As in future the concept of e-filing of the cases will be in reallity, if not already in practice, then in those cases he can efficiently work on such cases. however with the assistance of next person he can accomplish all the tasks which are assigned to a judge. While hearing the cases pleaded by various noted blind advocates the court has remarked that how efficiently he has presented the case that it is hard to believe that a blind advocate is pleading the case. Department of Disability Affairs) had directed this Ministry to circulate guidelines for the purpose of conducting written examination for persons with disabilities for compliance by all concerned. In compliance of the above order, this Ministry hereby lays down the following uniform and comprehensive guidelines for conducting examination for the persons with disabilities as recommended by CCPD:- I. There should be a uniform and comprehensive policy across the country for persons with disabilities for written examination taking into account improvement in technology and new avenues opened to the persons with disabilities providing a level playing field. Policy should also have flexibility to accommodate the specific needs on case-to-case basis. II. There is no need for fixing separate criteria for regular and competitive examinations. III. The facility of Scribe/Reader/Lab Assistant should be allowed to any person who has disability of 40% or more if so desired by the person. IV. The candidate should have the discretion of opting for his own scribe/reader/lab assistant or request the Examination Body for the same. The examining body may also identify the scribe/ reader/lab assistant to make panels at the District/Division/ State level as per the requirements of the examination. In such instances the candidates should be allowed to meet the scribe a day before the examination so that the candidates get a chance to check and verify whether the scribe is suitable or not. V. Criteria like educational qualification, marks scored, age or other such restrictions for the scribe/reader/lab assistant should not be fixed. Instead, the invigilation system should be strengthened, so that the candidates using scribe/reader/lab assistant do not indulge in malpractices like copying and cheating during the examination. VI. There should also be flexibility in accommodating any change in scribe/reader/lab assistant in case of emergency. The candidates should also be allowed to take more than one scribe/reader for writing different papers especially for languages. VII. Persons with disabilities should be given the option of choosing the mode for taking the examinations i.e. in Braille or in the computer or in large print or even by recording the answers as the examining bodies can easily make use of technology to convert question paper in large prints, e-text, or Braille and can also convert Braille text in English or regional languages. VIII. The candidates should be allowed to check the computer system one day in advance so that the problems, if any in the software/system could be rectified. IX. The procedure of availing the facility of scribe should be simplified and the necessary details should be recorded at the time of filling up of the forms. Thereafter, the examining body should ensure availability of question papers in the format opted by the candidate as well as suitable seating arrangement for giving examination. X. The disability certificate issued by the competent medical authority at any place should be accepted across the country. XI. The word “extra time or additional time” that is being currently used should be changed to “compensatory time” and the same should not be less than 20 minutes per hour of examination for persons who are making use of scribe/reader/lab assistant. All the candidates with disability not availing the facility of scribe may be allowed additional time of minimum of one hour for examination of 3 hours duration which could further be increased on case to case basis. XII. The candidates should be allowed to use assistive devices like talking calculator (in cases where calculators are allowed for giving exams), tailor frame, Braille slate, abacus, geometry kit, Braille measuring tape and augmentative communication devices like communication chart and electronic devices. XIII. Proper seating arrangement (preferably on the ground floor) should be made prior to the commencement of examination to avoid confusion or distraction during the day of the exam. The time of giving the question papers should be marked accurately and timely supply of supplementary papers should be ensured. XIV. I could not take much time to go through the entire website, however, I will endeavor to do it soon whenever I get some time. I have tried to open E-VERSION link of this site and found more defects related to edit box again. Two out of 4 edit boxes are not labeled in accordance with the accessibility norms.
