[AI] CPI(M) Stand on the Disability Bill
Dear All We all must thank CPI(M) and Sitaram Yechury who demanded for refering RPD Bill to the Standing Committee yesterday and represented the legitimatd demands of majority of persons with disabilities. we should not forget disabled have no representation in either of the houses. and if Seitaram sir has not raised this demand our lives would have been in peril. what we want debate and discussion in the parliament on RPD. isn't disability a national issue? formost India should legislate its law on disability in harmony with UNCRPD which current law has intentially ignored. Now attempts are on to vendalise and attack CPI(M) Office, we all should unite to condemn such attempts, and lets be united to fight against such individuals and groups who for scoring political points are hastening RPD Bill for passage which has countless inadequacies. Many thanks to Sitaram Yechury and CPI(M) JNU blind students and scholars are greatly indebted to CPM and sitaram Yechury who became the powerful voice of the disabled in the Rajya Sabha. We hope CPM will not succum to any pressure exerted by some of the politically motivated groups and individuals. I would like to reiterate what I told you on the phone, the pressure should be on the government to move the official amendments on the floor of parliament, in the few days it has left of this last session. The onus is on the government, not parties like the cpim who have been uncompromising in their wholehearted support for the disability rights movement. Press Information Bureau Government of India Ministry of Social Justice & Empowerment 07-February-2014 20:46 IST Cabinet Approves Amendment to Rights of Persons with Disabilities Bill 2014 The Cabinet on 6 February, 2014 approved the proposal of the Department of Disability Affairs to incorporate amendments in the proposed Rights of the Persons with Disabilities Bill, 2014, which are:- - Definition of person with disability in terms of interaction with barriers also; - High support needs person enabled to take independent and inform decision also; - Definition of low vision will be notified by the Government; - The appropriate Government to take necessary steps to ensure reasonable accommodation for persons with disabilities; - No person with disability will be discriminated on grounds of disability; - Appropriate Governments to ensure that the persons with disabilities enjoy legal capacity on an equal basis with others, in all aspects of life to have equal rights as any other person before law; - Recognizing legal capacity of person with disability, limited guardianship would be the norm, to enable the person with disability to take joint decision with legal guardian; - Person with disability would also have the right to appeal against the decision of appointment of legal guardian; - Disability Certificate to be valid across the country; - Educational institutions funded and recognized will have to provide inclusive education for children with disability; - The appropriate Governments to constitute to expert committee with representation of persons with disabilities for identification of posts for Government employment for persons with disabilities; - Review period shortened from 5 years to 3 years in case of identified posts; - 5 per cent vacancies reserved for persons with disabilities will be computed against the total number of vacancies in the cadre strength; - National Commission and State Commission will have power to exempt any post in an establishment from the purview of reservation for persons with disabilities; - For greater coverage and employability in Government sector, the appropriate Governments to prescribe relaxation for upper age limit for employment of PwDs; - National Commission shall formulate and enforce regulations. The Rights Bill without rights in the present global context is a mockery in itself and any bill will just be nothing more than another semantic exercise. We must remember that even with the 1995 Act, we have to wait till October 2013 when the Supreme Court have to intervene thanks to Mr. Rungta. There is a great deal of difference the way the 1995 Act was formulated and the New Rights Bill being conceived today. 20 years ago when the 1995 Act was prepared, many of us must be students and today we are well matured, well informed and motivated enough to shape our destiny for ourselves and even for future generations. Nothing About US without US! Global perspectives on disabilities have considerably improved and we cannot afford to lag behind. Hense all efforts must be put right now for the best bill possible. Let us all strengthen Mr. Rungta and Mr. Dipendra at this most momentous juncture. Now that the Bill is tabled in Rajya Sabha, focus must be on the necessary additions and amendments. We should raise our issues with the members of the Select Committee of the Rajya Sabha. We can have more informed debate on the Rights Bill during the AccessINdia convension. hi all. i have 1 retainer client who i need to attend to for computer repares and all what i came to know is when the owner of the office is not in office the people waste time by streaming videos from youtube download songs and all. so the owner asked me if i can fully disible access to the internet. now i had 2 options unplugging the lan cable or disconnecting it from wifi or turning air plain mode on on windows 8.1 and as the people are not that tech oriented they wont know if its on but i cannot do this as the pc is connected to a network scanner so it wont work i could compleately remove ie firefox and crome but there is a posibility that people can bring it on pendrive and install it can some1 suggest me something? i think a pairental controle would do this but which 1 should i install? i only want the pc to connect to the internet only to scann download windows updates download antivirus updates and thats it not even google can open on the pc Time to meet up again! Dear friends, You can do it easily with Vinux. Vinux is a customised version of ubuntu which allows a VI to run and install vinux independently. Actually, you don't even need to install vinux to use it. You can boot it from the pen drive and easily accomplish the partitioning tasks with utmost ease. Unfortunately, as in many cases earlier, this government has shown utter carelessness for public opinion and in this case, the opinion of the concerned public is so fragmented that they will have free hand. I remember having participated in several such discussions. But as it turned out: we are being handed a raw deal. Our sector is legitimately upset about this. Congress, BJP, Communists or any one do not really care for us. None of the senior parliamentarian is ever concerned about disability. India ratified UNCRPD without reservations: This could have meant 1 of 2 things: either the nation is serious to change the entire legal regime to bring it in tune with the Convention or (and this is more likely in our case) just ratify the damned document and make disabled happy. I am still perplexed as to how are we going to have UNCRPD implemented merely by having the new disability law (certainly not this one with all its inadequacies) when there are so many laws that run counter to the Convention. This sure needs to be kept in mind by us at the time of considering the new law and should also insist in the amendment of the other relevant laws. If the present draft bill fails to clearly define low vision, does not have adequate penal provisions, has weak institutions to monitor and enforce the law, justifies discrimination on ground of disability for furthering so-called legitimate aims, places persons with high support needs in pattronage of RCI, does not say who may be included in high support needs, and so on, why should we have it in the first place?
