Good, this judgment will have an implication over the similar issue. It will directly impact my petition which is pending there in Allahabad on the subject of reservation for visually impaired in civil judge posts. http://timesofindia.indiatimes.com/city/chennai/Keep-judge-slot-for-70-blind-lawyer-SC-tells-Tamil-Nadu-govt/articleshow/48125589.cms CHENNAI: A CBI prosecutor suffering 70% blindness is close to realizing his dream of becoming a judicial magistrate, as the Supreme Court has directed Tamil Nadu government to keep one post of civil judge vacant for him. An interim order to this effect was passed by a bench of Justice V Gopala Gowda and Justice S A Bobde on July 10. Though V Surendra Mohan, 29, of Thiruvotriyur in Chennai got through written examination his name was not shortlisted for viva voce. He filed a writ petition for inclusion in the interview list. As an interim order, the court allowed him to take part in the interview and the result was kept in a sealed envelope. When it was opened after a later order, it was revealed that Surendra Mohan had secured 178 marks out of 400 in written examination, and 38.25 marks out of 60 in viva voce. To a court query, Tamil Nadu Public Service Commission said he was well within the zone of consideration and appointment for a civil judge post. However, he was not considered for appointment since he suffered more than 50% visual disability, whereas a proposed amendment to rules limited the disability between 40% and 50% for eligible candidates. On June 5, the high court upheld his exclusion saying, Taking into account the nature of duties to be performed by the civil judge, the government in consultation with the high court, had proposed to restrict the applicability of the benefit of reservation only to those whose disability ranges from 40% to 50%. Surendra Mohan took the case to the Supreme Court saying the high court wholly erroneously relied on admittedly a 'proposed amendment' to deprive him of his right to be appointed as a civil judge on the basis of his partial blindness as provided under the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995. The judgment proceeds to reject the petitioner's claim without either an executive order or an amendment coming into force, he said, adding, without the law having been changed, there was no basis for the judgment at all. Reiterating that there is no way he could be excluded from the selection process, he said a GO dated April 11, 2005 clearly notified that PB (partially blind) persons are eligible for civil judge post. The petitioner, who has 70% partial blindness, cannot in any way be excluded from the recruitment, he said, adding that the high court judgment overlooked the overwhelming discrimination in the system against the disabled, and in an egregious step it excludes the only fully eligible blind man. George sir, the above candidates are from 2014 bache of civil services examination. While Beno qualified last year, mean in 2013 civil services exam. That's why after initial training she has been appointed, and the candidates who qualified this year will go for their respective services training and they will be appointed next year. Yes, out of these 14 VH candidates, only 3 are genuine blind. Rest are merely blind on documents. Even most of these candidates wrote their exam by themselves and they availed the extra time. So the things are not clear as they should be. I heard somewhere, even few of them failed medical test where medical board didn't find them a blind person. Dear Friends, I am going to be dignified with my complaint. I have been banking for some time now with ICICI Bank. I was perfectly happy with their internet banking. Suddenly they have made changes in their website and I cannot even find the login link/button. I wonder if the people who run such functions in the bank and the developers have a clue about accessibility. We are talking of digital India and our Ministry is talking of Accessible India. I shudder to think as to where we are heading for if 99% of the software/website developers in India do not know the A of Accessibility. But fighting with fake cases, and identifying such persons is very difficult. Some people don't look blind at all, but they are indeed visually impaired. While in some cases the condition is reverse. Say for e.g. in my case, people are always confused whether I am a visually impaired? Because there is no deformity in my eyes and I can do most of the tasks independently, but my near vision is extremely bad, I can not read the printed text except large font. We are standing at a very critical juncture. On the one hand, obtaining disability certificate is proving next to impossible for genuine disabled people; on the other hand, non-blind people are bribing and availing it with ease. The government data says 62 per cent of people with disabilities are denied of the disability certificate. Hence the rule was relaxed few years ago and primary health centres were authorized to examine and issue certificates. As a result, many non-blind easily duped the officials and got away with it. We need to be mindful of the fact that the coming days will be challenging for totally blind people. Exactly for these reasons, one of my friends often puts pressure on me saying start working and find job and get settled. Who knows, amidst growing unemployment in the country, the easiest way could be attempted by many for availing jobs. And becoming blind is simpliest of option available for availing employment. How to withstand this mal-practice is not in our hands. We could only raise issues but the government is stuck in dilemma cause data suggests that the 68 per cent are yet to get certificate. And rutine media exposures put pressure on the government whose welfare policies are not reaching to the targeted population.
