Courts across the world, including India, havehistorically considered mental illness as a mitigating circumstance forimposition of lenient sentences as the offender, because of his mentalincapacity, seldom knows the consequences of his action, which becomes acrime. But this is the first time that the SC, through a bench of Justices NV Ramana, M M Shantanagoudar and Indira Banerjee, took note that punishmentis a communication from the sentencing system to the criminal about theconsequences of his action. When a condemned prisoner loses cognitive powerbecause of postconviction mental illness, the essence of that communication- consequences of the crime - is lost, it said. Writing the judgment for thebench, Justice Ramana said, The notion of death penalty and the sufferanceit brings along causes incapacitation and is idealised to invoke a sense ofdeterrence. If the accused is not able to understand the impact and purposeof his execution because of his disability, the raison detre for theexecution itself collapses. When such a disability occurs, a person maynot be in a position to understand the implications of his actions and theconsequences it entails. In this situation, the execution of such a personwould lower the majesty of law, Justice Ramana said.This judgment came in a petition seeking review of the SCs 2008 ruling inwhich it had upheld the death penalty awarded by the trial court and BombayHC to a person, referred to as X by the court, for sexually assaulting andmurdering two minor girls in December 1999 at Gulumb in Maharashtra. Whilerelieving him of execution, the SC ordered that he should be kept in jailtill death as given the serious crime, it would not be safe to send him backto society even though he has spent 20 years in prison, 17 of them on deathrow. Realising that this ruling could be misused, the SC warned thatpost-conviction mental illness could not be used as a ruse by condemnedprisoners to escape the noose. This ground needs to be utilised only inextreme cases of mental illness... only extreme cases of convicts beingmentally ill are not executed, the bench said. This court cautions againstutilisation of this dicta as a ruse to escape the gallows by pleading suchdefence even if such ailment is not of grave severity, it said. The JusticeRamana -led bench laid down the test of post-conviction severe mentalillness as a ground for non-execution of condemned prisoners. The testenvisaged herein predicates that the offender needs to have a severe mentalillness or disability, which simply means that a medical professional wouldobjectively consider the illness to be most serious so that he cannotunderstand or comprehend the nature and purpose behind the imposition ofdeath penalty. These disorders generally include schizophrenia, otherserious psychotic disorders, and dissociative disorders with schizophrenia,the SC said. Justices Ramana, Shantanagoudar and Banerjee discussed indetail judgments from the US and UK Supreme Courts on this issue besidestaking note of the related global judicial trends on post-conviction mentalillness of condemned prisoners. They said, It is a well-acknowledged factthroughout the world that prisons are difficult places to be in. The WorldHealth Organisation and the International Red Cross identify that multiplecircumstances such as overcrowding, various forms of violence, enforcedsolitude, lack of privacy, inadequate healthcare facilities, concerns aboutfamily etc can take a toll on the mental health of prisoners.The SC said, Due to prevailing lack of awareness about such issues, theprisoners have no recourse and their mental health keeps on degrading day byday. Madam, i have had the opportunity to arrange for training and funding of the SHGs. The training module was provided to the trainers by NABARD. They have a training division headed by a senior manager. The funding was arranged through the lead bank of this area i.e PNB. A Group of Blind boys and girls performed a Musical Concert and a Skit or Glaucoma awareness at the Haryana Raj Bhawan on Sunday.The programme was organised by the Glaucoma support group of post Graduate institute of Medical research (PGI) Chandigarh, Presided over By the Haryana Governor, Director PGI, Chief of the Glaucoma support group and a team of Doctors - Eye specialists of PGI. The Chief Secretary of the Govt. Of Haryana also graced the occasion.Over 200 persons enjoyed the musical evening and the sumptuous tea at the expense of Haryana Govt. The participants, represented a cross section of citizens, associated with PGI Glaucoma Support group, the Doctors and those connected with the blind,The governor granted rupees 2 lacks to the Glaucoma Support group and rupees 1000 each to the blind performers besides Souvenirs were given to them by the glaucoma support group.While about 200 hundred citizens were made aware about the silent on-set of glaucoma and the need to be vigilant in the confines of the Raj Bhawan; a larger audience would have been possible at the Tagore Theatre or the PGI Auditorium. While the blind girls and boys performed gleefully, enthralled by the opportunity to perform before a VIP gathering their introduction and names were strikingly missing through the program. Probably the Blind are destined to be identified as Blind only and are not expected to be recognised as human beings with a name, esteem or identity. But it is a fashion statement these days to harp on the empowerment, esteem and dignity for the Blind and the disabled.However I wish to introduce all of them. Hi friends After having read and observed the contributions of my friends Young and Old, on this Forum: I find that most of the members are very enlightened and some are real intellectuals. The younger ones are TechnoSavy having varied expertise.So I decieded to seek help. I am needing an electronic device to function as a scribbler/ NotePad, to write notes, make lists or small Memos which are printed/ produced on thermal paper: Since I have not learnt Braille and am unable to use a Braille device. Most of you must have come across hand-held devices used by sales people in the airlines or elsewhere. They handout a printout of the invoice of the item purchased by you from them. These devices are programmed to printout item description and prices. However, I need a device which can print out anything typed through the traditional or qwerty keypad. The size of the device can be like a mobile phone or a tablet. I had requested Barrier Break also to consider for TechShare: but got no. Please do let me know if any such device is available in India or Abroad and how to obtain it. Dear young and senior friends, agreeing with Pooja mittal that only the needy can appreciate the needs of others ; I suggest Mr. S K Rungta NFB, Dr. Anil Aneja, Mr. Javed abedi and other stalwarts must take up the issue of appointment of a disabled expert only as the state disability commissioner, in every State or UT. The PMs own state Gujarat had a VI Disability Commissioner, appointed by Mr. Modi , a few years back. In most states and UT s the Secretary Welfare of the concerned state has been notified as the Disability Commissioner also but they hardly find time for the petitions, the NGOs or any other important work related to disability . Nor are they easily approachable to the disabled. A provision in the PWD Act for selecting a State Disability commissioner from amongst the disabled only, shall be imperative . I shall look forward to the list members views on this issue. Dear young and senior friends, agreeing with Pooja mittal that only the needy can appreciate the needs of others ; I suggest Mr. S K Rungta NFB, Dr. Anil Aneja, Mr. Javed abedi and other stalwarts must take up the issue of appointment of a disabled expert only, as the state disability commissioner, in every State or UT. The PMs own state Gujarat had a VI Disability Commissioner, appointed by Mr. Modi , a few years back. In most states and UT s the Secretary Welfare of the concerned state has been notified as the Disability Commissioner also, but they hardly find time for the petitions, the NGOs or any other important work related to disability . Nor are they easily approachable to the disabled. A provision in the PWD Act for selecting a State Disability commissioner from amongst the disabled only, shall be imperative . I shall look forward to the list members views on this issue.
