Hi Misba,

Thumb impression has been defined under General Clauses Acts of
various state governments and central government as follows: “Sign”
with its grammatical variations and cognate expressions, shall, with
reference to a person who is unable to write his name, include,
“mark”, with its grammatical variation and cognate expressions.

While I do not know the legislative intent behind this definition
which was written in 1897, but given the fact that at that time
literacy rate was low so it may have been very well defined in such a
way so as to give legal status to those persons' signatures who were
unable to write their name on account of lack of necessary skills
which would enable them to write their name using the traditional
means.

But today, given the advancements, this argument should be
well-founded that a person with blindness who uses thumb impression
for signature is unable to write on a paper due to absence of sight
despite being qualified otherwise.

As far as verification of thumb impression is concerned, it is done so
that in case of legal disputes the mode of proving a thumb impression
becomes easy which may otherwise be hard.

When I wanted to have my Demat Account I didn’t have to face any
difficulties however they did suggested me not to take Online facility
and use a cheque for transaction purpose but I manage to explain them
that there is no security risk if they offer me Online Account, I am
having Demat Account with Tata Capital Securities.

Technically speaking, you had two options: 1st was to request two
senior employees of the brokerage house to attest your thumb
impression and 2nd is to get it notarized, in which case brokerage
house can very well ask for the charges which they have incurred (try
and get an invoice for it as they are corporates and their notary
official should not have any problem in issuing an invoice). But if
you have opted for notary, the broker is not liable to pay any charges
incurred for the same.

Hi!

When I wanted to have my Demat Account I didn’t have to face any

[AI] Problems in opening Demat account

Friends,
In the month of December, I  filled a form for opening a demat account at:
www.angelbroking.com
Their agent contacted me and took all the relevant documents including NSDL 
circular  to open the same. Instead of a cancellation cheque, I submitted cover 
page of my passbook stamped with MICR and IFSC code.  As I put thumb impression 
in the application form, they asked me to notarise the same. And, I was also 
assured they will bear the cost.  With their employer, I approached an advocate 
and all the documents were notarised.
But now they are  asking me to notarise one more document and pay the cost of 
all the  notaries done till this date.  The cost is around Rs.800.00
Now my question to learned legal experts of this group is:  Do I have to go to 
the notary and pay all the cost?  or should I drop the agency and go for the 
new one?  Please also let me know who in SEBI entertains our grievances.

Sanjay, You may logg the grivience to SEBI on:
scores.gov.in

You need to register on the web, fill in all the relevant details,
attach all the necessary documents scanned copies and the problem will
be addressed.
