I went though this with Yahoo in the early 2000s.   Their basic argument is
that their mark is included in your mark and they want your domain.  They
are domain bullies.   I went ahead and purchased your app because it sounded
pretty cool.  I wish the best for you.

I'd have to side with Twitter on this one:

1) From your domain name, I don't know that you aren't part of Twitter(tm)

2) Your service seems to be trying to circumvent what they are doing 
rather than just adding value to it.

3) You are using a Twitter-like bird in your logo at the top.

I bet if you changed your domain name, changed your service name, 
created a different logo, and stopped infringing on their trade mark 
you'd be fine.

I'll bet the Twitter TOS grants you rights to their API as long as you 
are only adding value and not trying to lead customers away from 
Twitter.  They have the right to put something like that in there TOS.

Then again, your app seems to heavily hit the Twitter API with 20,000 
API calls an hour?  I bet you don't pay monies to Twitter for all that 
system usage yet you are making money from sales of your app at $10 per 
license.  If you sell 10,000 copies of your code, Twitter has to suffer 
through 20 million API calls per hour (480 BILLION calls per day) and 
you get to have $100,000.  That doesn't seem fair does it?

reasonably surmised to mean that they might sue you in the future, but

your product inoperable by denying your existing client base access, then
may still come back at you.  I'd be prepared to launch a second and

to go to court if you fail to observe any of the conditions in the order.  One
of those conditions was to cease violating their Terms of Service, which any
subsequent application would also do.

This really has nothing to do with Obama.  As for the Cease and Desist
order, I will certainly side with Twitter on this one.  You have chosen to
use a trademarked name as part of your domain and offer a service that
violates the TOS that YOU agreed to when you created your Twitter account.

This isn't the end of 3rd party developers, and Twitter isn't suing you,
yet.  If you have a valid argument, make one.  Otherwise, comply and in the
future be more careful.

Nowhere does the letter say Twitter is suing you.  It is a cease and
desist letter.

I suppose their threat about further action at the bottom can be
reasonably surmised to mean that they might sue you in the future, but
that is a far, far cry from Twitter is suing me!

have you actually violated anything ?? IP my ass... you simply used their
published API and wrote an application which might be better then theirs,
simply reply by asking them to state explicitly, what parts of the terms of
services you violated, and no you should not have to simply just turn over
the domain name because they used a workd from websters dictionary which
just happens to be part of your domain name hell i could register a
abirdtwitters.com ... a site about songs from various species around the
world... go ahead... sue me... bring it on.. be very polite with your
request, or have an attorney do it for you best proactices are always
thru legal means who knows you might have stumbledupon ( LOL ) future
things they were thinking about or considereing and beat them too it at
least validate this isnt an idle threat and their letter actually merits
some review, dont let it be scare tactics to drive technology you wrote
based on their API into the ground

 fighting their own third party API developer community !!

 twitter API was built in the first place if they want to sue people for
 using it.
