I have to ask how you got $20,000 in damage and no injuries. YIKES! Unless you 
are suing for emotion distress or something, you might end up getting paid out 
in full by the jetski place and not have a basis for suing. Make sure you keep

In the accident which I described, my boat sustained literally no damage.
No injuries.  And the insurance pay out was $30k.  Fortunately, we just
renewed our policy and it appears that there has been no increase in the
premium.

Thankfully, we were not hurt, and the renters climbed back on the jetski and 
returned to the rental company.  However, I want to recover the deductible and 
get anything depreciated repaid as well.  

 

Yes, I already have the insurer involved, and they will help, but I'm 
sufficiently angry with the rental company for not keeping them out of the 
deepwater channel I really want to go after them.

 

We've had lots of close calls with their renters before, and I want to get them 
to tighten the training.

A release of liability only means the renter won't sue the rental company.  
Notify your carrier and tell the rental company you want the name of their 
insurance company and that they are full of sh*t.

Your insurance will be immensely helpful.  Right, wrong, or otherwise they
will ultimately make a decision that makes the most sense and they have an
obligation to represent you.  In principle you may not get exactly the
solution you want but I can say with confidence that it will be a solution
in everyone's interests.

I was slipped sideways into another vessel's wooden bowsprit last year.  I
was not even making 0.25 knots which was actually part of the cause -
little to no steerage.  In getting off the sprit it kinda crushed and
collapsed, the way 80 year old wood is prone to doing.  The carpenter said,
"Oh yeah a bowsprit that's easy!  Low price would be about $3000.  High
price around $5000."  When they came and inspected the vessel they walked
away saying that the only proper repair would be to dig back and find solid
wood but that the extent of the preexisting decay was unclear and a new low
price was closer to $12k.  The insurance assessor said the same thing.
It's akin to an errant shopping cart knocking the bumper of off a historic
vehicle.  There was clearly an underlying problem.  Is the offender
responsible for cost of repair for pre-existing conditions, arguably no.
Well ultimately my insurance company paid $30k!  The boat had been
purchased 8 years prior for $55k.  The insurance company was as upset about
it as I was and the other owner continued to accused everyone involved of a
myriad of things, least of all not paying enough to compensate for the
damages.  In commiserating with the insurance adjuster he recognized the
injustice but argues that wasting more time and resources was more costly
than just paying out.  Other boat owners approached me privately and
supported me by saying that they had been worried about the condition of
the damaged boat.  They even suggested that the accident may very well have
saved the owners life should he have attempted to sail the vessel only to
have it collapse around him.

the vessel at the time. Find out if Florida has similar laws. The release

reports?  If nothing, get something soon.

Let your insurance company handle it. Then sue the rental company in small
claims court for any deductible that you may have. The rental company's
insurance should cover your loss. Then they can go after the renter. Be
careful that you don't sign any release that may keep you from recovering
the deductible.

Usually your insurance deals with their insurance. I would have your 
lawyers from your insurance deal with their lawyers instead of trying to 
DIY.
