AN HONEST MISTAKE

 In the land of the blind, the one-eyed man is
king. I've always loved that ancient saying, whose
author seems to be unknown.
 But in the age of democracy, it needs to be adapted:
In the land of the blind, the one-eyed man loses every
election. Not quite as snappy, maybe, but it meets the
facts.
 By now every blind American has heard that arms
inspector David Kay has exploded the Bush
administration's justification for preemptive war on, and
regime change in, Iraq: the dogmatic accusation that Iraq
had weapons of mass destruction. One-eyed Americans
doubted it all along.
 Of course the U.S. Government and its chief allies
have those weapons, which is why they aren't called by
their right name: weapons of mass murder. And it's a bit
odd for the one government that has actually dropped
nuclear weapons on cities to claim exclusive moral
authority to decide who else is worthy to possess them.
 But never mind all that. The Bush administration and
its supportive cadres of neoconservative war nerds
insisted that there was no doubt whatever that Saddam
Hussein had such weapons and was prepared to use them;
Britain's Prime Minister Tony Blair said they could be
deployed within 45 minutes. It was urgent to act. The
risks of inaction are greater than the risks of action,
said Vice President Dick Cheney, action meaning war.
 Well, there appeared to be virtually no risk for the
administration; a quick U.S. military victory was a
foregone conclusion. Who knew that after the war, a U.S.
arms inspector would find that Saddam Hussein was telling
the truth, while George W. Bush was lying?
 Lying? Well, Bush's apologists are now trying to
pass it off as an innocent error. He was misled by the
Central Intelligence Agency and other intelligence
services, and he made the only decision he could have
made in the circumstances. Bush himself still insists
that the war was justified.
 Pardon me, but when you pretend to have a certainty
you don't have about so serious a matter as war, you are
lying. Bush left no room for doubt. He didn't say,
According to our best intelligence, Iraq has weapons of
mass murder and is prepared to use them on us. Of course
we can't be absolutely sure, but we can't afford to take
chances. He made the unqualified assertion that there
was no alternative to war.
 Millions of people around the world, without
privileged knowledge of that best intelligence,
disputed this. They didn't believe that Saddam Hussein
had those weapons or would be lunatic enough to use them.
And they mistrusted Bush and Blair.
 So are these great war leaders apologizing for an
unnecessary and aggressive war, the kind that once sent
German and Japanese dignitaries to the gallows? At this
point we must make a fine distinction: the Nuremberg
principles were never meant to be applied to the victors.
 No. Hey, honest mistake! Bush has now agreed to an
official investigation to help him find out who was
pulling his leg about those alleged weapons. It wasn't
his idea. He only works here. He was just following his
advisors. Anyway, we've brought democracy to Iraq. Isn't
that the important thing?
 But Bush can't afford to blame, and ax, CIA chief
George Tenet, the Man Who Knows Too Much. Maybe we'll
soon hear that Tenet too was only following his
underlings.
 Now even the most skeptical opponent of the Iraq war
must deal with the fact that Bush, Blair, and their cabal
were lying even more brazenly than anyone, except maybe
Noam Chomsky, dared suggest. We assumed that they must
know something we didn't, or why would they risk a raw
deception that would blow up in their faces if those
weapons weren't found?
 Now we know there were no weapons to find. Saddam
Hussein didn't have enough materiel to deter, or even
impede, an American invasion. The sad sack dictator may
be shocked to learn how harmless he actually was. But
that's why he's the one who will be tried for crimes
against humanity.
 And what about little Ali Abbas, the boy who lost
his entire family and both arms when an American missile
hit his Baghdad home [see the column of May 29, 2003]?
Well, he'll have the consolation of living in a
democracy. When he's a little older, he'll be able to
vote, if he can hold a pencil in his teeth.

NEW YORK (AP) -- Although privacy worries led several states to pull

out of a federally funded crime and terrorism database project, others

are actively considering joining and thereby sharing information on

their citizens, The Associated Press has learned.


Mark Zadra, chief investigator for Florida state police, which runs

the Matrix project, said organizers have given presentations to more

than 10 Northeastern and Midwestern states in recent weeks, arguing at

each stop that the database is an invaluable law enforcement tool.

   

Officials in Iowa and North Carolina said Friday that they are

exploring the system. And documents obtained through a public-records

request in Florida indicate Arizona and Arkansas also may have

interest in the quick-access information repository, which combines

state records with 20 billion pieces of data held by a private

company.

   

For now, Matrix -- short for Multistate Anti-Terrorism Information

Exchange -- involves Florida, Connecticut, Pennsylvania, Ohio, New

York and Michigan.

   

Utah's governor said Thursday that she was halting the state's

participation, which was launched under her predecessor, and

appointing a panel to examine security and privacy issues.

   

Another state once involved, Georgia, said Friday it is now dropping

out completely -- after the AP confronted officials with documents

indicating the state was continuing to participate despite a public

proclamation to the contrary in October from Gov. Sonny Perdue.

   

Law enforcement officials say Matrix is an ultra-efficient way for

investigators to get information about suspects that authorities

previously had to obtain from disparate sources. They insist it

includes only public records and does not make predictions about crime

or terrorism.

   

But privacy advocates say Matrix gives law enforcement too much access

to private details on millions of people, resembling the Pentagon

terrorism data-mining program that drew public rebuke and lost

Congressional funding last year.

   

The likelihood of Matrix expansion remains hard to gauge.

   

Bill Shrewsbury, a vice president at Seisint Inc., the company that

maintains the database, said he expects five or six more states to

join the program, though he would not specify which ones.

   

I've never shown it to any law enforcement people who didn't say: My

goodness, this is unbelievable technology. It makes our job so much

easier,' said Shrewsbury, a former agent with Florida state police

and the U.S. Drug Enforcement Agency.

   

He added, however, that if too much controversy follows the project,

all bets are off.

The Guardian

At 4am on November 12 1915, a woman named Anna Bollinger gave birth at
the German-American Hospital in Chicago. The baby was somewhat
deformed and suffered from extreme intestinal and rectal abnormalities, as
well as other complications. The delivering physicians awakened Dr Harry
Haiselden, the hospital's chief of staff. Haiselden came in at once. He
consulted with colleagues. There was great disagreement over whether
the child could be saved. But Haiselden decided the baby was too afflicted
and fundamentally not worth saving. It would be killed. The method: denial
of treatment.

Catherine Walsh, probably a friend of Bollinger's, heard the news and sped
to the hospital to help. She found the baby, who had been named Allan,
alone in a bare room. Walsh pleaded with Haiselden not to kill the baby by
withholding treatment. It was not a monster - that child, Walsh later told
an inquest. It was a beautiful baby. I saw no deformities. Walsh had
patted the infant lightly. Allan's eyes were open, and he waved his tiny
fists at her. Begging the doctor once more, Walsh tried an appeal to his
humanity. If the poor little darling has one chance in a thousand, she
pleaded, won't you operate to save it?

Haiselden laughed at Walsh, retorting, I'm afraid it might get well. He was
a skilled and experienced surgeon, trained by the best doctors in Chicago.
He was also an ardent eugenicist. Allan Bollinger duly died. An inquest was
convened a few days later. Haiselden defiantly declared, I should have
been guilty of a graver crime if I had saved this child's life. My crime would
have been keeping in existence one of nature's cruellest blunders. A juror
shot back, What do you mean by that? Haiselden responded, Exactly
that. I do not think this child would have grown up to be a mental
defective. I know it.

After tempestuous proceedings, the inquest ruled: We believe that a
prompt operation would have prolonged and perhaps saved the life of the
child. We find no evidence from the physical defects that the child would
have become mentally or morally defective. But they also decided that
Haiselden was within his professional rights to decline treatment. No law
compelled him to operate on the child. He was released unpunished, and
efforts by the Illinois attorney general to indict him for murder were
blocked by the local prosecutor. The doctor considered his legal
vindication a powerful victory for eugenics. Eugenics? Of course it's
eugenics, he told one reporter.

Haiselden became an overnight celebrity, known for his many newspaper
articles, his speaking tours and outrageous diatribes. In 1917, Hollywood
came calling. The film was called The Black Stork. Written by Jack Lait, a
reporter on the Chicago American, it was produced in Hollywood and given
a massive national distribution and promotion campaign. Haiselden played
himself in a fictionalised account of a eugenically mismatched couple
whom he advises not to have children because they are likely to be
defective. Eventually, the woman does give birth to a defective child,
whom she then allows to die. The dead child levitates into the waiting
arms of Jesus Christ. It was

An old mans anger: Absolute Friends, by John le Carr

Absolute Friends, by John le Carr, 455 pages, Boston: Little, Brown, 2003

The latest novel by veteran British author John le Carr has had a
generally frosty reception from critics on both sides of the Atlantic. The
Times Literary Supplement (TLS) intimates that his new work is little more
than agit-prop and headlines its review le Carrs agit propositions. In
particular, the TLS reviewer objects to le Carrs treatment of
contemporary American politics in Absolute Friends, declaring that the
authors indictment of the United States overshoots reasonable levels of
credibility.

In the New York Times, reviewer Michiko Kakutani has no time for British
understatement and is positively scathing in her dismissal of Absolute
Friends, describing the book as a clumsy, hectoring, conspiracy-minded
message-novel meant to drive home the argument that American
imperialism poses a grave danger to the new world order.

Kakutani has trawled the dictionary to assemble derogatory epithets to
describe the book which she states is, in turn, ridiculously contrived,
simplistic, ungainly and dogmatic, and preposterous. For Geoffrey
Wheatcroft, also writing in the New York Times, the matter is easierle
Carre is simply anti-American (see Smileys (Anti-American) People,
January 11, 2004).

Le Carr has been entertaining his readers with intelligently told espionage
stories for some 40 years. As an ex-spy himselfinitially recruited at the
age of 17he writes with inside knowledge of espionage tradecraft and the
relations and rivalries between secret services and government. Absolute
Friends is his 19th novel, but none of them has received such an initially
hostile reception as this latest. What has le Carr done that has so upset
the critics of the New York Times, among others?

Without revealing the entire plot, it is necessary to deal briefly with the
content of the novel. Its main figure is Ted Mundy, the only child of Major
Mundy, a retired British army officer formerly stationed in India and a man
with a skeleton in his closet. As a young man, Ted Mundy travels in the
1960s to Berlin and meets a German left-wing radical named Sasha his
Absolute Friend. Following the ebbing of the radical movement, Sasha goes
east and is recruited as an agent by East German secret intelligence
(Stasi), but also allows himself to be recruited by British intelligence. At a
later point, Mundy is also recruited by Sasha and also operates as a double
agent for both British and East German security services.

Mundy and Sasha are key figures in the concluding episode of the book,
which involves a bloody provocation by right-wing American political forces
and US intelligence agents aimed at discrediting left-wing intellectuals and
opponents of US politics, in particular the American-led war against Iraq.

The first point to be made is that the blusterings of critics such as
Kakutani and Wheatcroft are aimed at the relatively small proportion of le
Carrs book dealing directly with current American politics. For most of
Absolute Friends, the author is in his familiar territory, sketching out the
molding of a British spy, first during the period of the Cold War, and then
as Mundy is forced to find his feet in the unsure social and political
climate following the collapse of the Soviet Union.

In most of his spy books, le Carr has concentrated on fleshing out the
world of the post- war English spy. Drawing upon his own personal
experience (from his own family and his espionage career), le Carr has
repeatedly presented a compelling psychological

PATTERSON, La. -- Supreme Court Justice Antonin Scalia
traveled as an official guest of Vice President Dick
Cheney on a small government jet that served as Air
Force Two when the pair came here last month to hunt
ducks.

The revelation cast further doubts about whether Scalia
can be an impartial judge in Cheney's upcoming case
before the Supreme Court, legal ethics experts said.
The hunting trip took place just weeks after the high
court agreed to take up Cheney's bid to keep secret the
details of his energy policy task force.


According to those who met them at the small airstrip
here, the justice and the vice president flew from
Washington on Jan. 5 and were accompanied by a second,
backup Air Force jet that carried staff and security
aides to the vice president.

Two military Black Hawk helicopters were brought in and
hovered nearby as Cheney and Scalia were whisked away
in a heavily guarded motorcade to a secluded, private
hunting camp owned by an oil industry businessman.

The Times previously reported that the two men hunted
ducks together while the case was pending, but it
wasn't clear then that they had traveled together or
that Scalia had accompanied Cheney on Air Force Two.

Several experts in legal ethics questioned whether
Scalia should decide the case.

In my view, this further ratchets it up. If the vice
president is the source of generosity, it means Scalia
is accepting a gift of some value from a litigant in a
case before him, said New York University law
professor Stephen Gillers.

It is not just a trip with a litigant. It's a trip at
the expense of the litigant. This is an easy case for
stepping aside.

Aides to Cheney say the vice president, like the
president, is entitled to travel to vacation spots on
government jets and to take along guests at no cost.

The vice president is on duty 24 hours, seven days a
week, said Kevin Kellems, a spokesman for Cheney. His
security is important, and a certain number of people
must accompany him.

Judges are bound by different rules, however. Federal
law says that any justice or judge shall disqualify
himself in any proceeding in which his impartiality
might be questioned.

When asked about the trip last month, Scalia confirmed
that he had gone duck hunting with Cheney, but said he
did not see a need to withdraw from the case.

I do not think my impartiality could reasonably be
questioned, he said in a written response to The
Times. He said social contacts between justices and
high-level government officials have not been seen as
improper, even when those officials have cases in the
courts that concern their official capacity, as
opposed to their personal capacity.

I expect that all of the Justices were invited to the
Vice President's annual Christmas Party. The invitation
was not improper, nor was the attendance, Scalia
wrote.

This week, the justice was asked whether he had
traveled to south Louisiana as Cheney's guest or paid
for the trip. He refused to comment.

Two years ago, the Sierra Club and Judicial Watch sued
Cheney, seeking to learn whether the vice president and
his staff had met behind closed doors with lobbyists
and corporate officials from the oil, gas, coal and
electric power industries.

A judge ordered Cheney to turn over documents detailing
who met with his energy task force. Cheney appealed,
and in September, Bush administration lawyers asked the
Supreme Court to hear the case and reverse the judge's
order.

The purpose of Tenet's peroration was to get 
the President, and also his own Agency, off the hook when it comes to the 
complete absence of "weapons of mass destruction" in Iraq. Either the President 
of the United States and his advisors made it all up out of whole cloth, or the 
intelligence they were being fed was faulty. The first conclusion is not 
allowable, and so the second conclusion was the Republican line by default – and 
that, from Tenet's point of view, wasn't good either, because it looked like the 
CIA was being set up to take the fall. Thus, the speech had to walk a very fine 
line between blaming the boss, and taking it on the chin, and, when all is said 
and done, one has to say: Good job, George!

So much intelligence, so many lies. February 7, 2004 

For a long time, Scott Ritter, the UN's chief weapons inspector in Iraq until 1998, was virtually alone in expressing doubts about Iraq's weapons of mass destruction. For his trouble, he got called everything from a hothead to a traitor.
I rang him this week, on the day John Howard finally conceded that the intelligence on Iraq was faulty. Ritter still sounds like the US marine officer he once was, the voice parade-ground adamant. He doesn't accept the theory that intelligence services simply stuffed up. For him, it's a story of people bending to pressure from above,putting career ahead of country in order to tell the politicians what they wanted to hear.
In his role as a weapons inspector, he told me, he liaised with intelligence officials from Israel from 1994 to 1998. By the end of that period, Israel had reassessed the threat from Iraq, believing it had been fundamentally disarmed. In the same period, he says, the CIA came to the same conclusion. So, he asks, what happened to change that view, if not the arrival in the White House of George Bush.
Ritter still speaks the military language of patriotism and service, which he now uses to condemn both the leaders who demanded faulty intelligence, and the spineless agencies which went out to find it. "An intelligence officer's job," he said, "is never to tell the boss what they want to hear, but what the facts are. It's a job that's centred on service to country."
He lamented that not a single US intelligence officer spoke out for the truth, saying they suffered from "moral and intellectual cowardice".
I reminded him of Andrew Wilkie. Ritter responded, "I would hope the people of Australia would applaud him as a true hero and a patriot who did what was right in the face of tremendous political pressure to the contrary."
Of course, some people see Ritter as a conspiracy theorist; they prefer the Stuff-Up Theory of History. Under this version, we should stop imagining this well-oiled conspiracy, with Bush and Blair calling the shots, and instead allow for simple incompetence.
It's true the Stuff-Up-ologists have a fair bit of human history on their side. Some this week have quoted one of America's other recent invasions - that of Grenada in 1983. The prime reason for the invasion, they remind us, was to rescue a group of American medical students who were being held hostage on the Caribbean island.
Well, they were apparently being held hostage. An internal military coup was under way on the island, and the students had phoned home with news of the fighting in the streets. Their worried parents called the State Department, and one well-connected family even phoned the Secretary of State, George Schultz. As journalist Matthew Wall notes in a piece in Slate, the information then passed through the hands of Oliver North, John Poindexter and the national security adviser, Robert MacFarlane, before eventually reaching President Reagan.
By that time, the students' apprehensive calls home had transmogrified into a full-on Tehran-style hostage crisis. Send in the troops!
As Wall notes, the phone lines to the island continued to operate during the three-day invasion, but no one thought to phone the students to discover if they were in fact being held hostage. Before you laugh, I should mention that 23 US soldiers died, along with hundreds of Cubans and Grenadians.
So score that one to the stuff-up-ologists. What's different about Iraq is the amount of intelligence. In Grenada, there wasn't a single CIA agent; even the maps were old. For Iraq, there was a mountain of intelligence, aerial surveillance and weapon inspectors' reports.
It's hard to escape the conclusion that Ritter is right: this time it wasn't a stuff-up. The people of the West were fed some deliberate

 LITTLE GREEN LIES

 The best characteristics of any society can be
discovered through a careful study of what parents tell
children who are under seven years old.  You can trace what
is worst in a society by a study of what parents tell their
children from about eight years old.  They modify what they
told them under age seven.

 Don't lie, we tell our small children.  Then, around
age eight, mothers tell sons, Don't forget to send Aunt
Harriet a thank you note for those bunny slippers she sent
you for your birthday.  Sons old enough to write thank-you
notes hate bunny slippers.  But I hate them, they say.
Answer: Don't make Aunt Harriet feel bad.  So, the son
learns, Lies are OK after all.  Also, next year, Aunt
Harriet will send bunny mittens to match.

 After age seven, we are taught how to break all of the
rules that we were taught before age seven.  We are rarely
taught any rules governing the breaking of once unbreakable
rules.  We are supposed to intuit the exceptions from the
circumstances.  Being able to intuit the rules of rule-
breaking is widely regarded as a mark of maturity.
Maturity is for adults.  So is adultery, which is justified
in the name of maturity.  You'll understand when you're
older, fathers tell their teenage sons.  And the sons
often do understand when they are older.  Like father, like
son.  And, if necessary, they go on national television and
announce, I did not have sex with that woman.  And their
wives, having been betrayed this way repeatedly, then tell
the press that they believe their husbands.  They even tell
this to their daughters.  Like mother, like daughter.

 Wives are not stupid, but they are trusting.  We can
say the same thing about voters.


WE TEND TO BELIEVE THE EXPERTS

 We want to believe those on whom we are dependent.  If
we are being betrayed, then we are at risk.  If we are
being betrayed on life-and-death matters, then we are at
extreme risk.  So, in life-and-death matters, we dearly
want to believe.  We become soft touches, marks, and
suckers for those who prey on trusting souls.

 The voters know that politicians in general are liars
who will say anything to get elected.  But they except
their Congressman, who shook hands with them once at a
fund-raiser.  Parents know that the American public schools
are disintegrating.  But they except the local public
school to which they send their children, which somehow has
avoided the decay.  And so it goes, liar by liar, fraud by
fraud.  People want to believe.  The more dependent they
are, the more they want to believe.

 We are all dependent.  The division of labor makes us
rich by offering so many alternatives.  So, we transfer to
others the decision to produce a good product.  But we
learn, as President Reagan said of the Soviets, to trust,
but verify.  When a company keeps selling us substandard
products, we buy from a rival.  We retain our right to say
no.  We reserve our right to ask: What have you done for
me lately?

 This is why liars seek monopolies.  They don't like
competition.  Competition makes it profitable for buyers to
scrutinize sellers.  When there are no legal alternatives,
the buyer learns that it isn't worth the time to monitor
the exclusive seller.


THE ULTIMATE MONOPOLY

 Take a dollar bill out of your wallet.  Look for these
words:

 This note is legal tender for all debts, public
 and private.

Now, that's a monopoly!  It's a legal monopoly of debt
repayment.  The creditor must accept it.  You hold a
monopoly in your wallet.  But if you have lent money, the
debtor holds a similar monopoly in his wallet.  And the
United States Treasury holds a monopoly on us all.

March 13, 2002 -- Tom Clancy wrote two bestselling thrillers about a pilot deliberately flying a fuel-laden jet into the Capitol building and killing the President and top leadership (Debt of Honor , 1994; Executive Orders, 1996).
 What does Clancy say about the government's 9-11 story? Clancy Quote

 "Four planes? That many people willing to die for the same cause at the same time? If any writer had turned in a story like this, the publisher would have just handed it back and said, 'No way. Not believable.' "
 You will find the quote in the attached article, in which one of Clancy's big admirers, four-star general Carl Stiner, describes Clancy as a Pentagon "insider." Stiner says Clancy is granted an amazing level of access in the military because, "We trust him. We know he gets it right." It's a mutual admiration society: Clancy describes Stiner as low-key: "He's a real old fashioned Southern gentleman---who kills people."
 Think about it. Clancy is right in there with the war mongers and assassins. They "trust him;" they know "he gets it right," they give him access. In other words, the Pentagon helps Clancy when he is writing his novels. If that were not true, Clancy would not need nor be able to use "access."
 Certainly Stiner and other military officers must read Clancy's novels. How else would they know he "gets it right"?
 Now ... Clancy wrote two novels about jets being crashed into the Capitol by terrorists. But according to Congressional testimony, the military never imagined that the 9-11 scenario was possible: that's why NORAD didn't show up on September 11.
 Rubbish. The military could not have been surprised by September 11. The September 11 plot -- the slamming of fuel-filled jet planes into public buildings in acts of terror -- was hatched by their baby, Tom Clancy, obviously with their help.
 Clancy's 1994 and 1996 novels planted in the public's mind the paradigm that would be called up in 2001. The two novels prepared the public mind to accept the feasibility of 9-11.
 Even so, they over-reached. Clancy is right when he says the September 11 plot is unbelievable. Four planes? That many people willing to die for the same cause at the same time?

 Clancy, visiting New York from his home in Maryland, has accepted our invitation to tour Ground Zero, the site of the World Trade Center attack. Though Clancy is preparing to witness the disaster site for the first time, he's been here before in his imagination. For years, Clancy's writing has dared to envision, in chilling detail, what terrorists could do to America. In his 1994 novel, Debt of Honor, for example, a fuel-laden plane is hijacked by a terrorist and intentionally flown into the Capitol building in Washington, D.C.
 But what transpired on September 11 turned out to be even more terrifying than anything cooked up in The Sum of All Fears, Executive Orders or Patriot Games. And Clancy acknowledges this during his slow march down to Ground Zero, shaking his head at one point along the way, saying, "Four planes? "A widower and the father of two young boys, Baha al-Maliki worked as a hotel receptionist in the Iraqi city of Basra until September 14 of last year. That day, British soldiers arrested him and seven other hotel workers, saying they had found a stash of weapons hidden in the hotel. His family learned nothing of his whereabouts until three days later, when British soldiers came to their door to tell them he was dead. When al-Maliki's father retrieved his body from the hospital, according to Amnesty International's Khaled Chibane, "it was severely bruised and covered in blood." The cause of death listed on his death certificate, says Chibane, was asphyxiation, apparently from being hooded during his interrogation. "It was obvious that he had died," Chibane says, "as a result of torture."

Al-Maliki is not the only Iraqi to have died under disturbing circumstances while detained by coalition forces. Though they have received minimal attention in the U.S. press, allegations of mistreatment of detainees have been surfacing persistently for at least the last six months. The allegations range from generalized neglect  unsanitary conditions and exposure to the elements  to beatings, electric shock and other forms of torture."

First, don't you think the post-2004 admin should issue a book of
Goodspeak, Badspeak and Nospeak suitable for this Orwellian era? Should we

Anyway, a long time ago (when Barny Frank was just a litte fairy) we
didn't need the Orwell Book. Now we do.

Both of you guys are hand-in-hand so to speak, on the issue of homo
marriage. But look at it this way. U-S-A refused to have a king but it can
have a queen. If the Israelite King Chuck of England marries the Edomite
Queen Barny of U-S-A, what a wonderful union that will be! Queen Barny can
claim instant citizenship upon setting foot in New Edom (current called
Israel). You see where this leads?

After King Chuck (also head of the Church of England for 60,000,000
Anglicans) explains why that is a valid union under ecclesiastical law, he
can also explain why the laws of the land should be changed to allow
incestuous marriage or adult-child marriage or human-animal marriage.
Or do we just ignore REASONING when it comes to marriage law?

for Expansion of Hemp Food Industry SAN FRANCISCO, CA - U.S.  COURT of APPEALS 
for the NINTH CIRCUIT - The Hemp Industries Association (HIA), representing 
over 200 hemp companies in North America won their 2 1/2-year old lawsuit today 
against the Drug Enforcement Administration (DEA) in a decision that 
permanently blocks DEA regulations that attempted to ban nutritious hemp foods such as 
waffles, bread, cereal, vegetarian burgers, protein powder, salad dressing and 
nutrition bars.

The decision in HIA v.  DEA is a huge boost to the hemp food market, and we 
expect to see many more hemp food products on store shelves, says David 
Bronner, maker of the AlpSnack® organic hemp nutrition bar and Chair of the HIA 
Food and Oil Committee.  The three judge panel agreed with our main argument 
that the DEA's 'Final Rule' ignores Congress's specific exemption in the 
Controlled Substances Act (CSA) under the definition of marihuana that excludes hemp 
seed and oil from control along with hemp fiber.  Based on today's decision, 
the court reasonably views trace insignificant amounts of THC in hemp seed in 
the same way as it sees trace amounts of opiates in poppy seeds, says Bronner.

Background on the Hemp Food Court Decision Today's Ninth Circuit decision 
permanently invalidates the DEA's Final Rule, issued on March 21, 2003, that 
was virtually identical to an Interpretive Rule issued by the DEA on October 
9, 2001 that was invalidated by a Ninth Circuit court order issued on June 30,

In the decision, Judge Betty Fletcher wrote, [T]hey (DEA) cannot regulate 
naturally-occurring THC not contained within or derived from marijuana-i.e.  
non-psychoactive hemp is not included in Schedule I.  The DEA has no authority to 
regulate drugs that are not scheduled, and it has not followed procedures 
required to schedule a substance.  The DEA's definition of THC contravenes the 
unambiguously expressed intent of Congress in the CSA and cannot be upheld.

During the final oral arguments held in San Francisco on September 17, 
2003, the HIA argued that the DEA's Final Rule banning nutritious hemp 
foods misinterprets the CSA.  The judges were completely unconvinced by DEA 
attorney Daniel Dormont's arguments that Congress did not exempt hemp seed from the 
CSA even if the seed contains insignificant amounts of naturally-occurring 
THC.  According to the hearing transcript available at

section of the CSA 
dealing with the hemp seed exemption on three occasions by Judge Alex Kozinski.

Bush Names Panelists in Iraq Intel Probe

WASHINGTON - President Bush (news - web sites) named seven people Friday to sit on an independent study commission to look into intelligence failures on Iraqi weapons, choosing former 
1. Democratic Sen. Charles S. Robb and 
2. retired judge Laurence Silberman, a Republican, to head the panel. 
"We must stay ahead of constantly changing intelligence challenges," Bush said. "The stakes for our country cannot be higher." 
Robb, a moderate Democrat, was a former U.S. senator and governor of Virginia and son-in-law of the late President Johnson. He is married to Lynda Bird Johnson and has been practicing law since leaving the Senate. Silberman is a conservative who served as deputy attorney general in the Nixon and Ford administrations. He was named to the appeals court by President Reagan in 1985. 
Bush directed federal agencies to cooperate with the commission, which will report to the nation by March 2005. Bush said he has yet to select the remaining two members of the nine-member panel. 
Bush also picked 
3. Sen. John McCain, R-Ariz., to be a member of the commission. "In our war against terrorism, it is imperative that we guarantee the credibility and effectiveness of our intelligence capabilities," McCain said in a statement. "I will do my very best to help find the answers that the American people have a right to know." 
Bush had come under increasing pressure from Democrats in recent days in the wake of the admission by chief weapons inspector David Kay that he could not substantiate that Saddam Hussein (news - web sites) had the kind of weapons arsenal the administration maintained was in existence, and which it used to justify the invasion of Iraq (news - web sites). 
Bush also named 
4. Lloyd Cutler, former White House counsel to Presidents Carter and Clinton; 
5. former federal judge Patricia M. Wald; 
6. Yale University president Richard C. Levin, and 
7. Adm. William O. Studeman, former deputy director of the CIA (news - web sites). 
Wald, a respected former chief judge for the U.S. Circuit Court of Appeals (news - web sites) for the District of Columbia, served as a judge on the International Criminal Tribunal for the former Yugoslavia. 
In a visit to the United Nations (news - web sites), where he relied on Tenet's intelligence in a futile attempt for Security Council backing for the war, Powell said Friday: "I don't think any apologies are necessary." 
"It represented the best judgment we had" and "there is no evidence to suggest we were wrong,' he said. And yet, Powell acknowledged "we could not be sure of the nature of the stockpile." 
U.N. Secretary General Kofi Annan (news - web sites) said, "It is ironic that Secretary of State Colin Powell (news - web sites) is in the building. There has been some damage. Damage that probably will take some time to heal. People are going to be very suspicious when we try to use intelligence to
 justify certain actions." 
But, Annan also said that intelligence is necessary for government work and said that "we need to be careful not to throw everything out of the window." 
Bush had initially opposed a commission, but agreed to do so as calls grew from Republican lawmakers as well as Democrats. But the White House said the commission would look beyond problems in Iraq and examine the handling of intelligence on terrorists and U.S. adversaries. 
Democrats said any commission appointed solely by Bush could not be considered independent and objective. They have called for an examination not only of the work of intelligence agencies, but whether the White House pressured analysts and manipulated data to boost the case for war.
