Steven Hill, West Coast director of the liberal Center for Voting and Democracy, aptly expressed this misconception in the Seattle Post-Intelligencer: "The point is that the Bill of Rights and Constitution were really there to guarantee the property rights of the rich and the rich wannabes. ..." The nation's inequalities, he added, "are a direct result of - not in spite of, but because of - the priority given by the Bill of Rights and U.S. Constitution to protect the private property of rich individuals and wealthy corporations over basic human rights." Yet as a recent Michigan court ruling makes clear, property rights are not primarily about protecting the "rich and rich wannabes." They are, first and foremost, about protecting those without political power from those with power. That this sounds counterintuitive only reinforces how far the nation has traveled from the ideas embraced by the founders. Consider this defense of property rights by William Pitt, the British prime minister in the late 1700s and early 1800s: "The poorest man may in his cottage bid defiance to all the forces of the Crown. It may be frail. Its roof may shake, the wind may blow through it - the storm may enter, the rain may enter, but the King of England cannot enter; all his forces dare not cross the threshold of the ruined tenement." That was - and remains - a wonderfully radical idea. Fast-forward about 180 years to 1981 and the Detroit neighborhood known as Poletown. It was a well-kept, ethnically diverse working-class neighborhood originally settled by Poles. The area had more than 1,000 homes, 600 businesses, several churches and a hospital. Nothing wrong with the neighborhood, except that it was in an area coveted by General Motors, which was threatening to build a new Cadillac assembly plant out of state if city leaders didn't use eminent domain - the power of the state to take property by force, upon compensation to the owner - and clear away Poletown. So Detroit officials, backed by influential business and civic leaders (including the Catholic archdiocese, which sided with the government rather than its own people), argued that Poletown must be destroyed for the economic well-being of all Detroit residents. The state Supreme Court agreed that the taking was legitimate, based on a questionable U.S. Supreme Court decision that stood in stark contrast to the Constitution's Fifth Amendment. The Fifth Amendment is clear about the use of eminent domain. The government can use this power, provided that it is for a "public" use. With some exceptions (i.e., to make way for railroads), the courts generally interpreted public use in the traditional way envisioned by the founders - courthouses, highways, schools, bridges, dams, infrastructure. But in 1954, in Berman v. Parker, the liberal Warren court agreed that the District of Columbia could condemn private property and hand it over to other private developers for a private gain provided that the appropriate legislative body (at the time Congress, since the district had not yet gained home rule) deemed that it is proper to do so. "If those who govern the District of Columbia decide that the nation's capital should be beautiful as well as sanitary, there is nothing in the Fifth Amendment that stands in the way," ruled the court, in a decision that read more like a chapter in a sociology textbook than a reflection of the founders' wisdom. In 1950s Washington, there was a great deal of actual blight. By 1981, the courts were saying that blight need not even be found. The mere promise of better economic circumstances for a region is a good enough "public" use to clear away a neighborhood. And although the Poletown plant is still in operation, its impact has been far less beneficial than General Motors and Detroit officials had promised. In recent years, cities in Orange County and across the country have used Poletown to justify the most outlandish schemes. Sometimes, they are stopped by courts or political pressures, but only sometimes. In Cypress, city officials voted to use eminent domain - they were stopped by a federal court decision - to give Cottonwood Christian Center's property to Costco. They argued that the transfer from Cottonwood to Costco was for a "public use" because Costco paid more taxes than Cottonwood. Garden Grove tried to condemn an entire ethnically diverse neighborhood so the

(Terrorist and Organized Crime Groups in the Tri-Border Area (TBA) of South America. Since the early 1980s, Arab terrorists have been sending thousands of their cohorts to the almost inaccessible jungle and mountain region between Brazil, Argentina, and Paraguay (known as the TBA, Tri-Border Area or La Triple Frontera). Terror training camps and arsenals have been established, virtually out of the reach of local law enforcement or defense forces; and elements from Hezbollah, al-Gamaa al-Islamiyya, Islamic Jihad, al-Qaeda, Hamas, and the Lebanese Drug mafia operate in partnership, freely and openly in conjunction with local organized crime and corrupt government officials. The TBA has become a virtual haven for Islamic terror groups and a base for terror operations against South American targets. The large and growing Arab population of these states (in excess of 750,000 by local estimates) provides a community highly conducive to the establishment of Islamic terrorist sleeper cells throughout the area. The attacks in Buenos Aires on the Israeli embassy (3/17/1992) and the Jewish Community Center (7/18/1994) are believed to have originated from terror bases in the TBA. Since the mid-90s, government forces have foiled many more terror attacks against American, Jewish and Israeli targets, arresting some of the perpetrators. CNN reported that an Islamic terrorist summit meeting was held in the TBA in late 2002, to plot attacks in South America and abroad. Security forces believe that future targets include USA and Israeli government offices, Jewish community buildings, hotels, tourism centers, airports and facilities of multinational corporations. The TBA terrorist haven also operates an immense money-laundering project, reaping profits from their partnerships with the FARC and narcotics traffickers in the widespread South American drug trade. Government estimates place the total amount of money laundered since 1992 at more than 172 billion dollars. There is currently no effective surveillance or containment of these terrorist activities. Dot #2: Increased Terrorism in northern Venezuela (U.S. News World Report, 10/6/03, pp. 18ff.) Another South American hub of Arab terrorism has emerged recently in northern Venezuela near the border with Colombia. Thousands of terrorists now occupy an unknown number of camps in that region, and move about with the support and collaboration of the Venezuelan government. President Hugo Chavez plays host to a growing horde of Middle Eastern terrorists from some of the USAs most notorious enemies, including Libya, Saddams Iraq, Syria, Egypt and Pakistan. Thousands of Venezuelan identity cards have been legally issued to these foreigners. Such cards can be used to obtain legal travel documents and passports for unimpeded entry into other South American countries and into the USA. These terror groups are known to work in conjunction with the Colombian anti-government insurgency group, FARC. They offer FARC terrorists safe haven in mountainous and unpatrolled regions of Northeastern Venezuela. They may provide Hugo Chavez with a covert force that can be used to support FARC against the Colombian government. Venezuelan cooperation with these terrorists may buy President Chavez a guarantee that terror assaults will not be perpetrated in his country. Currently there are no known terror attacks that can be attributed to these groups. Dot #3: Illegal Immigration at the Southern Border Not Just Hispanics, Anymore. (U.S. seizes 77 Mideastern aliens in southern Arizona, World Tribune, 8/2/04; Two groups of middle-eastern invaders caught in Cochise county in past six weeks, Tombstone Tumbleweed, 7/18/04; Breaking silence over possible terror threat, Defense Watch, 7/23/04.) American border patrol agents arrested 158 illegal aliens in Cochise County, Arizona, on 6/13/04. One agent, who speaks Farsi and Arabic, overheard dozens of detainees speaking Arabic in the back of the detention vehicle. He counted 53 of Middle Eastern rather than Hispanic origin. His superiors told him to keep that information to himself; but he reported it to the local newspaper, the Tombstone Tumbleweed. Just one week later, on June 21, 2004, another group of illegals were apprehended, including 24 Arabic speaking men. But at least as many or more escaped apprehension and disappeared into the United States. Border Patrol officials deny that there have been any Middle Eastern illegals among those arrested, but individual arresting officers attest to the accuracy of that

The case has split Chile's right-wing political parties and led to a bill to limit news coverage of such scandals. By LARRY ROHTER 8/8/04 Santiago, Chile - For Chile's right wing, it has become the scandal that refuses to go away. Though the "Caso Claudio Spiniak" began as a squalid sexual matter, it has been transformed into a political issue that has divided supporters of Gen. Augusto Pinochet and pitted them against an increasingly combative news media. The scandal has been agitating Chile since late last year, when María Pía Guzmán, a conservative member of Congress, denounced what she described as a prostitution and child pornography ring and accused Mr. Spiniak, the nouveau riche owner of a string of health clubs, of leading it. She said that some of her own political allies were involved. "There is evidence that within the intimate circle of Spiniak's network, there are politicians," she said, citing accounts that she said she had heard at a shelter for sexually abused youths. In the latest round of accusations, made public in July, people identified as procurers for the ring have implicated as clients the mayor of a large city and a Roman Catholic bishop renowned for his opposition to the Pinochet dictatorship. Both men have denied any involvement in the sex ring, but in a poll taken early this year, three-quarters of those surveyed said they believed that politicians were involved. Mr. Spiniak, through his lawyer, has denied that he headed such a ring. A total of 18 criminal investigations are under way, with at least a half dozen more expected to be opened soon.
