BOOK: STARR'S OFFICE PREPARED SAMPLE CLINTON INDICTMENT
WASHINGTON POST'S Sue Schmidt and TIME magazine's Michael
Weisskopf reveal in their forthcoming book, "Truth at Any Cost:
Ken Starr and the Unmasking of Bill Clinton," that the Office of
Independent Counsel under Ken Starr in 1998 prepared a sample
indictment of Bill Clinton for perjury in the Monica Lewinsky
investigation.
WASHINGTON POST'S John Mintz gets first dibs at choice cuts in
the book that is currently selling at #2 on Amazon.com's
bestseller list -- though the book does not come out until
Tuesday.
"'Truth at Any Cost' offers a detailed inside account of Starr's
investigation from the vicinity of the office water cooler. The
authors had 10 lengthy interviews with Starr and long talks with
25 assistants," Mintz writes.
"Starr's staff gathered to discuss indictment in October 1999.
'No one doubted the strength of their evidence, at least in a
perjury case,' the authors write. 'The question before them was a
matter of prosecutorial discretion.... Some at the summit meeting
argued that Clinton had suffered enough."
Mintz reports that Starr ultimately decided that he'd let his
successor, Robert Ray, make the final choice whether or not to
indict.
Mintz also reveals that most every lawyer in the OIC believed
that Hillary Clinton had lied in sworn testimony over her
Whitewater dealings but they did not have enough evidence to
indict.
According to the book:
"Virtually everybody concluded that the first lady had lied but
that the evidence was not strong enough to convict her. No one
was in favor of going forward with an indictment" including a
somber Hickman Ewing, Starr's Little Rock based deputy...

* STARR MISTRUSTED TRIPP
"'Everyone (in Starr's office) had serious questions about her
motives,' the authors write. 'They all felt used' by Tripp.
'Prosecutors shared much of the larger public's distaste for
Tripp and her clandestine taping of a friend's (Lewinsky's)
confidences.' But they concluded that Tripp was truthful about
her dealings with Lewinsky, the book says, and that they would
continue relying on Tripp."
The book also reveals for the first time, according to Mintz,
"that the night before Clinton was to be deposed in the Jones
sexual harassment lawsuit, Tripp or one of her attorneys informed
Jones's legal team that Starr had launched a probe of Clinton and
had confronted Lewinsky about it."
Tripp's attorney, reached for comment, said: "Linda Tripp was
always truthful," and refused to elaborate on the book's
allegations.
* BITTMAN CALLED CLINTON 'YOUR HONOR'
"There was the night in August 1998 when an angry Clinton ducked
away from a White House dinner party to have his blood drawn by
his physician, for DNA comparison with semen on Lewinsky's dress.
A Starr assistant who was there, Robert Bittman, became so
flustered he called Clinton 'your honor.'"
* Schmidt and Weisskopf also reveal that Starr was apprehensive
about having pursued the Lewinsky investigation after having been
pilloried in the media:
"'Starr would chastise himself for ever taking on' the probe, the
book says. Because Clinton's supporters had publicly vilified
Starr in the Whitewater investigation, Starr realized he 'should
have known he'd already reached his limit' in how much
controversy a prosecutor should court. 'When (Clinton accuser)
Linda Tripp showed up (with allegations of a Clinton affair), he
should have shown her to the door of the Justice Department' and
let it handle her, the book says Starr thought."
