REP NADLER: 'WHIFF OF FASCISM IN THE AIR'

U.S. REPRESENTATIVE JERROLD NADLER (D-NY) HELD PRESS CONFERENCE
IN FLORIDA ON SATURDAY


NADLER: We're here to express our dismay as American citizens at
the action of the Miami-Dade County board of canvassers in giving
in to mob rule, and deciding not to count--recount the ballots
when they had already decided to do so, pursuant to the election
law of Florida.

Paul Gigot in the Wall Street Journal yesterday, in talking about
the mob that assaulted the offices of the board of canvassers and
that roughed up some people says: ``Street-smart New York
Representative John Sweeney, a visiting GOP monitor, a
congressman, told an aide to, quote, 'Shut it down,''' unquote.

And then the riot started. So we have a Republican rent-a-gang,
led by a Republican congressman from New York, who says ``shut it
down.'' Let's have the mob rule and shut down a legal process of
counting ballots.

Ladies and gentlemen, I don't think I've called anything else
like this before, but I will now: A whiff of fascism is in the
air. When you can have a mob deliberately seek, under the
leadership of political party representatives, responsible
people, ``shut down the count.'' Not by court order, not by a
writ, not by a legal decision, but by intimidation and threat and
physical violence. That is intolerable. It's absolutely
intolerable.

What is also intolerable is that we know they counted 1,800
votes--I'm sorry--1,800 ballots which had not been counted by the
machines. The machines registered no vote for almost 11,000
ballots. They counted 1,800 of them, and they found 394 valid
votes for Gore and for Bush.

So we know that roughly 2,300, 2,400 of those 10,750 ballots are
valid votes.

The action of the Miami-Dade County board of canvassers in
saying, ``We're not going to count them,'' is saying, ``We're
going to disenfranchise and deprive of their constitutional
rights those people who voted and whose ballots the machine
simply couldn't read.''

But people can read. That is a violation of Florida law; it's a
violation of state and constitutional rights. It seems to be a
violation of Florida law, which says that once you've made a
decision, a finding, once you've made a finding that--an error in
the tabulation could affect the result, which they did find, that
you must then count the votes.

And they voted Wednesday morning at 9 a.m. to count the votes
that hadn't been counted by the machine, and they had plenty of
time to count those 10,750, and then they decided by 12:00 not
to. What happened between 9 and 12? Did they suddenly realize
they didn't have time enough by Sunday to count 11,000 ballots?
No. What happened between 9 and 12 is a mob threatened them,
banged on their doors, roughed up people, threatened them, and
they succumbed to the mob violence and the intimidation.

That is frankly un-American of the mob to do that, it's
un-American of the Republican leaders to lead that, and it's
un-American for the Dade County board of canvassers to succumb to
that threat.

Now I've heard some Republican orators, some Republican speakers,
say, ``Well, Jesse Jackson led a demonstration, it's the same
thing.'' There's a difference between a peaceable demonstration
outside the building, and if the Republicans want to demonstrate
outside the building, God bless them.

There's a difference between that and coming inside the building,
threatening physical violence, roughing up people,
bounding--pounding on the doors and threatening people. That is
not a demonstration. And it's an insult to peaceful demonstrators
to compare them to a mob.

So we're here to say that we are asking that the court reverse
the action of the Miami-Dade board of canvassers, vindicate the
constitutional and Florida statutory rights of these voters by
having their votes counted, and make sure that American elections
are not subject to mob rule and mob violence, and certainly not
to mob rule directed by the Republican or any other political
party.
