 You are using kernel patch 1.2.11-rc1? This patch is only for 2.4
 kernels, and 2.4 kernels are not supported in etch.
 Woa, this is new..and huge, AFAIK only 2.2 support is supposed to be
dropped from etch:

support for 2.2 kernels has been dropped (except for m68k). libc will
refuse to be installed on 2.2 kernels, the solution is to install a 2.4 (or
a 2.6) kernel before the upgrade.

If you're right then this is huge and turns debian into desktop distribution, 
i really hope you have mistaken 2.4 with 2.2.

vserver-stat doesn't work, you can't start/stop/enter any of running
vservers.

13:39  daniel_hozac however, distro packages really ought to build with 
--enable-apis=NOLEGACY.
13:39  daniel_hozac (which ironically means to enable the legacy APIs :))

this should fix the problem.

this test in util-vserver:
if [ -f /etc/vservers/*.conf ]
seems to cause error message when there is more then one legacy config active.

No, I have not mistaken 2.4 with 2.2. Have a look at the kernel
project's svn tree[1], and have a look at the debian installer, 2.4 has
been dropped.

The page you quote above also has a *very* important part that you
either have missed, or deliberately ignored:

2.4 kernels are only supported for upgrade from sarge. Users should
install a 2.6 kernel after (or before) the upgrade.

I disagree that this turns debian into a desktop distribution. I manage
quite a large number of debian servers, all running 2.6 fine. However,
this isn't a fight that you should make with me, take it to the kernel
team if you want to try and change this before etch releases.

I'm sorry, but you are out of date. Look at the Linux-vserver home page,
the patches which you are calling 'development' went stable some time
ago. There are stable vserver patches which have been released, and they
are for 2.6. There are patches still available for 2.4, but the /stable/
version is for 2.6. In fact, if you are not interested in development
patches you should be using vs1.2.10 not vs1.2.11-rc1.

Micah is correct in most things. However this is an issue when
upgrading from sarge, so that is the reason why it is corrected.
