Sure, but this is not necessarily an active decision, it could also
result from a lack of awareness of the legal situation.

Contacting them directly seems to be the way to go.

Personally I would not interpret "use" as including
modification/distribution; despite being a software developer I still
mainly interact with software by using it in the traditional
non-developer sense.
