That would be a DFSG violation, as part of the source is not shipped - thankfully, that source is restorable, because the only thing the Makefile changes is the VERSION string. You might wish to notify upstream about this problem, but it can be fixed without a new upstream release, in my opinion. I had contact with the upstream author and he gave me a workaround for the moment. He will fix it in the next upstream release. Other than this, the package looks fine, and I'll upload once the build issue is fixed (and this time, it won't take months to review the update, I promise!). Then with this preinst, you are not preserving his changes. So you have to test if the user is both upgrading (information is in $1) and is doing so from a version smaller than 0.0.5.1-1 (as it's the first version that introduces the fix) (information is in $2). Then, to be on the safe side, you also have to check that the symlink you want to remove indeed points to the place you had setup in the faulty postinst.
