It is occurring intermittently still. I can confirm this on my Lenovo ThinkPad X220 and a friend's desktop PC, both running Ubuntu 12.04 LTS. It is reproducible, but since it occurs intermittently, it makes it difficult to see. Go into Nautilus and try double-clicking items. I suggest that a bug of the trash not working in an operating system merits a label of more than low importance. A sophisticated user will figure out how to empty the trash by browsing to it, but a newbie will likely go back to Windows or Mac. It could be a deal-breaker for them.
