This is still the same in Intrepid! Basically the first time FSpot starts up it sticks all your imported photos in ~! I have confirmed this on multiple machines including x86_64 as well as i386. We ship with ~/Pictures but not ~/Photos. I had the same issue. Fspot then seems to have made the directory, but not used it.
