As far as I know: If you mean Flex 1, legally speaking, I don't think licensing would allow you to unless deployed to a location where you have a license. You can work out the legal details over the phone - the sales people are pretty good and very responsive. Technically, the Flex server will produce .swf files which you can copy elsewhere and use.
If you mean Flexbuilder 2, it produces .swf files for you.
