CASE AGAINST CITY LAWYER DISMISSED The Judicial Magistrate First Class, (JMFC) Panaji has dismissed the case filed by the Old Goa Police against Adv. Aires Rodrigues regarding an alleged trespass by him into a flat of a Norwegian national Mr. Ivar Fjeld at Milroc Complex, Ribandar. Adv. Rodrigues had stated that he had merely accompanied the police team led by PI Gurudas Gawade as they had asked him to show them Mr Fjeld's flat. In his order Judge Shinde has stated that that the conduct of Adv. Rodrigues shows that he had no criminal intention of breaking the public peace and committing any offence. The Judge has further stated that there was no whisper in the complaint or in the statement of the witnesses that Adv. Rodrigues had given any threat to Mr. Fjeld and that mere entry into Mr. Fjeld's flat by Adv. Rodrigues does not constitute an offence of house trespass. The JMFC P.M.Shinde has discharged Adv. Rodrigues of all the charges framed against him as there was no prima facie evidence to proceed with the matter and that the charges leveled were with insufficient materials. Meanwhile Adv. Aires Rodrigues has regretted that the Old Goa police succumbed to high-handed political pressures in registering a false and very fabricated case him. Adv. Rodrigues further stated that he has instructed his lawyer to file proceedings for damages against the Government of Goa to the tune of Rs 50 lakhs, and that he would donate all these proceeds to the NGO's doing the relief work for the displaced people of the Baina demolition. * * *
