[Goanet] ADVOCATE GENERAL ATMARAM NADKARNI ACCUSED OF LYING TO THE SUPREME COURT

Benjamin Franklin had said “A countryman between two lawyers is like a fish
between two cats”



It should be the endeavor of every officer of the Court to ensure purity of
justice and that in the judicial system no person howsoever high should
ever do anything to be above the law. It is expected that the Advocate
General of the State being the First Law officer would lead by example in
always being very truthful and ever so honest to the Court.



On 4th December 2012 it was submitted before the Supreme Court that
Advocate General of Goa Atmaram Nadkarni being unwell was unable to appear.
Accepting the submission at face value, a Division bench of the Supreme
Court comprising of Justice G.S.Singhvi and Justice Sudhansu Jyoti
Mukhopadhaya adjourned that matter recording personal difficulty of the
Advocate General to appear before the Court.



However, shockingly the fact of the matter is that on 4th December, 2012,
the Advocate General Mr. Atmaram Nadkarni was very much in the pink of
health and even appeared before the Bombay High Court at Goa in various
matters.  If this is the blatant misleading manner in which the Advocate
General of Goa seeks to adjourn matters, it is a very sad reflection of the
sordid State of affairs. It also shows the kind of respect which Advocate
General Atmaram Nadkarni holds for the Supreme Court, despite being the
first Law Officer of the State.



Copies of the High Court orders showing his presence in Goa while the
Supreme Court was falsely misled that he was unable to appear before the
Apex Court,  have all been now sent to the Chief Justice of India so that
he is aware of the manner in which the Supreme Court was taken for a jolly
ride and that too by Goa’s Advocate General, the highest paid in the
country.



Chief Justice of India Altamas Kabir has been urged to ensure that such
malpractices are nipped in the bud by sending a message to all that there
cannot be hide and seek with the judiciary nor the judicial system.



By the way, that case before the Supreme Court which Advocate General
Atmaram Nadkarni manipulated and managed to adjourn is a very high profile
case. Let us leave it that, without mentioning more details. It may release
a gory can of worms that may sting the Advocate General ever so badly.



I am also reminded of the words of William Faulkner “Never be afraid to
raise your voice for honesty and truth and compassion against injustice and
lying and greed. If people all over the world...would do this, it would
change the earth.”

Panaji, March 24 (IANS) Now that the Goa Carnival's samba season is well and 
truly over, get ready for the deafening cymbals of Shigmo, often referred to by 
historians as the Goan adaptation of the Holi festival.
The lull of post-carnival Lent in Goa will be broken by the Hindu spring 
festival, which, like the carnival, is marked by street parades, colour and 
fanfare and the ring of traditional instruments. The 14-day Shigmo will get 
under way on Holi, March 27.
Tourism Minister Dilip Parulekar said close to Rs.1.75 crore has been invested 
to organise this year's celebrations, as part of the state government's effort 
to promote Goa as a cultural tourism destination.

We want to ensure that Goa's traditions and culture are brought out from 
villages and showcased to tourists who come here. Our job is to bring to the 
fore the real Goa with Shigmo celebrations, Parulekar told IANS.
Parulekar said the festival would attract 100,000 tourists to the state.

The Goa Carnival and Shigmo share several common practices like parades of 
floats where khells (plays) are depicted.
Khell was originally a Shigmo custom. It was enacted on the ground itself in 
pre-Portuguese days. The Portugal-inspired carnival later started enacting 
these plays on float parades, said renowned theatre artiste and former speaker 
of Goa assembly Tomazinho Cardozo.
The traditional khell traces its origins to the classical Yakshagana dance of 
Karnataka and is based on old Hindu tales with a Sutradhar or narrator and a 
jester called a Kodangi, he added.
The Shigmo procession begins with brass bands reminiscent of the Maratha 
conquerors, followed by a series of Kunbi (an indigenous Goan tribe) folk 
dances performed by women bedecked with gold and wearing brightly coloured 
sarees.

Long before Christianity arrived, Hinduism was the major religion practised by 
Goa's people. Shigmo is a proof that Goans were fun-loving people much before 
the arrival of the Portuguese.
Besides a unique form of entertainment, Shigmo is also a cultural exhibition 
of Goa's history from time immemorial, according to historian Anil Naik.
Men march with tall and colourfully draped wooden poles to the beat of drums, 
while others dance with decorated umbrellas. Both men and women in elaborate 
costumes, representing various deities, can also be seen during Shigmo parades, 
which are held in all major towns in the state.

The procession culminates in a march of illuminated floats, atop which larger 
than life mechanical figures represent important deities and some even re-enact 
historic and mythological feats.
And this is just the kind of culturally rich and vibrant fare that the state's 
Shigmotsava committee, which organises the festival, wants to promote.
Goa is so rich in culture. Our effort is to ensure that through Shigmo, the 
village culture of Goa, is there for everyone to see, said Srinivas Dempo, who 
heads the Panaji Shigmotsava Committee.

Not all who left were Great Goans  or Great Intellectuals. Some of us little 
Goans just left because the spirit so moved usand there is no guarantee we 
will not return either because childhood memories of sweet mangoes and warm 
breezes and bright skies and friendly faces still persist.
We love comfort zones! and what better comfort zone is there than the one you 
were born and raised in? Not everybody likes to get out of their comfort zone 
and move into the unfamiliar zone! and yet, Mr. Genographic tells us:
You've come a long way baby! a 75,000 year journey form the fertile African

In just a few weeks, the very Goan name of Francisco (Frank) D'Souza
has abruptly emerged right amidst the most famous and admired titans
of global business.

While IT industry insiders and observers have long admired the
spectacular trajectory charted by D'Souza at Cognizant Technology
Solution Corp, the multinational services provider and outsourcer, the
2013 results of Glassdoor.com's global survey of more than 5,00,000
corporate employees marked an unprecedented milestone.

The 44-year-old was rated 6th best CEO in the world, polling
significantly ahead of legendary tycoons like Jeff Bezos, Michael Dell
and Larry Ellison. In breaking entirely new ground for Indian
industry, D'Souza also outranked Larry Page of Google, and Tim Cook of
Apple, who helm the giant corporations which define the current era of
the information age.

This eye-opening news came right on the heels of another amazing
breakthrough for Cognizant's deceptively boyish-looking CEO. Last
month, he agreed to join the board of General Electric, the
third-largest company in the world, with bewilderingly huge
multinational interests in energy, technology, finance, and the
consumer and industrial sectors. It is the first such appointment in
Indian corporate history. As the youngest member of GE's board,
D'Souza has become firmly established as one of the most admired
business visionaries in the world.

Looking back now, D'Souza's childhood uncannily suited the making of a
globetrotting multinational executive. While the family roots are in
Anjuna, his father Placido D'Souza grew up in Pune, and travelled the
world for more than three decades in a stellar career for the Indian
Foreign Service.

The elder D'Souza served in Switzerland, Indonesia, Kenya, Ethiopia,
as Indian ambassador to Panama, Costa Rica, Nicaragua, Zaire, Congo,
Gabon, Central African Republic and Equatorial Guinea, as consul
general to New York, and high commissioner to a slew of Caribbean
countries as well as Hong Kong and Macau.

In the wake of his father's career, Francisco lived in 11 different
countries, studying in local schools, and often in the local language.
His childhood was divided across Asia, Africa, Latin America and
Europe, which he has explained forced him to always survive and
thrive in a 'flat world' long before the flat world came into vogue.

After two business degrees (including an MBA from Carnegie Mellon),
D'Souza plunged straight into information services and technology,
from the beginning characterized by an extraordinary willingness to
adapt and reconfigure, as well as a rare appetite for risk in order to
pursue distant goals.

What D'Souza has already achieved for Cognizant is one of the greatest
corporate stories of our time. The company only came into being in
1994, more than a decade after most of its competition had already
been firmly established. As recently as 2007 (when he took over as
CEO) annual revenues totalled $1.4 billion.

It has been a stratospheric ride, as Cognizant scorched all
competitors to grow to more than $7 billion in revenues in 2012, an
astonishing 30% compounded annual growth. Often expanding at double
the rate of its competition, Cognizant has now outpaced Wipro and
Infosys, while adding more than 1,00,000 employees in just five years.
The company is now a member of the Fortune 500, the FT 500, the
Standard and Poor's 500, and the Forbes Global 2000.

Corporate dream runs like this are always diplomatically credited to a
team effort. But everyone acknowledges that Cognizant's secret weapon
is its dynamic CEO. He has consistently dared to tweak, shake up and
reconfigure existing strategies to pursue avenues that his competitors
had not even considered (like building venture-capital structures
within his own company, and repeatedly seeking advice from successful
innovators from other industries). It is surely these characteristics
which attracted GE's leadership, and earned such impressive plaudits
in Glassdoor's survey.

Quite ironically, these are also attributes we are in desperate need
of in D'Souza's ancestral land. For a very long time, Goa's business
affairs have been distinguished by a stubbornly defended status quo,
resulting in a paralyzing stasis that continues to benefit only a
handful of entrenched interests. Those with get up and go are almost
always forced to literally get up and go, and leave the state.

Thus, we see virtually no value added to Goa's economic scenario for
generations, with rampant nepotism, cronyism, corruption, and nakedly
selfish exploitation of community resources still defining business
as usual.

But stories like those newly written by Francisco D'Souza demonstrate
it is not like that elsewhere, even just across the border in other
states of India, where innumerable sons and daughters of Goa are
experiencing an entirely different 21st century. What is it

When the majority of Goan families had little in the way of affluence, they
had each other. Mother and father raised their brood usually along with an
unmarried and disadvantaged relative and sometimes a posko or poskem - an
adopted child that may have crossed their path unintentionally. 

They stopped all activity at the evening Angelus bells, then gradually
recommencing until later when they would all huddle together for the family
rosary. After, Dad would open the small wall cupboard to pour himself a shot
of well matured feni while Mum and the children would help lay the dinner
table. While the parents had their own chairs, others would squeeze on the
wooden benches beneath the simple spread of rice, vegetables and some
curried or fried fish. Retiring to the cemented balcony at the entrance to
the home, they would stretch and talk under the starry skies until sleep
first gently nudged the most tired.
 
Whatever troubles beset the family would rest solely on the broad shoulders
of the parents who would never drop even a hint to any of the others even if
the problem belonged to one of them. It seemed prayer, toil and St. Francis
would solve everything and even when it didn't there were no recriminations
that destroyed the family peace. 

Mum and Dad eventually aged to infirmity. It was the custom of the eldest
son to take over their care and he did the job uncomplainingly without
expectation of any reward of asset transfer which in any case would devolve
to all of the sons. That's just the way it was, Portuguese civil or family
law notwithstanding. In any case the assets, mainly the land and house
amounted to almost nothing. Brothers and sisters maintained the family bond
and passed it on to their children.

Eventually all that changed with the times. The price of land and homes in
Goa escalated to dizzying heights. Families grew and accommodation got
beyond the reach of average incomes. In the fight for space, elders are the
first casualty.

Goan Christians are mostly working folk. Except for a few, they are hardly
entrepreneurs or business people. With high inflation, increasing medical
and education costs and rising gasoline prices, belts have to be tightened
and the old and infirm are the first to suffer. In certain areas where
property prices have especially skyrocketed, families prefer to sell
ancestral property, divide the proceeds and go their own way. Couples want
to be independent with no added responsibilities. Father and mother cannot
manage on their own and in a short time end up in old age homes.

In many cases the younger adults have to relocate to other cities like
Bangalore, Hyderabad or Gurgaon because they are either in transferable jobs
or have found employment in these booming cities. Goa has no meaningful
opportunity for the well-educated and skilled except in the stagnating and
unregulated tourist sector which lacks any kind of self-discipline. They are
unable to take their parents along because of their uncertainties in these
newly expanding cities. Jobs in India are no more secured than in more
advanced countries. If the stress levels in these parts are high, in India
they are higher since employers while their hands are somewhat tied in the
west, have unfettered slave driving opportunities in their outsourced
destinations.

Then there are Goans who see their future in immigrating to Australia,
Canada, New Zealand and lately the UK in large numbers. They need capital to
tide them over the initial difficult phase and they tend to entice or force
their parents out of their ancestral home with the promise of providing them
with a place to live with them in their new countries. Once settled, those
old folks become either babysitters or a burden and a nuisance to their good
life, or perhaps they are still struggling and their parents would seem to
add to the problems. In some countries where medical costs are high as in
the USA or where senior or long term care homes have to be partly paid for
as in Canada and the UK, problems are aggravated.

Thankfully, Goans long established in the Diaspora, especially those from
Africa who came with young children in the 50s to the 70s are relatively
unscathed from such issues. The parents now old, have worked here for a part
of their lives and their friends and support circle live among them. There
are no unmanageable expectations and no emotional trauma of sudden
separation from a community they have lived a lifetime with.

Everybody wishes that when they get old, a heart attack, stroke or rapidly
spreading cancer quickly takes them away. No one wishes to linger in
suffering or worse still be a burden, either financial or otherwise to their
loving children. But the reality is that we live longer than ever before and
until euthanasia becomes as common as cremation, or Pope Francis threatens

If you come to Moira there are some huge banners announcing in Marathi
that from today there are going to be festivities at the Shri Devi
Sateri Devasthan in Povoacao which is close by to the Moira Church.

On Monday there is a play called Mog aso karta piso; on Tuesday it is
Papa ek Papa; and on Wednesday - Gharchi gazal gharchya ghara. All
three are Konkani plays and although the Konkani will be in a
different dialect to what the Christians speak at least it will be
understandable to one and all. This is a welcome change from the time
the Temple Nataks were all in Marathi.

One thing I note, and I'm not sure if I'm altogether pleased with this
- all the cultural activities that take place in the vilage are
organized on communal lines. The Catholics will have their tiatrs or
hops around the occasions of feasts; the Hindus will have their nataks
and cultural programs around the temples feasts and zatras.

Why is it that we cannot organize ourselves in the villages on a
non-sectarian basis? In urban and beach areas this is happening no
doubt to some extent and if one went to a disco, one may not be able
to tell the community of the dancers there.

I wish this cultural apartheid did not exist in the villages. This is
why I wish that the Moira club would be more pro-active in this
direction. As of now it is identified as the hangout of Catholics
only, a result of some gerrymandering by the managing committee which
still hangs on to power desperately, through these means. It is a pity
that it cannot be the common meeting place of all in the village. As
of now, only the Panchayat and the School to some extent are secular
bodies where all citizens have equal rights.

Thank God that sports at least has not been infected by this communal
virus. At least in theory.

[Goanet] Restrictions restrictions

Heavy restrictions are imposed by local panchayats on any Goan legitimately 
owning a property and  wanting to build a bungalow on it.  People  are waiting 
for years to acquire these permissions and the so called officials are so 
indifferent and rude. However, when it comes to these non Goans, permisions are 
very easily granted to build multi-storey structures.  Who is the Government 
supporting?

I have often heard about this well matured and well aged Feni. This is what
the experts say about alcoholic spirits:-

Brandy, whisky and some other spirits are aged in Oak Barrels - some which
were previously used for Sherry, Wine, Port...it is also from the wood and
previous wine barrels that the spirit gets its distinctive taste.

I have had Sri lankan Feni' which is matured in wooden barrels made from
Teak. The colour of the spirit is golden.
