Commenting on my post, jc writes"Re 1: I would not be that quick to disparage 
the actions of poor people. And while it is true that they are messing up Goa, 
and will continue to do so ad infinitum a la Dharavi, what exactly are they to 
do? After all, the alleged Freedom Fighters provided them with Rights without 
advising them of their Responsibilities

I would like jc to prove which freedom fighter provided these People with 
rights. Proof which is tangible and verifiable. Not just statements pulled out 
of thin air. I am not disparaging anyone, merely stating the facts for which 
there is ample evidence. If people migrate  to another place where the customs 
are different, isn't it incumbent up to the new migrant to at least learn the 
basic customs? Common sense would dictate this. Now don't tell me that they do 
not have Common sense either.

ps: (a) is it possible that the Freedom Fighters were thinking ahead in terms 
of Organic Farming?

Again jc Proof please that Freedom fighters had anything to do with Inviting 
these immigrants to Fertilize the land organically.

[Goanet] Political party symbols challenged in High Court

The petition says that permanent election symbols is giving undue favor to
recognized parties and distorts the level playing field a writ petition has
been filed before the Lucknow bench of the Allahabad High Court seeking
quashing of symbols allotted to political parties.

Social Activist Nutan Thakur filed the petition on Tuesday, says that the
Election Commission has provided "permanent election symbols to national and
state recognized political parties under Election Symbols (Reservation and
Allotment) Order, 1968."

She contends that this was against rules five and 10 of the Conduct of
Election Rules 1961, which clearly says that symbols shall be provided by
the returning officers only at the time of elections. "This is clearly a
breach of laid down rules and regulations and hence I have appealed before
the court on the matter," the petitioner told IANS.

By doing so, the Election Commission was "giving undue favor to recognized
parties and distorts the level playing field". The petition also says that
dozens of election symbols like hand, clock, book, ceiling fan, chair and
table are against Section 130 of the Representation of People's Act, 1951,
which says that no election-related sign shall be placed anywhere within a
100 meter periphery of the polling booth, while these symbols are always
present in polling booths.

The petitioner has prayed for the quashing the party symbols and illegal
election symbols allotted to such political parties as well. The petition is
likely to be taken up by the court next week.

Mervyn's comments are hurting but so very true. Journalists who are worth their 
salt have a duty to enlighten the public as to what is happening at the present 
time so that the public can react appropriately in either condemning or 
affirming the actions or situations reported on. This keeps those in power on 
their toes and ensures that the right course of action is pursued. Delving in 
the past will not resurrect the dead nor ensure that whatever action is 
necessary is instituted immediately in order to ensure a well balanced and 
reasoned outcome. Leave the past to Historians. The past is history, not that 
history is irrelevant, but is only to be used as a window through which we can 
observe our shortcomings in order not to fall into the same traps again. It is 
true that journalists in the modern era Goa do not give enough coverage to the 
destruction of  the environment and the extremes that politicians with vested 
interests have maneuvers the situations to their benefit, nor have they 
portrayed and exposed the rampant bribery and  corruption that is rapidly 
decimating the very fabric of Goa and indeed of India.These and matters 
affecting health services and influx of undesirable immigrants into the state 
electricity and water problems, road and transportation  and many other social 
and political matters which are of paramount interest to the smooth, orderly 
and just distribution of goods and services and the equitable distribution of 
wealth and resources need to be monitored. The only way that the public can be 
made aware of these matters so that they can be informed and take appropriate 
action, is through the press. If the press is unable to do their due diligence, 
due to political and other pressures, then we have to conclude that the press 
in Goa is Gadded and bound and caged and ineffective and therefore these people 
calling themselves journalists should bow their heads in shame and await the 
execution of their masters who are pulling the strings or muzzling their mouths 
or holding their pens hostage so that they cannot convey the truth which they 
as journalists are duty bound to do.

While I really like this story, I would also like to add a few observations.

At Murchison Falls, the mighty Nile narrows to just 20 ft before plunging into 
the game park below. Had Hemingway crashed above Murchison Falls, he would have 
not been rescued by a launch, as boats would not have been able to reach him.

The park area below the falls is so lush or dense with vegetation, that even 
when you stand on the roof of a Land Rover, you can miss an elephant that is 
standing 20ft away. If you get the chance to make one trip to Africa, this is 
the place you want to go. When the Nile floods there, the river gets carpeted 
with reeds/grass and you feel like you are witnessing slow moving islands of 
floating grass. The Nile then flows into Lake Albert, from were the steamer was 
dispatched to rescue Hemingway.  

Here is a picture of the port at Lake Albert, circa 1964. This picture was 
taken a few years after the rescue and is one that you will not find anywhere 
else. My dad drove us all in his VW Beetle to this port and we found ourselves 
cut off by floods. Notice that there are no ships/boats/vessels and the entire 
port is under 10 ft of water? Trees line what used to be the road to the port. 
The port was later abandoned.

free lunch, removed.  At the end, - The Goan Spirit, is added. No mention
if it was given "permission" to use the article from Goan Spirit or if the
writer herself sent it to NG.
It must be noted that even using the word "courtesy" is illegal, as it
infringes copyright law.
I did write to Goan Spirit a few hours before I wrote this post asking the
owner/editor, Lionel, regarding this issue. I didn't get a reply. Since
he's on this forum, he could let us know. It must be stated that Pushpa is
Lionel's wife.
As a disclaimer let me say that  I have sent my same article to two
Goa-related sites. Since no website pays me and if the websites are okay
with sharing the same article  I have no problem. Even if a newspaper pays
it depends on the condtions agreed by the writer and the publication.

My Dear Member of Parliament,

I am writing this piece to you to voice my concern about a 
matter which is very important to me. There are reports in the media, that a 
bill is likely to be presented in Parliament to amend the RTI Act. The reasons 
being given publicly are that the CIC order declaring political parties as 
Public authorities, subject to RTI is bad in law. My understanding is that if 
an order which is bad in law is issued by any statutory authority, the correct 
process is to challenge it at an appropriate forum. The CIC order can be 
challenged in a writ in the High Court, and there are many instances of these 
orders having been quashed in Courts.  None of the political parties has filed 
for a stay of this order, and now expect to amend the law in Parliament to 
justify and legitimize their defiance of a statutory order. With folded hands I 
plead with you not to vote for this. Parliament makes the law. Once it is made, 
it has to be adjudicated by the appropriate statutory authorities.  This is the 
Constitutional process. Defying a statutory order by anyone sets a wrong 
example, and leads to breakdown of the rule of law. After considerable 
discussion spread over months, and reference to a Parliamentary Committee this 
law was passed. It has been rated as the second best law in the World. Citizens 
cherish and value it immensely, since it codifies a very important fundamental 
right of ours.

The law has been used fairly extensively and has uncovered certain 
arbitrariness and corruption. More importantly, it has empowered the individual 
sovereign citizen, who is today getting greater respect from many entities. The 
key principle in defining the bodies to be covered by the RTI Act was based on 
the movement’s slogan, “Hamara Paisa, Hamara Hisab.” Hence all Government 
bodies were covered by the RTI Act and also other Institutions which may be 
‘substantially funded’ by Government were covered. This was the Act passed by 
Parliament, based on which the CIC has passed an order. I do concede that there 
is some reasonable scope for a different opinion on what constitutes 
‘substantial funding’ and if the political parties feel that the CIC decision 
is flawed, they could challenge it in Court.  Parties have said that they are 
being monitored by the Election Commission and the Income Tax department, and 
hence they need not provide information to Citizens. All Institutions including 
Parliament are legitimized to be intermediaries on behalf of ‘We the People’. 
None of these can replace the people of India. 
Some worries have been voiced about how the political parties will be able to 
cope with the RTI queries. I might point out that many small NGOs and aided 
schools are complying with RTI without a major stress.

Subjecting themselves to Right to Information by citizens has not damaged any 
Institution in the Country. Some political representatives have claimed that 
they would not like to be questioned about their processes of decision making. 
RTI only gives access to citizens to the records of a Public authority, and 
does not entitle the citizen to question the merits of the decisions.  Besides 
there are ten exemptions in Section 8 (1) for information which need not be 
disclosed and these exemptions passed by Parliament have worked well, and not 
resulted in damaging any Institution since 2005. There is some recognition in

"Games That We Played:  Traditional Goan Sports" by Maria Lourdes Bravo da
Costa Rodrigues (formerly of the Central Library, Goa) and writes:

"I have been studying sedentary games in different countries of the world
for more than 30 years now,  and I have found some information in this book
that I am interested in. I am particularly interested in the rules of the
game 'Waganni', which I had not even heard of before."

to understanding “Globalisation”* by Prof. Amit Bhaduri co-author of
the1996 book, “The Intelligent Person’s Guide to Liberalisation”.


While some students could earn a course credit by attending the lecture,
members of the public are also welcome to attend. I think this initiative
of bringing eminent academicians to the University but also allowing
members of the public to benefit is a very praiseworthy one. Hope many will

Globalisation has brought prosperity to some parts of the world but the
period has also witnessed a rise in inequality not only across countries
but also within countries. A country like India has within one hundred
years come near full circle going from laissez faire to state control to
liberalization. What have been the consequences of this ?

*Prof. Amit Bhaduri’s* co-authored book in 1996 “The Intelligent Person’s
Guide to Liberalisation” was an early response to this question. He has
continued to engage on the issue of state and the market, and India’s
development trajectory. This course brings to the audience his critique of
globalization in an understandable manner.

Prof. Bhaduri, is the D.B. Bandodkar Visiting Chair Professor in Political
Economy at Goa University. He is a Professor Emeritus at Jawaharlal Nehru
University, New Delhi and Professor of Eminence at University of Pavia,
Italy.

He received his Ph.D. from Cambridge University and has taught all over the
world – in India, Europe and the Americas. In addition he has been research
consultant to the ILO, UNCTAD, UNDP, UNIDO, among others. He has authored 5
books and published more than 70 research articles in international
journals.

[Goanet] How to start a list, and other things.

As if the Goa-related FB groups and mailing lists not enough, there's one
more started, A-List. However, the A-List is just a bunch of emails which
have been taken off from heare and there, including Goanet. Most of the
emials were snatched without even the courtesy of asking for permission
from owners of the email ids. Call it daylight robbery.

Whatever good purpose the founder/s of the list had in starting it, I think
the purpose has been defeated. No matter how much the main founder, Joseph
Rebello, has pleaded to avoid abusive language, emails with foul language
still go thorought. Why? The list isn't hosted on any Listserv but emails
are cc'ed to the ids on the list.

I have repeatedly asked the owner of the list to remove me and he said he
has done so, though he has sent me some recent ones. It's hard to block the
60-odd emails on the list. As for some attacks on me there for doing a
critical review of the interviews by Niz Goenkar of some activists in Goa,
I am not surprsied to receive a couple of abusive emails. I expected many
more, and also an avalanche on NG. But as of yesterday there were a few.

It's shocking that Joseph or, as he signs himself JR, has complained to
Goanet to request me for making "damaging remarks" against one of Goanet
members, Menino Fernandes, who is owner/editor of Niz Goenkar. The site has
used foul language to describe some politicians and the Alamaos have been
the worst targets.

The site carries an apology from Menino Fernandes, who also goes by the
name Menino de Valpoi.
"I would liek to apologize to the viewers for a wrong name used by me
during the interview and would like to apologise to the person if any, does
really exist by that name. I have used the name Ujjwal Mishra which may
please be correst to be read as O.P. Mishra and not UJJWAL MISHRA. I called
O.P. Mishra a Joke and Not Ujjwal Mishra if one does exist by the former
name. THE NAME OF THE DIG MAY PLEASE BE READ AS O.P. MISHRA -- Menino de
Valpoi."

Yeah, everyone has a right to start a list. Also everyone has a right to
express his/her opinion or do a critique of any public interview. I can't
why JR wants to Goanet to demand an apology for me when the man himself,
Sir Menino, is himself silent on Goanet where he is a member.

 Putting the Congress back on track

The Congress party desperately needs a rainmaker to re-invent and
reposition it for the next electoral battle. Imminent is the selection of a
new president and the new in-charge for the state, Digvijay Singh, has
issued a diktat that the incoming chief should be a Catholic.
This effectively brings Subhash Shirodkar's term, which saw the Congress
losing power in the 2012 election, to an end. During the last election it
was amusing to see some key players, most of them ministers, pulling the
party into different directions and, at times, crossing each other's paths.
Vishwajeet Rane was the prime example of Super Boss who cared less for the
party's image as he ramrodded the Congress to provide tickets to
those within his embrace.

Angley's Cup TT Team championship 2013- Hotel Manoshanti triumphs

Hotel Manoshanti sponsored Panjim TT Club team registered a
sensational 3-2 win over Regal Electrotech to emerge champions of the
Angley's Cup Table Tennis Team Championship event 2013, held at the
gymkhana hall premises on Sunday. The prestigious championship, in
it's 40th year in running, witnessed edge of the seat excitement with
fortunes fluctuating every minute and the match going down to the
wire.

P Adarsh representing Regal gave his team a 1-0 lead with a facile
11-7, 11-2, 11-8 win over Amit Naik. Manoshanti won the next two games
to make it 2-1, with Diljeet Velingkar beating a tenacious Myron
Pereira 12-10, 13-15, 11-7, 11-4 and former state champion Noel
Noronha displaying his class and mastery with a 11-6, 11-3, 11-9 win
over Noel Estibeiro. The fourth game was fought between Goa's top seed
P Adarsh and second seed Diljeet Velingkar and saw some exciting
moments and great rallies. P Adarsh prevailed over his opponent with a
hard fought 8-11, 11-3, 11-9, 11-7 win to level the scores at 2-2.

With the match delicately poised, Myron Pereira took a 2 sets to 1
lead and looked all set to take his team to its third title in
succession, but Amit Naik came back strongly to win the next two sets
and the game, thereby clinching the team championship title for the
Manoshanti team. He won 11-8, 11-13, 9-11, 11-6, 11-6. Siddhant Parekh
and Gary Freitas were the other two players who represented the
winning team, with Ajit Ghantker as the Team Mentor and Arun Naik the
Coach. Winners and Runners up prizes and trophies were awarded to
Manoshanti and Regal Electrotech. BPS Sports Club, Margao and Parekh
Brothers were awarded semi Finalist Prizes.

Prizes were distributed by Chief Guest Vero Nunes, Goa Table Tennis
Association President; in the presence of Panjim Gymkhana Vice
President Gaurish Dhond, Jt. Secretary Sunil Naik, Treasurer Suresh
Karapurkar and member Sanjay Pednekar. Mr. Kishore Angley and Mr.
Atish Angley of Angley's Sports graced the occasion. Mr. Suresh
Karapurkar, Treasurer of Panjim Gymkhana proposed the vote of thanks.

Earlier, Hotel Manoshanti beat BPS Sports Club 3-1 and Regal
Electrotech beat Parekh Brothers 3-0 to seal their place in the
finals.

According to the regulations of FEMA and RBI, NRI is permitted to make specific 
investment in real estate. A NRI is allowed to do the following investment in 
property:
1) Any immovable property can be purchased by NRI in India other than any 
agricultural land, farm house and plantation property.
2) He can get any immovable property as mentioned above by gift from Indian 
resident, Indian citizen residing outside India or person of Indian Origin.
3) Obtain any property by inheritance.
4) He can transfer immovable property to any resident of India by sale.
5) He can transfer any agricultural land, farm house or plantation land to any 
resident of India by gift.
 6) He can also transfer his residential or commercial property by means of 
gift to any person either residing in India or abroad or person of Indian 
origin.
Sources of Finance

NRIs considers financial institutions as the easy option available in India for 
purchasing any property; at the same time financial institutions consider NRIs 
as their potential clients.
Financial institutions provide home loans easily, efficiently and sooner to 
such people as they are very much prompt at the time of repayment. Furthermore, 
the repayment can readily be done by inward remittance through the proper 
banking channel.
If someone is already getting income in India from sources like rent or 
dividend, he/she can directly repay the loan as well. Now RBI has also 
predetermined these norms in home loan for Non residents who are looking 
forward to buying any property:
A maximum of 80% amount is only financed by the financial institution. Rest 
should be given by NRI himself.
The remittance of the amount for down payment can be done from the place of 
residence by normal banking channels, i.e., NRO/NRE account in India.
Furthermore, the NRI has to repay his principal amount as well as interest part 
from that similar channel only.
Tax Implications for NRIs looking for property in India
NRI has to shell out stamp duty as well as registration fees at the time of 
purchase. He is entitled to avail all sorts of benefits at par with Indian 
resident on the interest paid for the home loan.
However, the tax process becomes full of twists and turns if the property is 
leased. As the amount of income received from such action comes under the head 
of income from property, therefore, standard deduction is applicable as per 
standard slab.
In this case, the NRI will have to pay the applicable tax if he is residing in 
the country where worldwide income is taxable unless the country has Double Tax 
Avoidance Agreement with India.
The special advantage for NRI is the amount which is paid for the interest of 
home loan is deductible from NRI's taxable income without any upper limit. The 
NRI is legally responsible for the payment of capital Gain Tax as prescribed 
under the Income Tax Act, in case he sells off the property.

I am writing this letter in the interests of communal harmony to stop those
elements that are trying to bring unrest in Goa on "Goanet" platform.

I know Fr. Victor slightly and I know that his thought process has been
distorted in the article, "There were no Hindus in Goa before Portuguese
landed".

Fr. Victor in fact has been known to say that both the Catholic and
Hindu communities come from the same biological tree but that
misunderstandings occur because they view each other through the prism of
trauma of colonization.

His analysis and his approach are very much based on linguistics.  He once
explained this very simply by giving the example of three things:

1) Dog: The term dog as three aspects: the word "dog" which changes from
one language to the other, the actual animal with four legs and a tail etc,
which does not change, and the third aspect is the nature of the dog which
could be described as a canine animal which can be domesticated.

2) Goa: The term Goa stays the same in every language. The territory also
is pretty much the same. However in the third sense Goa has changed.
Previously it was a colony of the Portuguese. Now it is a State in India.

3) The Centre: The term the centre will be different in different
languages.  The thing it is referring to will also change depending on what
you are talking about.  However the concept will stay the same - it is
something in the middle of everything else.

In this same way every word or concept can have three meanings.  What Fr.
Victor was trying to say is that the term Hindu as it is used now does not
have the exact same meaning as it did before.  The term initially and
probably originated from the word Indu which was a reference to the great
River Indus.  There is nothing for anyone to be angry about.  The Catholic
religion has also changed.  A Catholic today is very different from a
Catholic of the past.

I hope this helps people see how Fr. Victor's message has been distorted.
 He is a simple scholar whose objective in studying Goan Society is to seek
therapeutic solution to the current differences.  He feels there is a
forgetting of history in Goan society that afflicts us
tremendously.  Catholics have forgotten their histories of origin as well
as the Hindus have forgotten that they have transformed.  Only through
willingness to listen and therapeutic dialogue in Goa can all communities
heal their wounded memories.

Frederick,
I actually think that there is an opportunity to work with the salt
"farmers" to create an artisanal speciality food product (needs a lot of
thinking and development) on the lines of what is described here...and
perhaps the Portugese connections may be an easier way to start.

The Bombay High Court at Panaji today indicated that it may have to take
Suo motu cognizance on the alleged rampant drug menace in Goa. This
observation by a Division bench comprising of Justice A.P.Lavande and
Justice U.V.Bakre was made while hearing a petition against Noise Pollution.

The Court expressed its unhappiness regarding the sorry state of affairs
with the authorities abdicating their responsibility and failing to act in
accordance with law.

Expressing concern that even the Calangute MLA Michael Lobo was helpless
after having filed a complaint about drug trafficking and even naming the
alleged offenders, the Court inquired with Advocate General Atmaram
Nadkarni about the sad state of affairs especially in Goa’s northern
coastal belt.

It is high time Chief Minister Manohar Parrikar gets his act together. He
should realize that his new found love for Casinos along with the
flourishing drug trade is a lethal combination that will further degenerate
and disfigure our Goa beyond recognition. Mr. Chief Minister you had
promised a Parivartan and good governance. But you have lost it all.
Perform or quit for the sake of Goa. Infact with your despicable
performance over the last 16 months you have lost all moral authority to
continue as Chief Minister of Goa.

OLD GOA: "Protect our livelihood" was the overwhelming feedback the 
archaeological survey of India (ASI) received on Monday as it met with 
stakeholders to discuss draft heritage bylaws to protect the World Heritage 
Site's churches and convents.Prepared by the Indian National Trust for Art 
andCultural Heritage way back in 2010, the bylaws were presented to Old Goa 
residents and representatives of the Church and the state government via a 
powerpoint presentation atICAR.ASI's regional director (South) D Dayalan told 
TOI, "We have received requests to protect the livelihood (from tourism), 
honour religious sentiments, and maintain the area's historical significance 
before finalizing the bylaws. We will consider these empathetically and meet 
the stakeholders again before finalizing and presenting the bylaws to the 
Centre."The Ancient Monuments and Archaeological Sites and Remains (Amendment 
and Validation) Act, 2010, requires heritage bylaws to be prepared for all 
centrally-protected monuments of the country.At the meeting, Dayalan was told 
by Vishal Valvoikar, sarpanch, Se Old Goa, that the area should be exploited 
systematically for its rich cultural-and-religious-tourism potential. 
"Developmental activities should not be hampered by new laws," he 
warned.Valerine Vaz, representing the Archdiocese of Goa, pointed out that the 
Church couldn't undertake even bare repairs as the agreement between it and 
ASI-being sought since 1968-is yet to materialize. "We need to know our rights 
and duties," Vaz stressed.Both, Jaidev Sarangi, secretary, art and culture, and 
Narayan Navti, additional collector (North), felt better coordination between 
locals, government and ASI is required to ensure conservation and livelihood 
work in tandem
