*By Nisser Dias 8th Oct 2013* *Rahul Gandhi means business* In the last fortnight a couple of positive aspects have happened for the betterment of the country and its political system. In both cases the Indian Supreme Court have come to the rescue of its citizens. First being disqualifying convicted politicians for being members of Parliament and second endorsing ‘negative vote’ during elections. Of course almost all the political parties connived to bring about an Ordinance to negate the Supreme Court order on disqualifying convicted politicians, but the intervention of Rahul Gandhi of rubbishing the Ordinance which was sent for the assent of President of India changed the tide for the better. There has been a raging debate over the manner in which the young scion of the Gandhi family bulldozed his way through denouncing the Ordinance which made the Union government sit up and take notice and ultimately retract or withdraw it, but due credit has to be given to Rahul for having the courage to stand-up to the Prime minister, his cabinet and above all his own mother who is the president of the Congress party and also chairperson of the UPA. Let us not be naïve and accept that Rahul Gandhi did not know about the fallout and ill effects of the Ordinance being the vice-president of the Congress party. He did know just like the members of all the other political parties but he had the guts to accept the view of the masses that the Parliamentarians including himself were wrong about the Ordinance and demand its withdrawal. This shows his convictions and courage to move against the tide if required. He would have known that his demand of scrapping the Ordinance would create a flutter in the government, that it would give a handle to the Opposition to criticise him, his mother and their dynastic rule. He would have known that it would embarrass the Prime Minister. He would have anticipated the flak he would receive from the media. He would have known that he would be called an extra-constitutional authority but he took all this in his stride and disapproved of the Ordinance publicly thereby forcing the government to withdraw and abandon a draconian Ordinance. These are the qualities of a leader. Till now Rahul Gandhi – heir apparent was seen as someone who shunned away from responsibilities, one who does not want to cross swords with political opponents, shied away from debates but with his master stroke of opposing the Ordinance of his own party led government he has pole-vaulted himself much higher in the eyes of the public. Today the masses especially the youth see him in a new light. By this move he has also managed to send a clear message to the Opposition BJP that he cannot be taken lightly. BJP and their prime ministerial candidate, chief minister of Gujarat Narendra Modi had thought that they had captured the imagination of the citizens of the country and that 2014 Parliamentary election would be a cakewalk for them but now they have do a re-think in the light of energized Rahul Gandhi and his young brigade. Not that the Congress vice-president can wish away all the financial scams and corruption of his government, that will surely be an impediment for the Congress party in the elections. At the same time not everything is hunky-dory in the BJP as well. The BJP might even have an edge over the Congress but that does not mean they can take Congress lightly. All this while Gujarat chief minister has been trying to belittle and deride Rahul but Narendra Modi was silent on his views on the Ordinance and the reason being the Damocles sword of Godhra carnage of innocent lives is hanging over his head and his head honcho Amit Shah is facing many criminal charges. Hence their political career is also in doubt. The second good thing to happen to this country is Apex Court allowing negative voting (None of the Above - NOTA) thereby giving a right to the voters to reject all the candidates contesting polls. The Parliamentary is said to be the Temple of Democracy but sadly many a times it has been compared to a den of criminals because many individuals with criminal record and history have got elected using money and muscle power. As the highest court in the country has observed that NOTA would bring about a systemic change in the election process, the Election Commission should also be empowered to reject candidature of persons have criminal background. But at the moment we need to be content with the Apex Court’s decision on the negative voting and we as citizens need to take it forward. One thing is for sure that political parties be it national or regional they are not going to screen their candidates for criminal record. They only check on the aspects like whether the candidate can bag a seat for them and whether the candidate can fund and finance his own election

Perhaps unknown to you, he is a very gentle, humane and sensitive person. He has very strong ethics, principles and values and would never ever engage in extra-judicial killings, let alone unlawful activities. His strength lay in the fact that he is a man of integrity who had the guts and courage to stand up to political bosses and criminals. He stood by his men and was fair in his actions. He brooked no nonsense and carried no unwanted baggage. Such was his reputation for fairness, firmness and honesty that criminals and politicians dreaded him as they could not corrupt him or buy him off. He commanded the respect of the men of his force, politicians as well as criminals. It was precisely this reputation that made him a man much in demand. He was initially sent to Gujarat and then called to Punjab to douse the flames. It was in Punjab that the phrase ' bullet for bullet' was attributed to him. However, it was KPS Gill who was the author of that phrase. I think it would be good idea if Goanet could do an interview with him. He possesses a rich treasure of stories, anecdotes and incidents relating to Goa and goans besides his experiences in the force while serving in Maharashtra, Gujarat, Punjab and then Rumania where he was the Ambassador. A strong student of history, his knowledge is amazing and can keep you engrossed for hours together without you realising the passage of time. The child like innocence, kindness and gentleness that emanates from his personality is an experience to treasure. "The issue agitated through this petition are policy matter and come under the exclusive jurisdiction of the legislature and as a matter of fact, the area relating to issue agitated in the petition is covered by suitable statutory provisions in the concerned laws relating to election matter," the law ministry said in its affidavit. The ministry also said, "It is also a settled position that the courts do not interfere in policy matters of the state unless the policy violates the mandate of the Constitution or any statutory provision or is otherwise actuated by mala fides." After additional solicitor general Paras Kuhad submitted the affidavit, a bench of Justices R M Lodha and S K Singh asked the Election Commission to respond to the Centre's stand in six weeks. It averted the immediate danger of the court adjudicating on a very sensitive issue, especially when many politicians, including elected representatives, are facing trial after framing of charges against them in serious offences. These politicians, under existing law, are entitled to contest elections because of the cardinal principle - an accused is presumed innocent till pronounced guilty. The Centre also said the issue had been engaging the attention of the government, which in the past had undertaken serious consultations on the Law Commission's 170th report recommending that on framing of charges against the accused in serious offences, he be barred from contesting elections. It said the department related parliamentary standing committee on personnel, public grievances, law and justice in its report had disagreed with the view of the Election Commission, which too had opined that in case a court framed charges in a serious offence against a person, he should be kept out of the electoral arena. "The parliamentary committee was of the view that the proposal of the EC under reference is a major departure from the law for the time being in force which provides that if a person is convicted for an offence and the court gives a judgment convicting him, then such a person shall be disqualified for contesting elections," the Centre said. The committee, while expressing concern over criminalization of politics, also said "prosecution in many cases is bound to be influenced by the party in power or by failure of system and in that case there is very likelihood for framing false and mala fide charges against their political opponents". So all the NGO’s should also come under the purview of RTI regardless of the quantum of funding and any other support they receive from the government. The nomenclature of ‘substantial funding’ should not come in the way as a safe shelter for the NGO’s to try and circumvent the RTI Act to keep details of their affairs and activities under wraps. However, the spokesperson should also inform the people of Goa if the Congress government made any effort to address the issue while they were in power. The industry employs a host of Nepali dealers who have been displaced because of slump in casino operations back home. Gambling dens have also attracted several Europeans, former club-house managers and gaming experts who were instrumental in setting up gambling operations from scratch a decade ago. "It is appalling and outrageous that casinos in Goa have been set up to provide livelihood opportunities for non-Goans. I appeal to the chief minister to weed out illegal casino operators from Goa for good," Lourenco said, adding that many were working in India on expired visas.
