I have refrained from this discussion as I did not wish to turn a discussion 
into an argument. You have taken a stand and unfortunately in trying to prove 
yourself right you have missed the bus. Please stop flogging a dead horse. The 
'accurate information' may be accurate but in the present day and especially 
after the UN charter of 1947 which India is a signatory to, your information 
amounts to 'mis- information' 
Please read the following regarding India's annexation of Goa. Please google.

3) Regarding the 1962 act of GOI you refer to earlier. Please read Article 49 
of the Fourth Geneva Convention.
4) US President Kennedy told the Indian ambassador to the US, “You spend the 
last fifteen years preaching morality to us, and then you go ahead and act the 
way any normal country would behave People are saying, the preacher has

5) The New York Times on 19 December 1961, stated "With his invasion of Goa 
Prime Minister Nehru has done irreparable damage to India's good name and to 
the principles of international morality." 
6) The USSR supported India and vetoed the UN resolution in the security 
council. Brezhnev happened to be touring India at the time of operation Vijay. 
There is more then enough information to prove without doubt that India was in 
breach of The UN Charter and unfortunately set a precedence. 
The GOI annexed Goa not for any love of the Goan People, but to prevent the US 
from gaining a deep water port in the India Ocean. The " Liberation" was an 
annexation. India had no intention of liberating Goa. India wanted the Port of 
Goa for its strategic location. Period.
You are mixing two issues
1) Did India commit aggression on Goa?
2) Is Goa historically a part of India?
Your contention that Goa is a part of India and as such India has the right to 
annex Goa is wrong as the UN charter of 1947 clearly puts an end to all such 
ideas, concepts and actions by Governments, the Charter accepts the land areas 
of all countries as final from the day the Charter came into effect.
This charter was operational, effective and signed by India. Therefore as per 
the UN and International law India committed an act of aggression. 
During the Liberation of Goa, the Sikh battalion involved were so joyous they 
liberated a number of Goans of their possessions, vehicles, and underwear. They 
were punished by the Indian Army.
2) Historically Goa has never been a part of India. As India became a nation in 
1947. the so called Boundaries of 'India' you refer to kept changing depending 
on the whims and fancies of various rulers across much of recorded history. 
Infact the Mughals were Pathan, and the Adil Shah was Persian. There was a lot 
of mix and match going on in India and the world, before the UN came into 
existence. Especially after World War 2 the loss of life prompted world leaders 
to end aggression in every form and solidify boundaries, so that wars and 
Aggression would end. Nations would know their boundaries and respect the 
boundaries of others. Guess who set a precedence?
The people of Goa have a connection to India as our ancestors have at some 
point in time lived in various parts of India. So there is a familial 
relationship. But that is not sufficient reason for annexation. 
This situation can be argued till the cows come home. One must be pragmatic and 
accept
1) without a plebiscite, Goa remains an annexed state
2) all Goans born before Dec 1961 and to goan parents who were born in Goa 
before Dec 1961
Are Citizens of Portugal. UN charter, Geneva convention etc.

BICHOLIM: Switching over to another livelihood is never an easy option and
returning to an occupation after a gap of 20 long years is even more
difficult, especially when the two occupations differ sharply from one
another.

People from mining- affected areas at Pissurlem in Honda- Sattari have
resumed farming activity after a gap of about 20 years and acknowledging
the difficulties in this transition, the deputy collector has convened a
meeting with the farmers on December 27 to address and resolve their
problems and challenges.

It may be stated that Pissurlem is a mining affected area where farming was
one of the prominent occupations for a number of generations.

“ There was a time when about 150 farmers cultivated this land and dairy
farming was also one of the important secondary occupations in the area,”
ex- Pissurlem sarpanch Vishwasrao Desai told Herald.

With the arrival of mining activities, a number of farms in Pissurlem were
left uncultivated for past over 20 years as farmers abandoned their
traditional professions in 1994 and switched over to the more lucrative
mining- related activities.

Their fields were further affected when silt from t h e nearby mining c o m
- p a• y entered into the fields and the only relief for the affected was
some compensation from the mining company.

These mining activities came to a grinding halt last year and the locals
were left with neither mining nor farming activity in Pissurlem for their
livelihood.

In a desperate bid to make ends meet, locals in Pissurlem then decided to
return to their age- old profession by cultivating their fallow fields.

Although wells dried in the village due to mining activities, forcing
villagers to rely on water from tankers, the villagers are fortunate as a
lake that lies in close proximity to their fields survived the onslaught of
mining activity.

Some locals decided to take up farming once again after mining came to a
grinding halt and sought the assistance of an unlikely ally: a mining
company.

“ The farmers came together and with the help of the panchayat and the
mining company, fenced about 5 acres of land for cultivation. We have about
90 acres of land and we have begun cultivation on 5 acres of land so far.
This is just the first step and by next year, we hope to cultivate the
entire stretch with the help of the locals and the support of the
government,” said Desai.

“ We have already submitted a memorandum to the deputy collector demanding
to de- silt the lake and the springs so that next year, we can take up
farming at a larger scale.” Hanumant Parab, another villager, stated that
the mining company would be asked to divert water from the mining pits so
it could be used for farming.

Locals of Pissurlem in the taluka of Honda- Sattari return to farming
activity after a gap of 20 years, ever since mining activity came to a halt
due the ban on the same.

I think you should first look up the lawbooks before trying to throw them
at me.

But for your better understanding,  let me refine the second point I
made: (2) 'The fact that one can employ a servant at below the minimum wage
level set for industries, means that there is more supply than demand for
them. '

Now if you had taken the trouble you would find that the law regarding
minimum wages vary from State to State, and also for different categories
of workers. Most States prescribe the lowest minimum wage rate - for -
"unskilled
workers of all industries"

Domestic servants do not come under the category of "unskilled workers of
all industries" Hence their employers do not have to abide by this minimum
wage law; and hence are not in contravention of any law.

Prescribing a minimum wage for industries does not ensure that everyone
will be employed in those industries.

Hence a desperate workforce will go to wherever they can get employment
including working as domestic servants, ragpickers, commercial sex workers,
and other more criminal options.

I hope point # 3 that I made above is now within the ambit of your
comprehension.

Having said this, I should make it clear that I do think that domestic
workers should also be afforded a minimum wage by law to prevent
exploitation, although I suspect that this is easier said than done.

BICHOLIM: Deputy speaker and Mayem MLA Anant Shet has stated that if the
state government fails to solve the problem of custodian of evacuee
property during the winter assembly session to be held in the month of
March next year, he will 'prefer to stay with the people of Mayem village
and will act as per their guidelines'. While addressing mediapersons at
Bicholim, Shet also said that he will resign from the post if the villagers
so demand.

He said that chief minister Manohar Parrikar is 'very keen to solve this
problem as early as possible' and no any other government had taken such a
keen interest in the custodian of evacuee property issue. The Mayem MLA
pointed out that it was only the BJP, during its tenure in 2003, that
supported the people in saving their residential houses from demolition by
passing a special ordinance.

Shet lauded the efforts of the Mayem Bhuvimochan Nagarik Kruti Samiti and
the freedom fighters' association for agitating in a peaceful manner. He
advised the two groups to continue their agitation in the same manner and
expressed confidence that the chief minister will find a solution to the
vexed issue.
On Liberation Day, the samiti had demanded Shet's resignation on the
grounds that the BJP had failed to keep the promise of resolving the
evacuee property issue by December 19.(toi)

It is now crystal clear that Goa Chief Minister Manohar Parrikar discreetly
masterminded the December 19th high handed attack on his own BJP St Andre
MLA Vishnu Surya Wagh. With this Manohar Parrikar has lost all moral
authority to continue as the State’s Home Minister.


The Home portfolio should be immediately entrusted to Deputy Chief Minister
Francis D’Souza to pave way in enabling a free and fair probe into the
dastardly attack on Vishnu Wagh which has put Goa in further bad light.


Tivim MLA Kiran Kandolkar’s name is unnecessarily being linked to the
attack. This vicious attack was pre-planned by Chief Minister Manohar
Parrikar in conjunction with his RSS brigade to silence the very outspoken
and secular Vishnu Wagh.


It is very appalling that Chief Minister Manohar Parrikar has been misusing
the police force to spy and monitor the movements of his own Ministers and
party MLAs. This does not augur well in a democracy and for a State that
has just celebrated 52 years of its so called Liberation.


Chief Minister Manohar Parrikar should not stoop so low in fueling petty
political fights and disrupting peace in the State. He may one day get the
taste of his own bitter medicine.


On the double standards being adopted by Chief Minister Manohar Parrikar
less said the better.  While the Chief Minister coerced the police to burn
the midnight oil in the Tarun Tejpal case, he is yet to visit that 7 year
old little Vasco girl who was brutally raped on January 14th last year and
with that case hushed up with political blessings.


In Goa, crimes including rapes, dacoities and murders have become the order
of the day over the last 21 months of BJP rule. Chief Minister Manohar
Parrikar has failed on all counts with his one man autocratic rule and high
levels of arrogance while unleashing his communal agenda and destroying
Goa’s secular fabric.


It is dismaying that Chief Minister Manohar Parrikar was not trusting and
taking his own Ministers and party MLA’s in confidence. Contrary to good
established democratic traditions, Manohar Parrikar was also showing no
respect to the Opposition while having demanded it all when he was the
Leader of Opposition.

The people across Goa are now repenting for having voted the BJP and having
trusted a deceptive Manohar Parrikar who has by his endless U turns reneged
on his much hyped promise of a Parivartan by way of good governance and
Zero tolerance to corruption.

the life so many invisible immigrants endure in Britain. 
 
Portuguese passport-holding Goans arrive in an already depressed UK economy,
where jobs are difficult to find and the slightest downturn leads to layoffs
or reduced hours. To survive, they borrow from banks and relatives or worse
still, from quickfix money lending agencies charging usurious rates of
interest. Burdened with financial problems, unable to cope in an alien
country and cast adrift by their inability to communicate in English, they
spiral into debt, drink and depression. 

There is also currently a crackdown on landlords renting rooms and sheds
unfit for habitation. All this will make it that much more difficult for new
Portuguese passport-holding Goans contemplating a move to England."

of neon lights, and arc lamps, so sometimes we don't realize that we don't see 
clearly what is sometimes in the shadows. It is only in a blackout that we 
appreciate the importance of a flickering light or burning candle. On the other 
hand, "those who live in a world of darkness are specially prepared to "see" 
whatever light may seek them out. Christmas is a feast of the birth of the 
light of the world. May we acknowledge our darkness and seek the Light! Wishing

Sunday Reflections: Christmas Day "Today a Saviour is born! Light of the World! 
Glory to God in the highest!" 25-Dec-2013
Isaiah 9: 1-6;          Titus 2: 11-14;          Luke 1: 1-14;

The prophet Isaiah reminds us that Jesus came to bring the Light to a darkened 
world! "The people who walked in darkness have seen a great light. In the light 
of his light we can see ourselves and others more clearly. We all have darkness 
within us, which means that we all have potential to "see" the light. The 
surprise of the Incarnation is the light it sheds on the whole landscape of our 
common life: all are "made glorious" because "a child as been born for us, a 
son given to us". Here is the Light that redefines "family," and reshapes our 
vision of what it means to belong to one another within the People of God.

Jesus pitched his tent among us
The custom of placing lighted candles in the windows at Christmas was brought 
to America by the Irish. When religion was suppressed throughout Ireland during 
the English persecution, the people had no churches. Priests hid in the forests 
and caves and secretly visited the farms and homes to say Mass there during the 
night. It was the dearest wish of every Irish family that at least once in

Here is accurate information regarding the history of citizenship and 
international law. Citizenship has been recognized since the time of the Greek 
city states and the Roman empire. Ever since conquerors have granted 
citizenship to the people living in their conquered territories. International 
Law was first codified in 1840s. Jeremy Bentham is responsible for that term. 
An 1861 statement of this law with specific regard to citizenship states the 
following:

conquered territory who remain in it, become citizens of the new state; for 
justice would seem to require that the rights of citizenship should be given

[Goanet] The Ice Storm

It was going to come like in 1998, from Texas, to hit Toronto and surrounding 
areas in Southern Canada and last night it did. 

20 to 30 mm of rain falls and hits the cold ground and turns to ice. Tree 
branches sag with the weight, crack and break and take power lines down with 
them. 250,000 people in Toronto have woken up without power this morning and to 
slick and icy roads outside. Driving on them however slowly would be hara-kiri.

Last night before going off to bed we made sure the flashlights were placed 
stategically all over the house and I went to the garage and kept the camping 
gas stove ready for the morning coffee. On waking up I saw what we were warned 
about. Power was off and some branches of the two huge ash trees in my backyard 
had snapped and fallen on to the large deck. No damage except cutting and 
clearing for me after the storm is over. The neighbor's tall fir tree is 
leaning precariously over his neighbors house but like the coconut, the fir 
bends but does not easily break. Luckily the hot water is still running but 
that will get exhausted after the tank in the basement depletes.

Electricity restoration is announced for 72 hours in stages. That means some of 
us Torontonians will get it back after Christmas day. Nothing like this 
situation to appreciate how dependent on the 'juice' we have become. The house 
will get cold but fortunately ice storms when the temperature is between minus 
1 and plus 1 celsius. All homes (not buildings) are built of wood decorated 
with brick outside which keeps them warm, unlike if they were made from 
all-brick or cement.

The ice storm of 1998, the last time such a thing happened, saw 100 mm of rain 
compared to today's 30 so the intensity would have been three times greater. 
Toronto's mayor wanted to call out the Army which later made us the laughing 
stock of Montrealers to whom all this seems like a cake walk since they are 
used to worse weather than us. 

So if you are lighting a bonfire there in Goa on Christmas eve, blow us a wish 
or two through George Pinto's and Philomena Giese's Venerable Jose Vaz for some 
season's cheer.

Canada Border Protection Agency are very strict about bringing in ANY 
animal or plant products (no exceptions) into Canada in any form including 
cured, cooked, vacuum packed or even canned.


If you answer 'yes' to the disembarking card question, they will 
confiscate it. If you declare as not caring any if these, their sniffer 
dogs will suss it out and besides confiscating, they will fine or can even 
deny entry to tourists.


Gone are the days of bringing any foodstuff in from Goa and it's all for 
the better considering the poor state of product and hygiene there.


Some Asians (including Indians) however persist in trying. For them 
there's a black mark with mandatory (rather than random) inspection of 
their baggage every time they enter for the next 6 years.

I will skip # 3 above as it is beyond my comprehension.

Re #2: As the 'minimum wage' is set by law, it follows that paying an employee 
below the minimum wage is not only exploitative, it is also in contravention of 
the law.

I agree with Ananya. If one cannot afford to (say) dine at a 7 star restaurant, 
one should consider eating at a little road side cafe . at home..or 
just Fasting on that day.

A few years ago, a 'ton' of professionals from South India turned up at a 
Caribbean island and offered to work without pay. All they were asking the 
island's govt to do was to pay Board and Lodge. The island actually had 
vacancies it could fill with about 75% of the professionals. It could have 
exploited the situation and justify it on 'market forces'. To that country's 
credit, it did not do so. It found employment for all the applicants at the 
base salary for that profession.

Many countries recognize that the 'financially strapped' would agree to any 
contractual terms. When one is desperate, one is desperate. In order to protect 
the disadvantaged, these countries have enacted UCTA ( unfair contract terms 
Acts).

In the index situation, the mega-problem would not have arisen if it was just a 
question of under-paying. The main issue here which attracted attention is one 
of possible Fraud in Declaration, and possibly of 'leaning on' the weaker party 
which could mean anything from assault to whatever.

BTW: for all the (justifiable) complaints women have about exploitative men, it 
is quite ironic that those who harass daughters-in-law most - appear mainly to 
be women, those who treat the household help badly are mainly women and those 
who are super-harsh to female juniors at the work place reportedly are mainly 
women bosses; and I am not referring only to folks like Indira, Maggie and 
Aquino. (Please note that I have seen a few good mothers-in-law and a fewer 
number of good female bosses)

Ask any woman this question: Would you prefer a Man or a Woman as your boss at 
work? Do tell us what answers you receive.

status should be better, I think that Ananya Bhattacharyya is being a
little simplistic when he says that "Having a servant you cannot pay a decent
wage cannot be a birthright".

The fact that one can employ a servant at below the minimum wage level
means that there is more  supply than demand for them. Otherwise they would
hardly agree to work at that wage level. There are also other perks like
food, clothes and housing, no matter how bad, which come with the work. If
one enforced a minimum wage then it would deprive this class of the
sustenance which it provides them now.

However compared to some other states, in Goa the case is quite the
opposite and it is pretty difficult to get anyone, let alone domestic
servants, to work at the minimum wage level of 180 per day - which would
amount to Rs 5400/ per month. Most of the programs like NREGA which are
meant to provide employment to unskilled labor go abegging in Goa because
the wage rate in the market is much higher.

As for the status of domestic servants I think it will take a while for
societal attitudes to change, as happened in Portugal where there are no
longer criadas or servidors but only empregadas da casa. But they will
change.
