Antonio Menezes' view is eenlightening though he doesn't quote any legal references. However, he says he may be wrong. Taking into consideration his opinion, there seems a room for the Indian government to consider that registering births in Portugal doesn't necessarily confirm Portuguese citizenship on the person. However, one must also take the Indian constitutional veiw into consideration. This is for the centre to work out and may require dialogue with Portugla. Since the CM has approached the centre, we have to wait for the centre's move.l It's good of Antonio to give his view instead of someone whose mocking ways are well known on this forum. To him, a question must be answered by a question. The person can only call someone by names, something he's extremeldy good at. All nations of the world maintain their own Registers of Civil Births in which a birth (within the boundaries of that nation ) is recorded automatically. It does not matter if the parents of the baby are its nationals or not. It also does not mean a baby is automatically a citizen of that country, unless this particular baby ( born to foreign parents) on attaining adult age claims for himself/herself the citizenship of the country where he/she was born. It has been my belief all this time ( and I could be wrong) that the Portuguese had left Goa in a hurry and had no time carry along with them copies of the Registers of Births ( that have taken place before 19th December, 1961) they maintained in Panjim, Margao, Vasco and Mapusa and hence Goans were at liberty to re-register their births in the Goa related Civil Births Registers now maintained in Lisbon. It is my personal opinion that mere re-registration in Lisbon of births taken place in Goa prior to 19th December, 1961 does not necessarily mean that one becomes a Portuguese citizen. One has to apply further for a Cartao de Cidadado (something alike our Identity Card for voting purposes) and based on this Cartao one could apply for a Portuguese passport if one wishes.

The junction is a dangerous blind spot and and a crossing point for many school children on their way, When actually the PWD descended on the scene to execute ,some vested interest prevailed upon them to block it . As part of investigative powers, the police have the authority to require someone to appear before them if they have reasonable grounds to believe the person has committed a cognizable offence. In this case, the police were simply doing their duty by summoning the BJP (and NCP) workers to question them in connection with the case at hand. Mr Somaiya’s actions are a blatant disregard of police’s lawful authority. Dolphy D’Souza, Convenor, Police Reforms Watch, says, “There is a vital principle in law that no one can interfere with police investigation. This principle cannot have exceptions based on favouritism or power. Obstructing investigation is a crime and must be treated as such in all cases, whether it is by an MP or a common citizen. The police will not be able to do a professional job and serve the people if they are intimidated by their local politicians”. This incident speaks of blatant political interference in policing. In bad tidings for Maharashtra, the recently passed Maharashtra Police (Amendment and Continuance) Act 2014 entrenches near total political control over the police. I don't understand why someone would want to collect the email of a person without permission and add to a mailing list that has its own agenda.I am talking of a list which is notorious for distributing anti-Indian stuff and propaganda. I think the people have given Since the list has no name, it isn't easy to block it. One has to block all the people on the list. If the person feels happy to repeat ad nauseam the same thing about Nehru's promise, etc. I think the fight should be done through the elected representative or pressure groups in Goa. Now that Special Status has got received a setback, it must be kept alive. There are two groups fighting for it. One of the groups is closely associated with Alina Saldanha. More than hoping for plebiscite, which was promised by the government of the day, Goa is in the same boat as J&K. In one way Goa differs from J&K is that the latter has been given special status because of its geographical and political situations. Those who are pro-Portuguese must join hands or forces with the groups fighting for Special Status. I feel that's the way forward. No point in looking back and trying to educate the list members that Goa's freedom was "illegal" and that the Indian government has failed to honour its promise. As far as I can see this government or any future government will not go back and so one must forget that plebiscite will ever take place. A new generation of post-colonial Goans has sprung up and many of them are interested in their future instead of looking back at its political past.When I say future, I mean getting good jobs in Goa, which are few, or moving to UK under Portuguese passports or to other foreign lands or rest of India. The craze for Portuguese passports may be among Catholic Goans. One can't fault them as they have the opportunity for it. Some have said Goa will be lost. But there are Hindu Goans who are not so keen on Portuguese passports, and they can be counted upon to save Goa for Goans. The Goa government should work to have laws that erect barriers for migrants, which is one of problem for which Special Status was sought for. Let's hope the government comes with some laws, instead of expanding its energies on dual citizenship. The government isn't blind to see Goa run over by outsiders. In an article, possibly last year, I had said that that the Goans holding Portuguese passports must be give an amnesty. There seems to be no solution otherwise. The citizenship issue is a conflict between two nations. The registration of birth in Portugal means the person is a Portuguese citizen even if the person has an Indian passport. It remains to be seen if the centre listens to the CM. Not sure if this may need Consituiional Amendement. If such a bill is troducted in Parliament it will create a big uprorar and the Opposition will go hammer and tongs against the government. Since the BJP has a majority, it would help in passing the bill.The former centre governments, including the BJP under Vajpayee, had opposed dual citzienship on various grounds. We have to see how the bill is worded. If the centre says that registration a birth in Portugal is okay as long as the person doesn't have Portuguese passports means it is contrary to Portuguese laws. Will the Portuguese then strke off the names of these people from its registers? If this happens will it affect those family members who got Portuguese passport on the criteria that the father's birth was registered in Portugal? Advocate General of Goa Atmaram Nadkarni has managed to arm twist the Law Secretary not to respond to the queries raised by Comptroller and Auditor General of India (CAG) on the very high fees being paid to him. After making a comparative study with other States, CAG through two reminders has sought an urgent explanation and justification from the Goa Government on the extremely high fees being paid to Advocate General Atmaram Nadkarni. Goa Government paid Atmaram Nadkarni by way of fees and other allowances a whopping Rs 2,055,9032 (two crores fifty five lakhs nine thousand and thirty two rupees) for the two years from March 2012 to March 2014. The Government also spent a further Rs 10,14,869 (ten lakhs fourteen thousand eight hundred and sixty nine rupees) on the airfare for the 17 trips made to Delhi by Atmaram Nadkarni from January 2013 to March 2014 by Business class while even the Chief Minister travels Economy class. Goa despite being the smallest state is not only hosting India's highest paid Advocate General but the country's highest paid public servant too. The President of India gets Rs 1,50,000 a month, the Chief Justice of India Rs 1,00,000 and a High Court Judge Rs 80,000. But Advocate General Atmaram Nadkarni pockets up to a whopping eight lakhs a month besides Rs 75,000 a day on his every visit to Delhi. This is nothing short of a day light criminal loot and plunder of the State’s exchequer. The post of Advocate General is not to make money. Persons have held it for honour by getting paid even a token Re 1 per month. If Chief Minister Manohar Parrikar has any valid and tenable justification for these high fees being swallowed by the Atmaram Nadkarni he should place it before CAG and see the response. Atmaram Nadkarni by his acts of commission and commission has taken the high constitutional post of Advocate General to the gutters. Alike the politicians he even got the public to sponsor the expenses of his 50th birthday which was hosted at the Taj Fort Aguada in Sinquerim. Professional ethics demands that a person occupying the high and solemn constitutional post as Advocate General should never appear for a private party in a case where the government is directly or even indirectly a party. Once appointed as Advocate General he cannot have a penchant for raking in the moolah by any unholy means. The Advocate General is a very high Constitutional authority and should never be someone who has a lust and greed for wealth or having vested interest with any lobby but has always to ensure the State’s best interests at heart. As a role model to the legal fraternity he has to uphold impeccable integrity and the highest ethical standards. He being an important functionary in the legal system and in the dispensation of justice, his conduct at all times must be absolutely beyond any shadow of doubt.
