The 'Bandra boy's' brutal run-in with the law prompts a transformational career 
choice.

Arun Ferreira, arrested on charges of being a Naxal operative in 2007, tortured 
by police, made to run from court to court, has, nine years later, taken a 
final clear leap on his steeplechase race towards justice. Last month, Ferreira 
got his Sanad from the Bar Council of Maharashtra and Goa and joined the ranks 
of criminal lawyers practising in Mumbai.

Ferreira, 42, an alumni of St Xavier's College, Mumbai, found his seemingly 
commonplace suburban life abruptly upended when he was whisked away from his 
Bandra home on May 8, 2007, by the Maharashtra police.

The social work he did for an NGO, Navjawan Bharat Sabha was deemed as covert 
Naxalite activity. Over the next four years, 11 cases were filed against him 
variously under the Unlawful Activities Prevention Act (UAPA) and the Arms Act; 
he was also charged with sedition. Ferreira was repeatedly picked up by the 
police and tortured, an account of which he has written in detail in his book, 
Colours of the Cage: A Prison Memoir. He was acquitted of all charges in 2012 
but his run-in with the law imbued in him a deep desire to work for justice, 
especially for political prisoners.

After his acquittal, Ferreira, who now lives with his family in Thane, 
completed his degree from Siddharth Law College and last month began working 
with advocate Suresh Rajeshwar. Along with Rajeshwar, he is now part of the 
'Indian Association of People's Lawyers (IAPL) and Committee for Protection of 
Democratic Rights (CPDR) — organisations that stood behind him when he was 
arrested and allegedly tortured in Nagpur jail.

"There was a time in my life when I thought it would be impossible to get out 
of jail, and yet, here I am, a degree in my hand and responsibility on my 
shoulder," he said talking to this newspaper from his office at Fort. "Earlier 
when I would stand in courtrooms, it was to prove my innocence but now I stand 
in court once again to prove someone else's innocence. My background helps me 
better understand about things like prison conditions and police torture. Of 
course, proving all that during trial is always a different challenge."

To start with Ferreira, is closely working with his senior on the case 
involving Angela Sontakke and others from the Kabir Kala Mach, Pune. "In one of 
my cases Angela and I were co- accused, now I am working as a lawyer for her 
and the other members from KKM. We have a strong case and will ensure they get 
justice," he said.

I was finally served a meal: dal, rotis and abuse. It wasn't easy to eat from a 
plastic bag with jaws sore from the blows I had received earlier in the day. 
The only solution, I learnt, was to soften the rotis by soaking them in the bag 
of dal. But after the horrors I had undergone, these tribulations were 
relatively insignificant and allowed me a brief moment to pull myself together. 
I managed to ignore the putrid bedding, the humid air and the ache in my body 
and dozed off. Within a few hours, I was woken up for another round of 
questioning.

The officers appeared polite at first but quickly resorted to blows in an 
attempt to encourage me to provide the answers they were looking for. They 
wanted me to disclose the location of a cache of arms and explosives or 
information about my supposed links with Maoists. To make me more amenable to 
their demands, they stretched out my body completely, using an updated version 
of the medieval torture technique of drawing (though there was no quartering). 
My arms were tied to a window grill high above the ground while two policemen 
stood on my outstretched thighs to keep me pinned to the floor. This was 
calculated to cause maximum pain without leaving visible injuries. Despite 
these precautions, my ears started to bleed and my jaws began to swell.

You may or may not be aware that the GOA you love is being bled slow and
steady. The profligate functioning [beyond the means] of its successive
governments, including the present one, has virtually put GOA in  ICU,
requiring blood transfusions through loans and borrowings for her survival.


Consider these few points which will be more than sufficient for you to
understand why we say what we have said above:

Goa’s Public Debts, as of today, is Rs. 66,000 Crores to be precise. Most
of the revenew collection goes into servicing of this massive borrowings
with little scope for re-payments. With this amount of debt burden, is
there a future for Goa’s posterity? Aren’t we spreading-out our feet beyond
our bedding?


Goa is still on the expired Regional Plan 2001-2010  when Goa should have
been on RP-2011-2020 with planning underway for RP-2021-2030. This is
because the task of planning is not entrusted to those who are qualified
but to cooks and butlers who plan for themselves and for their cronies and
masters, not for the people and the State.


Today, we live in Goa that had excellent Law and Order that we are still
proud of. In comparison, what we have today is total anarchy, leaving the
common man day-dreaming of justice. Vices of all sorts are seen to be
promoted by those who are the guardians against these. Every election time,
political conmen  dilute the resolve of the people to bring in the change,
through giving false promises and promises that are never intended to be
kept, offering doles to citizens as enticements to get their votes,
frightening them of the consequences of division of votes. The already bad
situation is rendered worst with new political conmen getting on the
bandwagon, seemingly all for the love of Goa and its people with no defined
program of action.

Goa has many other serious issues that are kept swinging like the air-sock
in the winds, besides the above few mentioned. But nobody seems to have a
concrete solution to these issues and solutions cannot be expected from
greedy and bulging stomacks. There has to be sacrifices built  into the
system with belt-tightening exercises, if the solutions are to work
effectively.

The year 2017 will be the year that Goans and Goa Lovers will have to
sensitize themselves to act decisively once and for all, not falling prey
to the canards of dividing votes, so that they may walk into GOA of 2022
free from past political chicaneries and halftruths.


Goa Su-Raj Party-GSRP, which is built on sacrifices, is coming out in the
next elections with sufficient number of candidates [minimum 30] to
convince Goans and Goa Lovers that it means business. The Party has been
lying low for nigh 15 years, to come out strong and steady when ready, for
the task of the take-over in full preparedness. And, the Party gives a
worthy promise, based on its intrinsic self-sacrificial psyche, that it
will deliver a governance to the people of Goa and to this State that has
so far been in their dreams only, coupled with Goa’s own High Command in
Goa, so that decisions taken by the Government of Goa for Goa and Goans are
taken in Goa, not in Delhi, Nagpur or elsewhere, with its priority being
that Goa shall be public debt free or very close to it within the first 5
year term, so that Goa’s posterity may breath with ease, looking forward to
a bright future, having been freed from the crippling burden of this heavy
yolk,  augmented with a steady monthly income of not less than Rs. 10,000/-
per family for life as their birth,  accruing from Goa’s  God given mineral
and other landed resources.

SUB: STRONG OBJECTIONS TO RP 2021 AND PUBLIC CONSULTATION PROCESS

Dear Sir,

We write to request you to kindly de-notify the Regional Plan 2021 and begin 
the process of preparing a new plan, whilst placing a moratorium on all 
constructions except single dwellings, until the new Regional Plan has been 
notified.

The RP 2021 is unconstitutional since the 73rd and 74th Amendments have not 
been considered. Besides the RP 2021 also violates Articles 14, 19 and 21 of 
the Constitution as well as the TCP Act since no data collection has been done. 
You will recall that the settlement zones have been added based upon individual 
requests rather than as broad demarcations and zoning areas. The RP 2021 has 
been prepared based on adhocism and arbitrariness instead of facts and relevant 
data collection. 

In view of the unconstitutional nature and statutory illegalities of the RP 
2021, we are sure you will agree that this Plan needs to be denotified 
immediately and a new Regional Plan 2031 based on a foundation of 
constitutional and statutory compliance as well as transparency and people’s 
participation needs to be created without fail. In fact, it is a mark of high 
disrespect to the people of Goa that the suggestions and objections given by 
them in the past should be blatantly disregarded and ignored and that they 
should be asked to once again come up with suggestions.

It is also strange that on the one hand, the Government asks the people of Goa 
to come up with suggestions for the Regional Plan, but on the other hand, it 
deviously constitutes an unwarranted and draconian Investment Promotion Board, 
that equips its other departments with powers to over ride and destroy the very 
essence of the Regional Plan. Hence the very idea of the unconstitutional 
Investment Promotion Board needs to be scrapped along with RP 2021.

The new Plan needs to be prepared based on the following :

1.Data that is current, relevant and up to date. RP 2021 was prepared in 
2008 without data, and in the 8 years since Task Force pointed out absence of 
data, no attempts are made to collect socio-economic/physical data, or new 
emerging facts regarding climate change. 

2.The data should include studies that consider 
a)the impact on Goa of the sea level rise
b) the weakening monsoons
c)the anticipated World Climate Change
d) water and food security of Goa, and impact of the future water scarcity 
in neighbouring States upon which we are dependent for our water and food
e) the cumulative impact of filling of our low-lying lands and cutting of 
our forests and hills for public and private projects, especially on flood 
prevention infrastructure
f) Impact of loss of forests and agricultural lands and loss of groundwater 
resources.
g) Economic impact of the policies of the past 50 years on the environment, 
economy and society of Goa and the costs and benefits that have accrued
h)Proper and accurate economic production figures, especially foreign 
remittances (which have been shown as zero in RP 2021), sustenance economy of 
agriculture, forestry, fisheries and animal husbandry (which are shown in RP 
2021 to be only 10% of the GDP), and which does not include imaginary 
attribution of economic production to banking, commerce, transport, 
communications, etc (depicted falsely in RP 2021 to be about 30% of our 
economic production) and which gives proper figures for contribution from 
industries (shown in RP 2021 to be 30%, but which is actually only a fraction 
of the figure stated)

3.Traditional flood prevention systems and food and water security of 
villages should not under any circumstances be compromised. It is utterly 
reprehensible that RP 2021 shows destruction of the flood prevention system and 
food and water security of villages for roads and government projects. Sand 
dunes, low-lying paddy fields and even water bodies in CRZ are shown as 
settlement in RP 2021. Bypass roads are shown in flood plains of our rivers 
threatening to destroy the flood prevention infrastructure in place. 

4.No new settlements and industrial estates should be marked in 
eco-sensitive zones, CRZ, agricultural lands and plateaus. Again, RP 2021 
appears to be actively promoting destruction of our eco-sensitive areas and 
agricultural resources, even going as far as to actively promote real estate 
speculation by marking wider roads and new roads.

5.Forests should be preserved. RP 2021 permits destruction of forests for 
settlement, mining and eco-tourism (an illegal insertion in the Policy Document 
for RP 2021) and other

[Goanet] LEXICON VESSEL IN ACTION AT RIVER MANDOVI

-FOR PANJIMITES TO SEE THE NEW PANJIM JETTY WITH LEXICON SHIP

Yesterday evening on 18th 2016, I have visited the Panjim Jetty and
surprisingly I saw  more than 500 local tourists boarding the vessel
LEXICON venturing a one hour sea ride for the sightseeing tour from the
Jetty towards Miramar to Mandovi Bridge and back to the Jetty which is
being operated from the Captain of Ports Jetty itself.
This Lexicon has the blessing of the Government as it was inaugurated with
pump and glory  by almost all authorities of the Government who were
present during the inaugural ceremony.
I have noticed  that tickets is being sold at Rs. 300/- per person, for the
sight seeing tour of one hour duration and the trips are continuous as the
tourists keeps on waiting for their turn at the jetty itself with their
tickets. The crowd perhaps is being  directed by the Paulo Tours and Travel
to the Jetty and the tickets are allegedly being sold in the car INOVA
which is parked inside the jetty area. ( see the photograph).  These  tours
starts in the evening  and the crowd is massive and Lexicon moves with
several trips until late evening hours with Dj  music on board.
I have sounded this kind of activity earlier to the Captain of
Ports authorities and the Goa State Pollution Control Board who are working
modalities, whether they have  legal permission to operate for such tourism
activities. As a Panjimite and senior citizen of Goa I am a bit worried if
there is no permission for this Lexicon ship to operate it will surely
destroy the environment and the  Mandovi river may be
further aggravated and polluted with the garbage and sewage if thrown into
the sea by these tourists visiting this vessel. The load on the in situ
board toilets may not be able to cope up with such a crowd on the vessel
and the stools/ faeces and urine  will tend to discharge  into the sea.
For this purpose I have requested the Goa State Pollution Control Board to
visit this ship and check if there are provision made in the vessel to
treat and to accumulate such discharges on the vessel itself or else  the
river will be polluted.
Already we have number of Casinos in the area apart from other regular
boats navigating in the river Mandovi and with this addition
of sophisticated  vessel I am afraid that it may turn into a major worries
for the Government in the future to control  such activities.
I have seen many of these tourists carrying food packets and perhaps if
permission given to take on board the vessel these empty boxes, plastic etc
will  be thrown  out in the river itself.-
Will the concerned authorities look into this matter and stop such
menace before it turns  into a MESS.--
Enclosed are few photographs of the activities at the Jetty tken in the
late evening and  the tickets  allegedly being sold on vehicle INOVA itself
through  the Paulo Travel agency and also their advertisement Board just
seen outside the Jetty.
