Re: [Goanet] Loyola School Student assault case... by Adv. Rajeev Gomes

2018-02-03 Thread Roland Francis
Complainant’s advocate may say anything he wants. His allegations must be
proved in a court of law. That is where defendant’s counsel would put forward
the statements you have mentioned in your post.

Malicious allegations may attract punitive damages and reimbursement of court
costs.

In this day and age even merely slapping which constitutes physical abuse, is
against the law even in India.

There are other punishments available to the principal for a misbehaving child,
leading up to dismissal. There is no excuse for physical punishment. If the
student himself gets physical, police can be brought in. You cannot take the
Law in your hands except in self-defence.

Jesuits are well-known for being good educators but also known for their short
tempers.

Serious physical harm to a minor does justify custodial interrogation, I am
afraid. If he is arrested if well he might have been, it is a bailable office,
so no jail time until court decides on the case.

[Goanet] Of Political Fathers and Political Sons, Political Mothers and Political Daughters

2018-02-03 Thread Joao Barros-Pereira
Chief Minister Dayanand Bandokar was the first Chief Minister of the
union territory of Goa. The Father(s?) of the Opinion Poll, Dr Jack
Sequeira, and some say, also Purushottam Kakokar and maybe another one
or two, successfully led and transformed Goa from a union territory
into a State. This much almost everyone knows.

No need to fight over who is the real Father of the Opinion Poll.
There can be Fathers of the Opinion Poll. After all, we are talking
about a social and political movement, and not an original scientific
theory which can emerge only from an individual's brain, a Newton or
Einstein. Let us keep the Opinion Poll in perspective, and not get
carried away.

The first Chief Minister of the union territory has a statue in the
State Assembly complex but no statue(s) of the Father(s) of the
Opinion Poll which paved the way for statehood. Why? It is shocking,
isn't it, as it is now five decades.

The first Chief Minister Dayanand Bandokar was an appointed chief
minister, he did not stand or sit for elections. He was the right
choice as he had a small ego. He was not ego-full and had he been
alive today would probably smile understandably at the ridiculous
arguments of some ego-full politicians who do not want another statue
next to his. Are two or three statues a big number in the Goa State
Assembly complex? Is it so small?

Although Dr. Jack Sequeira, the Opposition leader, and Dayananda
Bandokar, the first Chief Minister sparred in the Goa Assembly, after
the session, and on other occasions as well they would get together in
a spirit of camaraderie. Someone needs to assure the ego-full
politicians it is most unlikely the two statues will begin to fight
with one another as the two leaders had a good relationship in real
life. Peace, brothers, peace.

Another approach to this political aberration is to get rid of the
term Father(s) of the Opinion Poll and call it Sons of the Opinion
Poll as in sons-of-the-soil. Why not? It will put an end to all the
unnecessary bickering and politicization of the issue. I hope,
however, we will not have any new sons added to the list. We need to
have only a few as there might not be enough space in the Goa Assembly
State complex or the proposed park - and like our graveyards - some
will inevitably have to be uprooted unceremoniously.

There is suggestion to have a park with all the important people who
contributed to the freedom movement and Opinion Poll. And, let's not
forget, statehood, too. Goa's first Chief Minister Dayanand Bandokar
was for merger of Goa with Maharastra and so it is not suitable for
his statue to continue to occupy a space in the Goa State Assembly
complex. I say this because he will become a satire of sorts and open
to mockery, and it is not something we want our children, especially
our school-going children to know and witness; especially, when the
pro-Goa State leaders are conspicuous by their absence.

Goa's first Chief Minister Bandokar should be given a place of pride
in the park along with other leaders. The park needs to be big enough.
Not as big as Mopa but big enough. After all, the egos of our
politicians are huge and have to be kept within the walls of the park,
lest they stray outside the walls. My personal opinion is all the
statues of the leaders of post-Opinion Poll should be installed on top
of Sonoda Hill for present and future generations to clearly see
because of all their great shenanigans. It is an appropriate and ideal
site. That is my personal opinion, as I have no Party affiliation or
idealogical loyalty.

The best name in fact for the park might be Leaders of Goa. This way
there will also be room for present, and future leaders. Why not? Try
to include everyone, and end this ugly scene. Let's not forget we are
Goans, irrespective of political parties and ideologies, and so are
capable of fighting over this issue for the next fifty years!

That credit due to the leaders is now five decades late is a Goan
tragedy. We should not add insult to injury. Accept facts gracefully,
and grow up. The quality of our politicians all over India since
Independence has gone slowly down the hill into the drain, to the
extent the average educated Indian voter is simply embarrassed for a
variety of reasons to acknowledge their representatives. Kali Yuga is
here? I can't think of a better explanation.

Goa has several major problems. The decline of the economy due to low
iron ore prices, which looked at from the point of view of ecological
degradation and pollution, some might think of as good and not bad
news, and the same for coal. Endless unruly tourists on a shoe-string
budget - definitely bad news, not good news - strangely enough in all
types of vehicles is causing major problems for everyone, everywhere,
including driving away more financially attractive tourists. These are
a few major issues in the news today. There are, of course, a lot
more, and garbage, too.

And, we have time to fight over setting up of a statue(s)?

[Goanet] Imitation of Goacare health scheme.

2018-02-03 Thread Nelson Lopes
ModicaRE, IMITATION OF Goacare or Obamacare Medical scheme

This type of scheme is existing in Goa paying Rs 200 for family of two and
Rs 300= for a family of three and more. Our CM needs to be congratulated
for inspiring, motivating it to adopt modified scheme by the Centre

Our Netas do not use the services of the best Medical hospitals in India
but rush abroad for free treatment at Govt costs

The enplaned private Hospitals make a killing by claiming the said
prescribed fees, but charge over and above this limit, which is footed by
the patient. The patient tolerates the pinch silently, since it is
subsidized partly. The renowned Hospitals do not undertake to participate
in this scheme, because the payments/ reimbursement is pittance that is
delayed and its not remunerative for the Hospital.

Instead the Govt would do well to strengthen the Health care system, by
improving the Hospitals, Primary health centre with qualified doctors and
making available needed medicines at local level. The condition of our
hospitals in many states in India is appalling to say the least. Such
facilities stand to benefit the thousands who are forced to seek refuse in
these hell holes of death. The amount of insurance premiums could well be
ploughed into these institutions., The Insurance companies make the
payments out of premiums and stand to profit. It is always a profitable
proposition based on computations of permutations and combinations. They
are not into charitable business like many Corporation providing medical
relief. The process of selection and approving Insurance companies is not
without question ,as is the case with all Govt tender process

The process of availing these facilities is bothersome, knotted with
administrative formalities for many a illiterate population for whom it is
primarily designed. There is no check on total costs incurred by the
patient at these empowered Hospitals, whether to what extent the vulnerable
patients are fleeced

Instead of waiting and promising to treat the highly impoverished,
malnourished population, first priority should be clean drinking water ,
balanced diet , clean living environment and well planned , dependable
primary health care system and education that would empower population to
fight diseases

This is yet another high decibel gimmick after demonetization, GST. Why
the contributions of States is assumed without there consent or is it because
of expected support BJP ruled states ? It is stated about 2000 crores
are set aside without any planning of the premium amount, the source of
funding of this tom tomed as the biggest health care system in the world,
which appears to be the biggest HOAX in this election year to hood wink the
voters
