[Goanet] LEGAL NOTICE SERVED ON GOVERNMENT TO EITHER HOLD SESSION OR DISSOLVE THE ASSEMBLY

A legal notice has been served today on the Chief Secretary giving the Goa
Government 24 hours to either summon the required session of the Goa
Legislative Assembly or to dissolve it.

It is surprising that there is no proposal by the Government to convene a
Session of the Legislative Assembly as required under the Constitution of
India. If the government fails to ensure that the constitutional mandate is
followed the Bombay High Court at Goa will be moved for appropriate orders
and directions.

In terms of Article 174 of the Constitution it is the duty of the Governor
to summon the House and six months should not intervene between its last
sitting and the next sitting. The Legislative Assembly has to be convened
and meet within six months of its last sitting. Since the last sitting was
on August 31st 2016, the Governor is duty bound to summon the House on or
before 3rd March 2017.

The Supreme Court has held that Article 174 is mandatory and only when the
State Assembly is dissolved or kept under suspended animation in exercise
of power under Article 356 of the Constitution, the mandate of Section 174
is not mandatory.

The continuation of the Legislative Assembly without its meeting in
compliance with Article 174 of the Constitution would not only be a
travesty of the Constitutional mandate but also an absolute breakdown of
the Constitutional Scheme.

If the Chief Minister refuses to recommend the convening of the Assembly
Session to meet the mandate of Article 174 then in exercise of powers under
Article 174 (2) (b) of the Constitution, the Governor has powers to
dissolve the Legislative Assembly.

The Chief Secretary as the Principal Functionary of the State Executive is
duty bound to bring these facts to the notice of the Governor and apprise
her of the situation and urge the Governor to take appropriate steps either
for convening of the House or for its dissolution failing which the
Government will have no right to continue in office if it fails to fulfil
the mandate of Article 174 (1) of the Constitution.

The Director General of Police has directed Superintendent of Police
Shekhar Prabhudesai to submit an immediate report on the complaint over the
huge disproportionate assets acquired by Crime Branch Police
Inspector Dattaguru Sawant.



Dattaguru Sawant on 18th August 2014 at an auction conducted by the Goa
Housing Board had bid for a mindboggling amount of Rs. 1,45,86,000 for a
plot admeasuring 483 sq. mtrs. at Durga Vaddo in Taleigao.



Dattaguru Sawant is also accused of having through a benami transaction
purchased Flat A-102, at Risara Luxuria in Taleigao admeasuring 138 sq.
mtrs. for Rs. 89,80,800 where he is currently now residing. He has
reportedly also furnished that flat to a tune of Rs 20 lakhs which was all
purchased from a premium furniture store THE TREASURE located at Dukle
Heaven in Taleigao. Dattaguru Sawant and his spouse Manuja who is a
housewife also own two Polo cars bearing registration No  GA07K2111 and
GA07Q2111.



Interestingly Dattaguru Sawant is reportedly drawing House Rent allowance
despite being in possession of a government residential premises in Block
M-52 at the Montepio quarters at Althinho which he has kept closed.



Dattaguru Sawant with his very close links with the BJP and RSS
was inducted as a Police Sub- Inspector in 2002 during Manohar Parrikar?s
first term as Chief Minister but his appointment was set aside by the High
Court as illegal. The matter is now pending before the Supreme Court since
2004. Dattaguru Sawant was later dismissed from service in 2004 for
allegedly extorting money at Mapusa but managed to be reinstated in 2006.

Dattaguru Sawant as Police Sub-Inspector at Konkan Railway Station at
Margao on 1st September 2013 demanded free helmets from the goods
consignment that had arrived at the Railway Station. After the two porters
refused to give him free helmets, Dattaguru Sawant arrested and implicated
them in a false and fabricated case which was not only a grave misconduct
on his part but a severe police atrocity. For this Dattaguru Sawant is
currently facing proceedings before the Goa State Police Complaints
Authority.



Dattaguru Sawant had a criminal record even before becoming a police
officer with an F.I.R registered against him in 1999 at the Panaji Police
Station for having along with some BJP activists sprayed black ink on then
Goa Pradesh Congress Committee President Shantaram Naik at the entrance of
Cafe Bhosle in Panaji.



Now cornered in a tight spot, the beleaguered Dattaguru Sawant is trying to
flex his political muscles and also kneeling down for mercy before some IPS
officers.



Let us hope that the no-nonsense Chief Secretary of Goa Dharmendra Sharma
and Director General of Police Dr Muktesh Chander who are both overseeing
this case will not allow the law to be reduced to an Ass. This one awfully
rotten apple cannot be allowed to bring utter and brazen disrepute to the
entire Goa Police force. And if it is Zero Tolerance to Corruption,
Dattaguru Sawant should have already been cooling his heels at Goa?s
Central Jail at Colvale.

Drug addiction and trafficking is very much embedded in every nook and
corner of Goa in every town and village be it Margao, Vasco, Saligao,
Arambol, Keri, Not only are Tourists both domestic and international making
a beeline to Goa given the easy availability of drugs who are being
targetted but also the local Goan population.

If 80's were bad, 2017 is a nightmare! Now small gaddas,bars, security
guards and even Goans  are openly selling drugs in every nook and corner,
under the patronage of the Politicians and law enforcement authorities many
of whom are involved in the drug trade in Goa.

Neither the Government nor the Police want to curb this problem as they are
hand in glove with the Drug Mafia and this is an evil nexus.

Days after Punjab deputy CM Sukhbir Singh Badal said at Express Adda that
though Goa is the easiest place to find drugs, Punjab is branded as the
drug capital, Goa CM Laxmikant Parsekar and the Law Enforcement were quick
to dismiss it off and Parsekar said the drug menace in Goa is “not as
complex as it is in Punjab”.

Goa and Goemkars are heaped with all sorts of social evils and  vile abuses
on all fronts not just  drugs, gambling and casinos,  prostitution and
trafficking of human beings and children. It is a mess and downright
shocking! We just close our eyes, ignore and pretend it doesn't exist when
it is happening under our very noses. You don't see a single social ad
anywhere in the media be it print or on television warning our youth about
the menace of drug addiction, which is the responsibility of the Goa
Government. Support systems for rehabilitation and de-addiction are pretty
much non-existent.

It is sad to see this being trivalised as it is "no joke" for those
families who have to cope with it.

Here's an article, we have to educate our Goan youth and children and
communities before more fall prey to this evil scourge. Sadly the chances
of recovery who once try these drugs is very poor, after they are lured
into it very often they in turn become traffickers and become victims of
other evils too,
Drug abuse growing among teenagers in Goa: NGO (Economic Times)

PANAJI: Substance abuse, which is largely associated with adults, has now
trickled down to teenagers with a growing number of school children getting
addicted to various narcotics in Goa, according to an NGO working in the
field of drug de-addiction.

"The trend of teenagers consuming drugs has suddenly risen in last
two-and-half years. Today, the average age of a drug consumer has dropped
to even teenagers," said Fr Joseph Pereira
, founder of NGO
Kripa Foundation
, which
works on de-addiction pan-India.

Earlier, the college-goers or drop outs were commonly found to be consuming
drugs, but today the menace has sneaked in even into schools, he said.

Fr Pereira, who runs a rehab centre in Anjuna, a village known for its all
night rave parties, claimed that teenagers doing drugs has attained an
alarming proportion.

"It is getting progressively worst in Goa. As it happened in the case of
alcohol abuse, Goa has also suffered from denial syndrome when it comes to
drugs," he said.

Pereira linked the growing trend of school children attracted towards
substance abuse to 'social status' as they see it as an "in-thing" to do.

The entry level drug consumers are doing 'weed'.

"This is satanic... by saying satanic I mean this is evil. And this evil is
so subtle that by the time you know about it entire society is destroyed.
Parents wake up late," he said.

Instances of drug being done by teenagers who come from educated families
have been noticed in the recent past, and in few cases, children are being
treated at state-run Institute of Psychiatry and Human Behaviour

(IPHB).

The incident of two youths dying of drug overdose in Curtorim village
(South Goa) during a birthday party in April 2015 year had shocked entire
Goa.

Curtorim MLA Aleixo Reginaldo Lourenco
 on the
incident said police's response towards drug menace has been "lethargic".

"Police is totally lethargic towards the menace. After the incident (at
Curtorim), the main operator is still absconding. We have been telling the
department (police) that narcotics have reached our door steps in the
villages," Lourenco, who had raised the issue during the recently held State
Legislative Assembly

session, said.

"It looks like police are totally involved in allowing the drugs to flow
smooth. Drug is still happening in village, though I have no proof to
substantiate it," he alleged.

Police, however, said they have been raiding places whenever the
information is provided.

Regardless of the news that is available to you, rest assured that everyone
else knows that the POTUS is not a voluntary position. The title holder
gets paid. What he says he does with that pay is up to you and me to
believe (or not). Trump's record on donations is a fascinating one and
everyday, thank you Jesus, brings another surprise. I really do not know
what made you want to claim that POTUS does not get paid!

As far as Canadians are concerned, the latest news is that Trump is going
to appoint two US ambassadors to Canada. Ted Cruz will be based in Ottawa
and Romney in Toronto. Canadians extend their welcome to both - after all,
we did banish our first female PM to a diplomatic spot in southern
California. Ted Cruz, mais oui,  has the distinction of being the only
person who ran for POTUS - who knew the difference between a moose and a

The southern US border is going to be what consumes Bwana Trump. It seems
that he is already tweeting that he has calculated the exact number of
bricks - to within an error of one - to build the wall.I expect Trump to be
in charge of the construction and George Bush (43) to be in charge of the
security on US side of it. Trump's policy, I am told, is to stop the entry
of bad hombres and to turn a blind eye to drugs from the same source.

One last thing, you can go to a department store in the US today and buy
Trump designer clothes selling at a 95% discount.

Dear Frederick,

Wow. Thanks very much for the detailed, footnoted, passionately argued
set of comments and perspectives on my last Op/Ed in the TOI.

Actually, most of what you've written doesn't conflict with my own
analysis. You concede the facts, and your interpretation simply
differs from mine in varying degrees. We can argue endlessly whose
angle is right or wrong (generally, I think you're way off!), but here
let me concentrate on three areas which might actually involve
tangible difference.

1) The relevance of electoral percentages.

In a small state like Goa, given the high glare of attention at the
moment, I would dispute that voter suppression is significant to any
extent. Yes, voters do occasionally have to go through onerous
processes to register, then vote. But that's barely a statistical
blip. The CEC data over years shows that the very great majority of
eligible voters show up at the polls.

2) The "myth" that the Bahujan Samaj, a loose agglomeration of lower
castes, is what Bandodkar's MGP represented.

Frankly, I don't understand your argument. As endlessly proven by the
historical record - and as wonderfully meticulously pointed out in
Parag Porobo's book - Bandodkar's MGP's record in office was an
extensive programme of emancipation and empowerment of the Bahujan
Samaj. The results in terms of human development were stark and
dramatic, and - as Porobo says - presages the rise of lower-caste
political dominance in other states in later decades. Why is it
relevant that Bandodkar was from a relatively powerful non-Brahmin
caste? Even Periyar came from a wealthy, well-connected family...

3) 30% literacy in 1961 is "dismal".

Again, I find your argument pointless. The fact is Portugal's modern
and contemporary record in education has been abysmal, starting with
the "home" country. In Goa it was even worse.This explains why the
mass of Goans with some means sought private education in Marathi and
English, and in the 20th century tended to troop across the border for
education. By what measure is 30% literacy wanting? By comparison to
the Goan diaspora in every part of the world in the same era. It
should also be pointed out that literacy (and access to primary
health) soared in Goa in just a decade and a half after 1961, which
amply demonstrates the colonial regime's priorities.

2-0 in the Finals of the 1st CBSE Goa Sahodaya Schools, Under-13 Boys
Football Tournament.

The seven schools tournament that had a two pool league system followed by
semifinals and a finals, is the first tournament of its kind wherein all
seven private Central board Schools in Goa have decided to come together to
excel in sports and education.

The football tournament had a total of seven schools which include Mount
Litera Zee School, Green Meadows School, Sunshine Worldwide Academy, Vidya
Vikas Academy, Bharatiya Vidya Bhavans, Fr Agnel Central School and The
King’s School as the host venue school.

The seven team tournament had a total of 12 matches, with Fr Agnel Central
School dominating the league stage being unbeaten until the finals and were
the favorites to win the tournament with a clean sheet

Fr Agnel Central School and The King’s School topped the league stage from
Poll A to proceed to the semifinals and were pitted against Green Meadows
School and Mount Litera Zee School who topped the Pool B in the league
stage.

In the semis The King’s School U-13 team beat Mount Litera Zee and won 4-1
with the goal scorers being while Fr Agnel Central Central School won the
semis beating Green Meadows School 4-0.

The finals was keenly contested and played under floodlights after both the
teams fought it through the day. Sanath Borkar and Shabaz Khan starred for
The King’s Schools scoring two brilliant goals from outside the b ox and
finally netting goals against Fr Agnel Central School

Melric Perreira from Fr Agnel Central School scored 6 goals in the
tournament and was the highest goal scorer of the tournament while The
King’s School Adon Cardozo bagged best Best Goalkeeper of the tournament,
Best Defender award was bagged by Aditya Prabhudessai. Scorer in the
finalist, The King’s School Shabaz Khan went on to win the player of the
tournament trophy.

The King’s school coaches Santan Furtado and Riddesh Madgavkar expressed
great satisfaction on winning the tournament and commended the efforts of
the GFA referees in organizing a fair tournament. Former Director of the
Directorate of Sports and Youth Affairs, Dr Suzana D’Souza was the Chief
Guest of the tournament and gave away the medals and the trophies.

definition of literacy in the 1960s. Just signing one's name?

This reminds me of the "Goa missed two Five Year Plans" argument put
forward by those making a case for more funding from New Delhi. Fact is
that inspite "missing" two Five Year Plans, in the early 1960s, Goa's
indicators were much ahead of comparable (non-metro) areas within the rest
of India. I know this sounds like a terrible apology for four-and-half
centuries of colonialism, but am just stating a counterpoint without
suggesting in any way that any form of colonialism can be recommended for
anyone. If Goa continues to show high indices, including on the per capita
income, it's because of the hard work (including migration) of its people,
not because we have the best politicians or electoral system in the world.

seems to ignore the fact that the Opinion Poll was won by a very narrow
margin indeed. If 17k voters had to switch sides, things could have gone

manufactured dispute to ensure that no more serious demands (such as that
of a referendum) would be raised in Goa then. From all signs and symptoms,
it is clear that New Delhi was keen to go ahead with the "Opinion Poll"
(don't miss the significance of its name, opinion indeed!) here, while also
being equally keen to make sure that the non-mergerites did not lose it.
The latter could have been a real recipe for disaster and turmoil.

To say Goa ia reached "one of the highest levels in the developing world"
in literacy is not statistical truth. Goa isn't the top literate state in
India, and that honour goes to Kerala, with 93.01% literacy. Goa, in 2011
census, came up to 88.70 %. India's lieracy rate 63.83 %.

Maybe the newly-added young voters made a difference, though the voting
figure was less than in 2012. Considering the migration of Goans to UK and
other parts of the world, particularly Christians, the turnout is
impressive.

It's no point to pointing out to American democracy. What happened in US is
a sad lesson for democracy. If that can happen to the world's strongest
democracy, anything can happen in the world largest democracy, that is
India. The election of the president is a complicated matter, and one
should understand why Trump could elected despite having about 3 millions
votes less than HIllary. Losing in the popular vote but winning in the
electoral college votes is a form of system that US practices in its
efforts to have checks and balances.
Just days ago, Canadian PM Justin Trudeau ditched his election promises to
have electoral reform. There were province-wide meetings. The
first-past-the-post was still considered a viable system, obviously
thinking that if the NDP's suggestion that "ranked ballot" may not favour
the Liberals in the next election. Parties want to twitch the election
process for their own selfish interests.
To me, Goan democracy will show signs of maturity when the electorate is
politically-savvy to vote with clear minds. We have seen candidates with a
bad past getting elected again and again. Politicians who served the
highest electoral office were back in the fray.
In India, politicians like Pawar go on and on, and people vote for them.
Retiring from public life is no option for most of them. We now see the
greed for office in TN. Seeing photos of MLA laying prostrate at the fee of
the later Jayalalitha is something cannot bear to see. In Canada, I once
met an MP outside a grocery store and he was alone, unlike in India, where
MPs are surrounded by a group of loyalists or chamchas.
Pierre Trudeau, who served as Canadian PM for about 16 years and now his
son holds the highest office, famously said of MPS, "When they are 50 yards
from Parliament Hill, they are no longer honourable members, they are just
nobodies."
When I see (on TV) Trump make those funny faces and his fingers do the
talking more than his mouth, I feel that democracy has failed USA. With so
much chaos since inauguration, it seems people who didn't vote for Trump
are in for a long haul. The White House shows Shades of Gray.

Another wound pierces the green heart of Goa along the highway leading
down from Verna to the Zuari Bridge. From times immemorial, lush and
well-irrigated rice paddies have lined both sides of the road, always
glistening brilliant emerald with multiple crops throughout the year.
That emblematic sight is now forever marred. Tens of thousands of
square metres of the richest agricultural land in the state have been
overnight filled up for pointless "road widening", expanding the
perfectly adequate highway to a vast tarmac. Like similar works under
way across the bridge on the bypass at Agasaim, it appears the
contractors acted without consulting local authorities and
stakeholders, and before undertaking the necessary environmental
impact surveys.

The hasty, shoddy, careless nature of yet another deeply dubious and
wasteful scam infrastructure project by the current administration
will come as no surprise to state citizens. Over the past five years,
Goa has seen its public debt soar past sustainability to danger of
bankruptcy, as the cabinet of ministers wilfully approved a long
string of alleged "development" that no one wants, needs, asked for or
benefits from — other than a small coterie of cronies and crooks. The
modus operandi has been near identical in each case — highly opaque
procedures, instant approvals without any public oversight, huge cost
overruns, and zero accountability.

Rampant road widening projects under way all across tiny Goa's
landscape are inevitably described as "essential", an imperative need.
Whenever traffic jams state highways and bridges — as routinely occurs
throughout the winter months — this administration seizes on the
delays as its excuse and justification to continue to spend thousands
of crores, and consume vast amounts of farmland, for "infrastructure
improvement." But that reasoning is thoroughly fallacious, and has
been comprehensively debunked everywhere in the world. In fact, road
expansion inevitably leads to more traffic with increased numbers of
vehicles. As the noted American urban planner Lewis Mumford wrote,
"building more roads to prevent congestion is like a fat man loosening
his belt to prevent obesity."

Decades ago, transportation experts detected a broad phenomenon they
called "induced demand". Mumford was among the pioneer researchers. He
wrote in 1955, "people, it seems, find it hard to believe the cure for
congestion is not more facilities for congestion." He found that
everywhere and always, expansion of road facilities have never
resulted in a decrease in traffic. Instead, several other converging
factors quickly come to bear, to ensure no perceptible or lasting
change. Some commuters are emboldened to change their driving
schedules, others switch routes, and even greater numbers become
motivated to purchase individual vehicles rather than rely on the
vagaries of public transport.

One of Mumford's immediate successors, Anthony Downs then formulated a
"universal law of highway congestion" that "on urban commuter
expressways, peak-hour traffic congestion [always] rises to meet
maximum capacity." It has been proven again and again — no matter how
many lanes, no matter how wide the roads, the entire system will
inevitably and unavoidably become choked with traffic unless two other
crucial factors come into play. The first is congestion pricing, which
is likely unworkable in Goa (with the possible exception of Panaji).
The other is the most abused and ignored aspect of India's
infrastructure — robust and scalable public transportation.

In this regard, Goa's abject failures merely reflect a wider national
disgrace. India's transportation woes severely drain on the economy
and carry a critical price in multiple areas, from food security to
public health. Chaos and mayhem on the roads are a major factor in the
perilous air quality which plagues most urban centres in the country.
According to World Health Organization's air pollution database, 10 of
the 20 unhealthiest cities on the planet are in India, with by far the
main cause being vehicular congestion. Air pollution is one of the
biggest causes of death in India. The average citizen loses years of
life simply by breathing.

There is no excuse at all for Goa to plunge directly to such hazards,
but that is precisely what is unfolding in plain view. Just last year,
the Goa State Pollution Board warned repeatedly that alarming spikes
were recorded in "respirable particulate matter" (which is caused by
vehicular exhausts) in both Vasco and Panaji, that were more than two
times the national ambient air quality standard. It's a clear red flag
that points to a frightening impending health emergency. Whatever
political alignment shapes the next government of the state, the
lurking air pollution problem deserves priority, along with its
interlinked corollary, a working and adequate public transportation
system.
