Bismillah [IslamCity] Teaching Islam

2008-07-07 Thread PoEtEsS
Teaching your Child about Islam
 Freda Shamma PhD
 --
Children are born in a state of fitra (purity) and then their parents teach
them to be believers or unbelievers. According to the Musnad Ibn Hanbal, "The
children of the unbelievers are better than you grown-ups. Every living
creature is born with a righteous nature." It is our obligation and duty as
parents to teach our children so that they grow up to be believing, practicing
Muslims. Sending the child to an Islamic weekend school or to a full-time
Islamic school is an important but minor part of their Islamic education. The
major 'institution of learning' for each child is his family, and the major
'professors' of this institution are the parents.
ROLE MODELING
The most effective way to teach anything to anybody is to be a role model.
This is why Allah sent human beings as prophets to all peoples. Whether we
willingly accept this job or not, it is a fact that your child learns how to
function in life by watching what you do. Even the absent parent is role
modeling to the degree that a boy, whose father abandoned his family, will
probably treat his own children the same way.
Every time we deal with our children, we are teaching them, whether we intend
to or not.
There is a famous poem by an anonymous author that depicts this vividly. It
begins:
If a child lives with criticism, he learns to condemn.
If a child lives with hostility, he learns to fight.
If a child lives with ridicule, he learns to be shy.
Therefore we must examine carefully how we deal with our child in order to have
a desirable end result.
 This same poem continues:
If a child lives with tolerance, he learns to be patient.
If a child lives with fairness, he learns justice.
If a child lives with security, he learns to have faith.

No coercion in faith

By Sidrah Unis

WHAT is the Islamic view on freedom of religion? Is Islam intolerant towards
other faiths? Do Muslims and non-Muslims enjoy equal rights in an Islamic
state? These questions are frequently raised in the western world.

To begin with, there is an immense difference between what the Quran and the
Sunnah declare and what some misguided Muslim groups and govenments actually
do. Even a cursory reading of the Quran and the Sunnah clearly shows that
tolerance is an essential obligation that Muslims are required to abide by.
Though Islam encourages the spread of faith by way of preaching and discussions
with non-Muslims, Muslims have been instructed to do it in the most respectful
and kind manner, “Call thou (all mankind) unto thy Sustainer’s path with wisdom
and goodly exhortation, and argue with them in the most kindly manner.” (16:
125)

If non-Muslims disagree with the message of Islam, Muslims are not allowed to
employ any method of intimidation or compulsion, “There shall be no coercion in
matters of faith.” (2: 256) “Thus, (O’ Prophet) if they dispute with thee, say,
‘I have surrendered my whole being unto Allah, and (so have) all who follow me.’

And ask all those who have been vouchsafed revelation aforetime, as well as all
unlettered people, ‘Have you (too) surrendered yourselves unto Him?’ And if
they surrender themselves unto Him, they are on the right path; but if they
turn away, thy duty is no more than to deliver the message.” (3: 20) “And had
thy Sustainer willed, all those who live on earth would surely have attained to
faith, all of them. Wilt thou then force men till they are believers?” (10: 99)
“And say: ‘The truth (has now come) from your Sustainer. Let, then, him who
wills, believe in it, and let him who wills, reject it.”’ (18: 29)

Thus, Muslims are not only prohibited from imposing their faith on non-Muslims,
Islam instructs them to treat non-Muslims with kindness: “As for such (of the
unbelievers) as do not fight against you on account of (your) faith, and
neither drive you forth from your homelands, Allah does not forbid you to show
them kindness and to behave towards them with full equity: for, verily, Allah
loves those who act equitably. “Allah only forbids you to turn in friendship
towards such as fight against you because of (your) faith, and drive you forth
from your homelands, or aid (others) in driving you forth: and as for those
(from among you) who turn towards them in friendship, it is they, they who are
truly wrongdoers.” (60: 8-9)

In fact, the Quran goes to the extent of forbidding Muslims from using any
insulting remarks about any deity worshiped by any non-Muslim. It says, “But do
not revile those (beings) whom they invoke instead of Allah.” (6: 108)

The following charter granted by Prophet Muhammad (PBUH) to the Christians of
Mount Sinai is an excellent example of how non-Muslims are supposed to be
treated in an Islamic state: “This is a message from Muhammad Ibn Abdullah, as
a covenant to those who adopt Christianity, near and far, we are with them.
Verily, 1, the servants and helpers, and my followers defend them, because
Christians are my citizens; and, by Allah, I hold out against anything that
displeases them.

“No compulsion is to be on them; neither are their judges to be removed from
their jobs, nor their monks from their monasteries. No one is to destroy a
house of their religion, to damage it, or to carry anything from it to the
Muslims’ houses. Should anyone take any of these, he would spoil Allah’s
covenant and disobey His Prophet. Verily, they are my allies and have my secure
charter against all they hate. No one is to force them to travel or to oblige
them to fight. Muslims are to fight for them... Their churches are to be
respected... No one of the nation (of Islam) is to disobey the covenant till
the Last Day.”

The principles given in the Quran and the Sunnah regarding tolerance and
pluralism were observed by the Pious Caliphs as well as later rulers.
Al-Qarafi, explaining the responsibility of the Islamic state to the Dhimmis
(non-Muslim citizens), said: “It is the responsibility of the Muslims to the
People of the Dhimma to care for their weak, fulfil the needs of the poor, feed
the hungry, provide clothes, address them politely, and even tolerate their
harm even if it was from a neighbour, even though the Muslim would have an
upper hand. The Muslims must also advise them sincerely on their affairs and
protect them against anyone who tries to hurt them or their family, steal their
wealth, or violates their rights.”

Non-Muslim citizens have the same rights to life, religion, respect, education,
expression, property, and enterprise as given to Muslim citizens. No govenment
can curtail or restrict these rights and liberties granted to Dhimmis.

One must not forget that an Islamic state is fund

Bismillah [IslamCity] The Month of Rajab By: Mufti Taqi Usmani

2008-07-07 Thread PoEtEsS
When his wife told the story to the wife of the Prime Minister, she
disbelieved her and because of this disbelief, she and her husband, the Prime
Minister, were punished by Allah. He was removed by the king from the prime
minister-ship and was imprisoned in a jail and was ordered to be hanged. While
being in the prison, the wife of the Prime Minister remembered that she had
disbelieved the story of Jafar al-Sadiq told to her by her maidservant and
their misery might be the punishment of their disbelief. On this point, she and
her husband repented before Allah and made a vow to observe the custom of
"Koonda", if they are released from the jail. After they made such a vow, the
whole scenario of the events changed suddenly. The king released the Prime
Minister from the jail and reinstated him on his former position.

As it can be seen by any reasonable person, this story is totally forged on
the face of it. The person who has coined this story did not even know that
Madinah had never a king nor a Prime Minister. All the Muslim rulers were named
as caliphs and had no Prime Minister at all. In the days of Umayyads, their
capital was Damascus and in the days of Abbasids, their permanent seat was in
Baghdad. It is ironical that the story of such a woodcutter is not even known
to anybody in Madinah, nor in any city of the Arab countries. No Arabic book
has ever referred to it. It has no mention except in an Urdu book
'Dastaan-e-Ajeeb', the author of which is unknown. One can easily see that a
custom based on such a fallacious and mythical story can never be an Islamic
custom. Islam has always been far away from such superstitions. Therefore, this
baseless custom should completely be avoided by the true Muslims. Some
historians have opined that in fact, this custom has been coined by some
Shi'ites because the date of 22nd of Rajab is the date of the demise of
Sayyidna Mu'awiyah whom they take as their biggest enemy. They took that date
as a happy occasion and made the Sunni Muslims also to celebrate it on the
pretext of the above mentioned story.

Be that as it may, it is evident that such customs have crept into the Muslim
society by their long association with Hindus who commemorate different
historical events of their religion in the like manner. The Muslims must be
careful about these customs, because they are not only an invention of
ignorance but also the imitation of non-Muslims in their religious rituals. No
doubt the "'isaal-al-thawab' to the soul of a deceased Muslim, and particularly
to a pious person is not only permissible but also a commendable practice but
the Shari'ah has not prescribed a particular date, nor a particular mode to do
so. If someone wants to make
"'isaal-al-thawab" to Sayyidna 'Ali, Radi-Allahu anhu, or to Ja'far al-Sadiq,
he can do it any day and by performing any act of worship, like Salaat, fast,
Sadaqah, dhikr etc.

There is no reason why it should be restricted to a special type of meal or
bread distributed on a particular date. What makes this practice worse is the
fact that the people accustomed
to this practice deem it as necessary as a fard (obligation); rather they
treat it as more necessary than fard because they do not care to perform the
obligatory Salat or to fulfill the rights of men obligated on them, but they
are very strict and punctual to perform these activities. Moreover, if a person
does not observe this practice, they reproach him and call him with bad names.
Such behavior makes this custom a bid'ah which is condemned by the Holy Prophet
as a misguidance. Therefore, the Muslims must abandon all such practices and
should not cling to it only because it has been the practice of their society
for many years. A Muslim is supposed to follow the dictates of Shari'ah and not
the practice of the society, if it violates any of its principles.

 Conclusion

The upshot of the above discussion is that the Shari'ah has not prescribed any
specific way to observe the month of Rajab or to perform a specific mode of
worship or a ritual in any one of its dates. However, being a prologue to the
month of Ramadan, it should be availed of for preparing oneself for Ramadan and
one should pray Allah to make him reach the blessed month and to benefit from
its unique merits.

Bismillah [IslamCity] Raising children in Islam

2008-07-07 Thread Shahid Khan

Raising children in Islam

**

*

ISLAM believes that the family is the cornerstone of the Muslin society and
the cause of its continuity. This is why Islam has shown so much concern to
preserve the solidarity of the family unit. Raising children properly is one
of the reasons that help to create a sound society based on ethics and
decorum. This task has become very hard in the last three or four decades
after children became addicted to watching T.V, video games and finally the
internet that swallows children's time and captures their attention.
Parent's role is to attract their children's attention to teach them good
manners.

One of the mistakes that some parents commit is that they deal with their
children as stupid beings that should be spoon-fed or filled with
information. They are intelligent beings and parents have to appreciated and
respect this fact in order to be able to approach them correctly.

Prophet Muhammad (peace be upon him) stresses in more than one Hadith the
importance of the role of parents in bringing up their children properly. He
asks parents to pay attention to the age of their children when deciding to
choose the best way to deal with them: at a certain age it is important to
be strict with them, but when they become teenagers, it is of prime
importance to befriend them to be able to approach their world.

Some parents believe that toughness is the best way to raise their children
which is totally wrong. Prophet Muhammad (peace be upon him) used to share
the fun and light moments with his grandchildren making them enjoy their
time with him.

The final advice that can be given in this respect is a Qur'anic one," Let
those (disposing of an estate) have the same fear in their minds as they
would have for their own if they had left a helpless family behind: Let them
fear Allah, and speak words of appropriate (comfort)." *(Qur'an, 4:9)*

One important fact that has to be stressed in this respect is that the
father's role is as important as that of the mother because some parents
believe that their role consists of earning money and providing the basic
necessities of life to their family.

They believe that it is the mother's business to raise children, but this is
not true at all. Islam addresses both parents as being responsible for
bringing up their children and teaching them the noble values of Islam.

Bismillah [IslamCity] The Month of Rajab By: Mufti Taqi Usmani - to be continued

2008-07-07 Thread PoEtEsS
The Month of Rajab

 By Mufti Taqi Usmani

 http://www.albalagh.net/general/rajab.shtml

Rajab is the seventh month in the Islamic lunar calendar.  This month was
regarded as one of the sacred months (Al-Ashhur-al-hurum) in which battles were
prohibited in the days of the Holy Prophet (sallallahu alayhi wasallam). It is
also a prelude to the month of Ramadan, because Ramadan follows it after the
intervening month of Sha'ban. Therefore, when the Holy Prophet sighted the moon
of Rajab, he used to pray to Allah in the following
words: "O Allah, make the months of Rajab and Sha'ban blessed for us, and let
us reach the month of Ramadan (i.e. prolong our life up to Ramadan, so that we
may benefit from its merits and blessings)."

Yet no specific way of worship has been prescribed by the Shari'ah in this
month. However, some people have invented some special rituals or practices in
this month, which are not supported by reliable resources of the Shari'ah or
are based on some unauthentic traditions. We would like to explain here the
correct position about them.

 1. Celebration of Lailatul Mi'raj

It is generally believed that the great event of Mi'raj (ascension of the Holy
Prophet to the heavens) took place in the night of 27th of Rajab. Therefore,
some people celebrate the night as "Lailatul- Mi'raj" (the night of ascension
to heavens). Indeed, the event of mi'raj was one of the most remarkable
episodes in the life of our beloved Holy Prophet . He was called by Almighty
Allah. He travelled from Makkah to Baitul-Maqdis and from there he ascended the
heavens through the miraculous power of Allah. He was honored with a direct
contact with his Creator at a place where even the angels had no access.

This was the unique honor conferred by Allah to the Holy Prophet alone. It was
the climax of the spiritual progress which is not attained by anybody except
him. No doubt the night in which he was blessed with this unparalleled honor
was one of the greatest nights in the history of this world. But, Islam has its
own principles with regard to the historic and religious
events. Its approach about observing festivals and celebrating days and nights
is totally different from the approach of other religions.

The Holy Qur'an and the Sunnah of the Holy Prophet did not prescribe any
festival or
any celebration to commemorate an event from the past, however remarkable it
might have been. Instead, Islam has prescribed two annual celebrations only.
One is Eid-ul-Fitr and the other is Eid ul-Adha. Both of these festivals have
been fixed at a date on which the Muslims accomplish a great 'ibadah (worship)
every year. Eid-ul-Fitr has been prescribed after the fasts of Ramadan, while
Eid-ul-Adha has been fixed when the Muslims perform the Hajj
 annually.

None of these two eids is designed to commemorate a particular event of the
past which has happened in these dates. This approach is indicative of the fact
that the real occasion for a happy celebration is the day in which the
celebrators themselves have accomplished remarkable work through their own
active effort. As for the accomplishments of our
ancestors, their commemoration should not be restricted to a particular day or
night. Instead, their accomplishments must be remembered every day in the
practical life by observing their teachings and following the great examples
they have set for us. Keeping this principle in view, the following points
should be  remembered with regard to the "Lailatul-mi'raj":

 (1) We cannot say with absolute certainty in which night the great event of
mi'raj took place. Although some traditions relate this event to 27th night of
the month of Rajab, yet there are other traditions that suggest other dates.
Al-Zurqani, the famous biographer of the Holy Prophet has referred to five
different views in this respect: Rabi-ul-Awwal, Rabi-u-Thani, Rajab, Ramadan
and Shawwal. Later, while discussing different traditions, he has added a sixth
opinion, that the mi'raj took place in the month of Zulhijjah. Allama Abdulhaq
Muhaddith Dehlawi, the well-known scholar of the Indian subcontinent, has
written a detailed book on the merits of Islamic months. While discussing the
'Lailatul-mi'raj' has mentioned that most of the scholars are of the view that
the event of mi'raj took place in the month of Ramadan or in Rabi-ul-awwal.

 (2) It is also not known in which year the event of Mi'raj took place. The
books of history suggest a wide range between the fifth-year and the twelfth
year after the Holy Prophet was entrusted with prophethood. Now, if it is
assumed that the event of Mi'raj took place in the fifth year of his
prophethood, it will mean that the Holy Prophet remained in this world for
eighteen years after this event. Even if it is presumed that the mi'raj took
place in the twelfth year of his prophethood, his remaining life-time after
this event would be eleven years. Throughout this lo

Does Islam sanction 'honor killing'? Is there any circumstances
where a parent can kill a child under the madhab of Imam Malik?

Question: I have heard in the news that muslims engage in 'honor
killing'. If a woman is raped or is thought to be in a relationship
with a man (who is not her husband), the father or brother will kill
her to perserve the family 'honor'. Does Islam condone this act?

Ustadh Abdullah's response,

As for "honor killings", Islam knows no such thing. As a matter of
fact, culture plays a pivotal role in such acts, and such a concept
is foreign to Islam. What this means is that the parent who kills
his/her child is a sinner, and is subject to suitable punishment for
the crime committed according to the Shariah.

Islam gives the parent more leeway in disciplining one's children for
recalcitrance than it extends to non-parents. This can clearly be
seen when we find Islam punishing the child who kills his/her parents
with the penalty of death while on the other hand it does not punish
the parent with death for the same crime.

This results from the Prophet's statement - may Allah bless and grant
him peace, "The parent (or father) shall not be killed because of his
child." Although most limit this distinguished position to the
father, some also extend it to the child's mother.

Consequently, if it happens that a father goes overboard in the
disciplining of his child, the judgment of Islam is that he will not
be punished for murder if he inadvertently kills him/her. However, he
is still liable for abuse and excess in discipline and the Islamic
judge has the right to punish him accordingly.

The ruling that the parent should not be punished for murdering his
child is accepted by most Schools of Law absolutely. However, the
view of Imam Malik is that this doesn't apply if a man happens to
slit the child's throat. That is, if this is what led in the child's
death, the parent will be killed for the murder of his child.

The reason is that it is clear that death didn't result from a
mistake in excessive discipline. Rather, the act turned into a crime
of passion, since slitting one's throat is usually a sign that the
murderer intends to displace another's soul and cause them excessive
suffering and pain.

Even if there had been the claim that the man's daughter had
apostatized from Islam by departing with her Christian lover and
taking on Western values, it would not be sufficient to justify such
a killing, since the girl would merely be guilty of fornication,
which demands only the hadd punishment of 100 lashes unless she
believed it to be permissible to marry a non-Muslim, something that
clearly contravenes the unanimous consensus of all Muslims. In this
case, she would be a non-believer whose blood is lawful to taken but
only by the established Islamic authority.

Vigilantism is forbidden in Islam. The Prophet (pbuh) has told us
that "There is no harm (done), nor any reciprocation of harm." And
Imam Nawwawi clarifies in his commentary on his 40 Hadith collection
that this means that a person is not to take the law into his own
hands if it happens that someone harms him/her.

Rather, the matter must be refered to one who has the authority to
exact justice for them to avoid the backlash of consecutive and
perpetual acts of retaliation. This can only occur when the matter is
entrusted to a neutral party who both parties involved respect and
fear alike. This neutral party is the government.

Add to that that the person must be allowed time to repent from
his/her wrong doing. This can only be guaranteed by an established
and commonly-acknowledged public order.

And Allah knows best

Allah is the One I ask and for Whose reply I hope: that He is benevolent to

his teaching of goodness wherever he may be and his giving of advice to
everyone he meets. Allah, the Exalted said, informing about al-Maseeh (i.e.,

Top British judge backs Shari`ah

05/07/2008 09:18:00 AM GMT

(img.thesun.co.uk) The Lord Chief Justice said that the Islamic Shari`ah has
been widely misunderstood.

Britain's most senior judge has suggested that Islamic Shari`ah could play a
role in the British legal system.

CAIRO - Britain's most senior judge has suggested that Islamic Shari`ah could
play a role in the British legal system, echoing a similar stance by the
Archbishop of Canterbury Rowan Williams, reported the Guardian on Friday.
"There is no reason why principles of Shari`ah law, or any other religious
code, should not be the basis for mediation or other forms of alternative
dispute resolution," Lord Chief Justice Lord Nicholas Phillips said in a speech
to the London Islamic Council.
"It must be recognized however that any sanctions for a failure to comply with
the agreed terms of the mediation would be drawn from the laws of England and
Wales."
Phillips, the most senior judge in England and Wales, said parties to a dispute
are free to agree to accept Shari`ah principles or other religious precepts if
they decide to seek mediation.
"So far as the law is concerned, those who live in this country are governed by
English and Welsh law and subject to the jurisdiction of English and Welsh
courts."
Under British law, people may devise their own way to settle a dispute in front
of an agreed third party, such as Shari`ah courts and the Jewish Beth Din, as
long as both sides agree to the process.
The rulings of Shari`ah courts, however, are not recognized by the law and thus
Muslims, estimated at nearly 2 million, would have to seek settling their
disputes through civil courts.

Misunderstood
The Lord Chief Justice said that the Islamic Shari`ah has been widely
misunderstood.
"Part of the misconception about Shari`ah law is the belief that Shari`ah is
only about mandating sanctions such as flogging, stoning, the cutting off of
hands or death for those fail to comply with the law.
"In some countries the courts interpret Shari`ah law as calling for severe
physical punishment. There can be no question of such courts sitting in this
country, or such sanctions being applied here."
Archbishop of Canterbury Rowan Williams recently recommended that British law
should recognize some aspects of Shari`ah to resolve Muslim civil matters.
His remarks ignited an extraordinary political and religious storm that still
rages on, with politicians united in denouncing the proposal.
Leading newspapers and tabloids launched vitriolic campaigns against the
spiritual leader of the world's Anglicans, some even calling for his
resignation.
The Lord Chief Justice defended Williams' Shari`ah law comments.
"It was not very radical to advocate embracing Shari`ah law in the context of
family disputes, for example, and our system already goes a long way towards
accommodating the archbishop's suggestion.
"It is possible in this country for those who are entering into a contractual
agreement to agree that the agreement shall be governed by a law other than
English law."
"So a Muslim woman who divorced according to Shari`ah principles would be free
to marry again, but not if she only went to a civil court.
"But as far as aspects of matrimonial law are concerned, there is a limited
precedent for English law to recognize aspects of religious laws, although when
it comes to divorce this can only be effected in accordance with the civil law
of this country."
The Lord Chief Justice's comments drew applause from Muslim leaders.
"Phillips is talking about provisions that are already out there for mediation
and conflict resolution," said Usama Hasan, imam at Al-Tawhid Mosque, Leyton,
and an adviser to the Islamic Shari`ah Council.
"Muslim couples would prefer to have their personal disputes to be settled by a
Shari`ah scholar because such a ruling would affect their status.
"Aspects of Jewish divorce law have long been part of English law and it seems
reasonable for Muslims to have the same treatment, but it can't lead to
inequality or a splintering of British society."

Muslims feel like 'Jews of Europe'
Minister's shock warning on rise of anti-Islamic prejudice
By Cahal Milmo, Chief Reporter
Friday, 4 July 2008, Independent.co.uk
Britain's first Muslim minister has attacked the growing culture of hostility
against Muslims in the United Kingdom, saying that many feel targeted like "the
Jews of Europe".
Shahid Malik, who was appointed as a minister in the Department for
International Development (Dfid) by Gordon Brown last summer, said it has
become legitimate to target Muslims in the media and society at large in a way
that would be unacceptable for any other minority.
Mr Malik made clear that he was not equating the situation with the Holocaust
but warned that many British Muslims now felt like "aliens in their own
country". He said he himself had been the target of a string of racist
incidents, including the firebombing of his family car and an attempt to run
him down at a petrol station.
"I think most people would agree that if you ask Muslims today what do they
feel like, they feel like the Jews of Europe," he said. "I don't mean to equate
that with the Holocaust but in the way that it was legitimate almost – and
still is in some parts – to target Jews, many Muslims would say that we feel
the exact same way.
"Somehow there's a message out there that it's OK to target people as long as
it's Muslims. And you don't have to worry about the facts, and people will turn
a blind eye."
The claims are made in an interview to be broadcast on Monday in a Channel 4
Dispatches programme to coincide with the third anniversary of the London
bombings of 7 July.
A poll to accompany the documentary highlights the growing polarisation of
opinion among Britain's 1.6 million Muslims, who say they have suffered a
marked increase in hostility since the London bombings.
The ICM survey found that 51 per cent of Britons blame Islam to some degree for
the 2005 attacks while more than a quarter of Muslims now believe Islamic
values are not compatible with British values. While 90 per cent of Muslims
said they felt attached to Britain, eight out of 10 said they felt there was
more religious prejudice against their faith since the July bombings.
The Dispatches film, "It Shouldn't Happen to a Muslim", presented by the writer
and broadcaster Peter Oborne, examines claims that negative attitudes to
Muslims have become legitimised by think-tanks and newspaper commentators, who
use language that is now being parroted by the far right.
Mr Malik, who narrowly escaped serious injury when a car was driven at him at a
petrol station in his home town of Burnley in 2002, said he regularly receives
anti-Muslim hate mail at his constituency office in Dewsbury, West Yorkshire,
which has the highest BNP vote in the country and was home to Mohammad Sidique
Khan, the leader of the suicide attackers who killed 52 people in London in
2005.
The MP said the negative portrayal of Muslims in the media, including a story
run by several national newspapers in December last year wrongly stating that
staff in the Dewsbury and District Hospital had been ordered to turn the beds
of Muslim patients towards Mecca five times a day, was a key example of how his
co-religionists were being alienated from the mainstream.
He said: "It's almost as if you don't have to check your facts when it comes to
certain people, and you can just run with those stories. It makes Muslims feel
like aliens in their own country. At a time when we want to engage with
Muslims, actually the opposite happens."
The Dispatches programme also speaks to Andy Hayman, the former Metropolitan
Police Assistant Commissioner who was Britain's most senior anti-terrorism
officer until he resigned last December. Mr Hayman, who was criticised for
failing to tell senior Scotland Yard officers that an innocent man, Jean
Charles de Menezes, had been shot dead after being mistaken for a suicide
bomber, is asked why he thinks it is important to engage with Muslims
expressing extreme views.
Mr Hayman said: "Because we're tackling head on the people that we feel are at
the heartbeat of this whole complex agenda.. Not to have a dialogue with them
would seem that we are apprehensive, we're scared, we're frightened... So even
if it's appeasement in some quarters, that is still a conversation that is not
being had and needs to be had."
Mr Malik's comments were backed by Simon Woolley, a member of the Government's
task force on race equality, and co-founder of Operation Black Vote. He said:
"On an almost daily basis, there is rampant Islamophobia in this country, the
effect of which is not for our Muslim community to get closer to a sense of
Britishness but to feel further away from a feeling of belonging in British

Bismillah [IslamCity] Sharia law 'could have UK role'-Chief Justice Lord Phillips-BBC

2008-07-07 Thread PP A Latheef
Sharia law 'could have UK role'

Lord Chief Justice Lord Phillips said English and Welsh law would still play
a part.

*Principles of sharia law could play a role in some parts of the legal
system, the Lord Chief Justice has said. *

Lord Phillips, the most senior judge in England and Wales, said there was no
reason sharia law's principles could not be used in mediation.

However, he said this would still be subject to the "jurisdiction of the
English and Welsh courts".

Sharia is a set of principles which govern the way many Muslims believe they
should live their life.

The Archbishop of Canterbury prompted controversy when he said use of
certain aspects of the law "seems unavoidable".

*English common law already allows us to go to mediation to whichever
third party we wish*
 Inayat Bunglawala
Muslim Council of Britain

 Q&A: Sharia law explained
In a speech at the East London Muslim Centre in Whitechapel, Lord Phillips
said that sharia suffered from "widespread misunderstanding".

Lord Phillips said: "There is no reason why sharia principles, or any other
religious code, should not be the basis for mediation or other forms of
alternative dispute resolution.

"It must be recognised, however, that any sanctions for a failure to comply
with the agreed terms of mediation would be drawn from the laws of England
and Wales."

Severe physical punishments such as flogging, stoning and the cutting off of
hands would not be acceptable, he said.

He added: "There can be no question of such courts sitting in this country,
or such sanctions being applied here.

"So far as the law is concerned, those who live in this country are governed
by English and Welsh law and subject to the jurisdiction of the English and
Welsh courts."

*'Misunderstood'*

The Archbishop of Canterbury, Dr Rowan Williams, had been misunderstood when
it was reported in February that he said British Muslims could be governed
by sharia law, the judge said.

Dr Williams suggested that sharia could play a role in "aspects of marital
law, the regulation of financial transactions and authorised structures of
mediation and conflict resolution".

Lord Phillips said: "It was not very radical to advocate embracing sharia
law in the context of family disputes, for example, and our system already
goes a long way towards accommodating the archbishop's suggestion.

"It is possible in this country for those who are entering into a
contractual agreement to agree that the agreement shall be governed by a law
other than English law."

Inayat Bunglawala from the Muslim Council of Britain told BBC News that
sharia law applied only to civil matters.

He said: "I think it's important to clarify that English common law already
allows us to go to mediation to whichever third party we wish. "So that is
why you have sharia council, that is why you have Jewish courts. It is a
truly voluntary arrangement.

"There is no parallel legal system. This system cannot override English
common law system at all."
