LL:DDS: RE-ENACTMENT: 80th Anniversary of Ngarrindjeri petition

The 45th Candle Light Walk to be held around Government House Adelaide
in December 2003, will mark the 80th Anniversary of a remarkable
Ngarrindjeri petition to the Governor in December 1923 (see copy retyped
by the Greens SA - below).  This petition was a heartfelt plea from the
Ngarrindjeri mothers from Point McLeay for their stolen children.  This
was not the first time the Ngarrindjeri had drafted and presented a
grievance petition to the Crown authorities.  The first was in 1867 when
the Ngarrindjeri gave the Prince of Wales a memorial which they asked be
presented to Queen Victoria and which is now in the possession of the
English Crown.

However, what is of more note than these Ngarrindjeri pleas is the
obdurate failure of the Crown to have responded to their petitions.

It is a sad indictment on the fair go South Australian way of life
that the Crown has still not heeded the Ngarrindjeri fair call from 1836
for recognition of their human rights to equal treatment as human beings
within the legal system establishing South Australia.

This forthcoming eightieth (80th) anniversary of the unfulfilled
Ngarrindjeri parents' call for recognition and respect for family values
needs to be acknowledged as the enlightened and understandable quest for
equal rights protection from South Australia that it is.

The people of South Australia have a unique opportunity through the
Governor of South Australia, Her Excellency Marjorie Jackson, to now
establish a permanent partnership with the Ngarrindjeri people by
re-enacting this 1923 petition presentation this December.

The Aborigines' Plea

Opposition to New Act

The Aborigines (Training of Children) Act, which was passed last
session, has caused much heartburning amongst the natives, and a
deputation of three of them came to Adelaide from Point Macleay, to
present a petition to his Excellency the Governor, praying for the
repeal of the measure. They will return today.

The Treasurer (Hon. W. Hague), in introducing the Bill to the House of
Assembly on September 20, stated that the attention of the Government
had been directed to the problem of training aboriginal and half-caste
children. It had become patent that the children would have to be taken
in hand while comparatively young. The Bill provided that the Protector
of Aborigines, who would be the guardian of all such children under the
age of 18 years, was empowered to transfer them to the State Children's
Council for training. There would be no obligation for him to make the
transfer if he were satisfied that it would not be to the child's
advantage. No transfer could be made unless the child were over 14
years, or had passed the qualifying examination. In the case of a female
child, the Governor might extend the time of supervision until the age
of 21 years had been attained. The children would be put to a trade, or
otherwise put to work under the supervision of the council. The Bill was
supported by both sides of the House, and was carried on the voices.

Three Ambassadors

Then Point Macleay deputies - Willy Rankine, Leonard Campbell, and John
Stanley - called at The Register office on Thursday, and explained the
aborigines' attitude to the new law. Campbell, the bearer, as he
informed an interviewer, of a Scotch name, is a splendidly built man of
47 summers, and he related with pathos, the fear of the native men and
women that their young ones will be taken from them [original has
'tehm']. We don't mind the Government taking them and training them,
he said. We want them to get on and be useful. But we want to feel that
we still have full rights over them, and that they are our own children.
There are a lot of times when a woman with only one daughter is unable
to get about, and if the girl is taken from her, there is no one left to
help her, and she has to borrow the daughters of other women. We do not
wish to help burden on the State, but our children have never been State

SORRY DAY 2002

On Sunday 26 May, Sorry Day will be commemorated across the country.

Aboriginal communities will remember the children who were removed. Bridge 
walks, barbecues, concerts will take place in cities, towns and rural 
centres as a further step on the Journey of Healing. Former Prime Minister 
Malcolm Fraser, a patron of the Journey, will take part in a press 
conference in Melbourne. The other patron, Doris Pilkington Garimara, 
author of Rabbit-Proof Fence, will lead a forum in Perth. Available for 
comment will be Sorry Day Committee Co-chairs Audrey Ngingali Kinnear (0408 
823 450) and John Brown (0417 209 076). They welcome the growth in 
understanding, in the past year, of the effect of forced removal though the 
feature film Rabbit-Proof Fence and other productions such as last week's 
Blue Heelers, which focused on the role of the police in removing children.

In MELBOURNE at the Aborigines Advancement League, 2 Watt Street, 
Thornbury, a Welcome to Country at 9.45am will be followed by a multi-faith 
service, and at 11.30am a press conference chaired by Dr Lillian Holt of 
Melbourne University. Participants will include former Prime Minister 
Malcolm Fraser, Victorian Minister for Aboriginal Affairs Keith Hamilton, 
musician Kutcha Edwards and Link-Up worker Nicole Cassar. From 1pm a

Other Sorry Day events are taking place around Melbourne - at La Trobe

In CANBERRA over 1,000 people are expected to walk across Commonwealth 
Bridge, starting at midday, arriving in Commonwealth Park for a barbecue 
and concert. Attractions include children's activities, ethnic foods,

Indigenous musicians (including Dale Huddleston and his band) will sing and 
Lowitja O'Donoghue, Tim Costello and ACT Chief Minister Jon Stanhope will

the 15 institutions in Brisbane that held stolen generation children. At

Bridge, through Southbank to Musgrave Park, where a family festival will be

Although there's no explicit provision of the UN Charter providing a 
direct obligation on a State Party to protect civilians during war, 
throughout the Charter there's a consistent abhorrence of armed force as 
anything but a solution of last resort in self-defence or in the common 
interest.

Equally important, a primary aim of the Charter is to establish conditions 
under which justice and respect for the obligations arising from treaties 
and other sources of international law can be maintained (preamble). The 
Geneva Conventions, which do explicitly provide for the protection of 
civilians, are a cornerstone of customary international law 
(notwithstanding very regrettable inconsistencies in their application). 
Accordingly the application of the Geneva Conventions is incumbent by force 
of the UN Charter on member nations.

Moreover, under the International Criminal Court Statute (Rome), not yet in 
force, the Sept 11 crimes certainly fit the legal definition of crime 
against humanity.

In any event it's preposterous that anyone, including a State Party, could 
credibly argue that civilian casualties would be consistent with the spirit 
and aims of the UN Charter.

Therefore, please sign the petition asking the Australian Government to 
ensure the US conducts a just, but peaceful, international response to the 
Sept 11 crimes against humanity, by warning the US Australia will withdraw 
ANZUS support for any US, were it to conduct unlawful retaliatory action 
outside the UN Charter.

approach to resolving this crisis being advocated in the US by a companion

your Australian chance to reject the militarist action of war on 
terrorism unilaterally declared by the US, in which coalition support is 
being treated almost as incidental.

To:  Government of the Commonwealth of Australia

We the undersigned, citizens and residents of Australia, and of countries 
around the world, urge the Australian Government to call on the United 
States Government to use moderation and restraint in responding to the 
recent terrorist attacks against the World Trade Center and the Pentagon, 
and, thereby, to avoid war as a response to the terrorist attacks against 
the USA, and to respect and uphold the responsibilty of the United Nations 
for the maintenance of international peace and security.

We implore all powers to use, wherever possible, international judicial 
institutions and international human rights law to bring to justice those 
responsible for the attacks, rather than the instruments of war, violence 
or destruction.

Furthermore, we assert that the government of a nation must be presumed 
separate and distinct from any terrorist group that may operate within its 
borders, and therefore cannot be held unduly accountable for the latter's 
crimes.

It follows that the government of a particular nation should not be 
condemned for the recent attack without compelling evidence of its 
cooperation and complicity with those individuals who actually committed 
the crimes in question.

Innocent civilians living within any nation that may be found responsible, 
in part or in full, for the crimes recently perpetrated against the United 
States, must not bear any responsibility for the actions of their 
government, and must therefore be guaranteed safety and immunity from any 
military or judicial action taken against the state in which they reside.

Such a course, which both the Australian and United States Governments 
should fully support, is compatible with Article 6 of the ANZUS Treaty 
which states: This Treaty does not affect and shall not be interpreted as 
affecting in any way the rights and obligations of the Parties under the 
Charter of the United Nations or the responsibility of the United Nations 
for the maintenance of international peace and security. (ANZUS Treaty, 
Article 6).

Thus, the treaty clearly asserts the primacy of United Nations Charter 
rights and obligations over the provisions of the treaty, including Article 
5, which Australia has invoked to support the USA.

Subscription by a State Party to the UN Charter asserts thereby certain 
inalienable human rights subscribed for all peoples by the Universal 
Declaration of Human Rights. The USA and Australia are founding State 
Parties to the UN Charter.

Obligations incumbent on State Parties under the UN Charter include the 
obligation to protect civilian populations in the conduct of armed 
conflict, which includes protection from the use of nuclear, chemical or 
biological weapons, or weapons of indiscriminate destruction or mass terror.

These obligations incumbent on State Parties under the Charter of the 
United Nations, and the norms of International Law, are inconsistent

Moving Forward: Reparations for the Stolen Generations Conference

15 and 16 August 2001

A national conference to facilitate public debate about reparations for the 
stolen generations will be held on 15-16 August 2001 at the University of 
New South Wales in Sydney. The conference will be hosted by the Human 
Rights and Equal Opportunity Commission (HREOC), the Aboriginal and Torres 
Strait Islander Commission (ATSIC) and the Public Interest Advocacy Centre 
(PIAC).

During 1995-96, HREOC conducted the National Inquiry into the Separation of 
Aboriginal and Torres Strait Islander Children from Their Families. The 
report of the inquiry, Bringing them Home, was tabled in the Federal 
Parliament in 1997, and illustrated the considerable harm and abuse 
suffered by many Aboriginal and Torres Strait Islander children and 
communities as a consequence of their removal.

Four years later, despite litigation and calls to address the trauma and 
harm caused, there remains a pressing need for reparations for the stolen 
generations. Moving Forward - Achieving reparations for the stolen 
generations, will bring together Indigenous and non-indigenous Australians 
to explore a model for providing reparations to members of the stolen 
generations.

The conference will address topics including

q the inadequacy of government measures to meet the needs of those affected 
by forcible removal;

q international law and models for dealing with reparations for violations 
of human rights;

q the findings of a national consultation project on a reparations tribunal 
proposal, conducted by PIAC, ATSIC and  the National Sorry Day 
Committee

q government and church responses to the history and effects of forcible 
removal;

q the importance of reparations in advancing the process of reconciliation.

The conference hosts are committed to ensuring that members of the stolen 
generations play a central role in shaping the conference outcomes. Members 
of the stolen generations are encouraged to attend the conference and

There is an opportunity to listen to Ngarrindjeri, Arrabunna and Kaurna
Elders speak on issues affecting their people. The microphone remains
open for anyone to offer their thoughts on current issues to sing a song or
to share stories of struggle. Another Candlelit Walk has begun in Perth
every month, and soon other states may follow.


Please feel free to attend.


P.S.  If anyone is interested in other states - please give the
Ngarrindjeri Land and Progress Association (NLPA) an email/
phonecall.There is a hope that we will soon have walks all over
Australia on EVERY first friday...


Don't worry if it will just be a small group of you to start with
