Just received a letter today from some outfit with a Class suit on
some ML (2000-2005) and some R vehicles pertaining to overheating
seats burning holes in seat covers. There's about 20 pages of
legalese. From what little I know about these class cases, they
benefit mostly the lawyers.

Yup, lawyers get cash. We don't.
The problem with class actions is that there are 3 parties to the suit, and
only two of them are represented.
The 3 parties are:
1. the allegedly victimized consumers.
2. the lawyers allegedly working for the consumers.
3. the manufacturer.
Should we be surprised that when parties #2 and #3 get together to discuss a
settlement agreement, they agree to set it up so that #2 gets paid and #1 gets
thrown under the bus while #3 walks away from potential liability?

I got my letter today, and the options are:
1. Do nothing and get the default settlement. When/if your seat heaters fail,
MBZ will pay PART of the cost of the repair. Being part of the class action
eliminates your right to sue MBZ over the seat heaters if your car should catch
fire later.
2. Opt for the seat heater bypass wiring upgrade by January, and MBZ will
install it for free. Selecting this option means MBZ won't pay part of the cost
if your seat heaters die later. Again, you lose your right to sue, because the
class action lawyers already sued on their, I mean, your behalf.
3. Opt out of the suit, and it's as if the class action never happened. You
don't get squat from MBZ unless you sue them.
4. Object to the settlement and hope the judge is on your side and not the side
of the two parties that negotiated the settlement.

Basically, it's a means for class action law firms to get a bunch of money in
exchange for MBZ getting rid of liability for the seat heaters, but if you
demand it, MBZ will rewire your seat heaters in exchange for getting rid of the
liability for the seat heaters. I suppose if you take the fix and it catches
fire later, you can start a new class action over the "dangerous fix" they
applied to your car.

Mitch.

Just received a letter today from some outfit with a Class suit on
some ML (2000-2005) and some R vehicles pertaining to overheating
seats burning holes in seat covers. There's about 20 pages of
legalese. From what little I know about these class cases, they
benefit mostly the lawyers.
