Romanian church in Malainita, Serbia View Current Signatures - Sign the Petition To: International romanian community and friends Dear Madam/Dear Sir, We appeal to you in order to draw your attention regarding the situation of a church built in Malainitsa (northeastern Serbia) by the local Romanian community. On January 21, the mayor of the locality submitted an official letter to the curate of the church, ordering him to destroy the belfry until January 28 and to proceed with the demolition of the church within 15 days. This order of the mayoralty is based on the pretense that the churchs construction was not approved by the local authorities. The fact is that no building in the village Malainitsa was ever constructed following such a procedure. The Romanian church is the first case when the authorities demand the completion of an approval procedure. Given the situation, this is clearly an unreasonable requirement directed in fact at preventing the Romanian minority to develop its own religious life. The church is built on a private property and no property issues are involved in the matter. The general framework regarding Romanians in Serbia is confusing. They live compactly in two areas of Serbia. The group in northwest (Vojvodina) is officially recognized as a national minority and is therefore granted all the specific rights of a national minority. The group in northeastern Serbia (the Tymok Region), is officially ignored and, in consequence, no language, education or cultural rights are available for them. The intention of the local authorities to proceed with the demolition of the church is wrong, immoral and ultimately illegal. Although the Romanians in Malainitsa might have broken some formal legal provisions concerning the need for an approval, such a requirement for them is unreasonable because nobody in the village was ever demanded to obtain such an approval for a private building, as it is usually the case in the countryside. Setting up unreasonable requirements for a minority group in comparison with the usual requested for the majority is a violation of the spirit of the international legislation regarding the protection of national minorities. In the particular case of the church in Malainitsa, the Serb authorities are clearly in breach of the following provisions of the Council of Europes Framework Convention for National Minorities: - article 4, regarding the promotion in all areas of social and cultural life of a full and effective equality between persons belonging to a national minority and those belonging to the majority - article 5, regarding the obligation of the state to promote the conditions necessary for persons belonging to national minorities to maintain and develop their culture, and to preserve the essential elements of their identity, namely their religion, language, traditions and cultural heritage - article 8, regarding the obligation of the state to recognize that every person belonging to a national minority has the right to manifest his or her religion or belief and to establish religious institutions, organizations and associations. Sfintit la iuteala de un sobor de preoti, recordul a fost consemnat apoi intr-un proces-verbal ad-hoc, autentificat de un notar, si care urmeaza, vezi Doamne, a fi trimis la Londra oficialilor Guinness Book, pentru omologare! Odata maimutareala ispravita, multimea rebegita de frig a dat navala sa apuce o friptura si un pahar de vin fiert, savurate apoi cu ochii pe cer, la focul de artificii - atractia finala a unei seri incheiate tragic, cu moarte de om. Vrem sa stabilim exact ce s-a intamplat acolo, ne-au declarat surse din Ministerul Agriculturii. In Romania exista 18 crescatorii si complexuri de vanatoare. Pentru partidele de vanatoare organizate in aceste perimetre nu este nevoie de autorizatii de vanatoare. La sfarsitul saptamanii trecute, omul de afaceri Ion Tiriac a organizat pe domeniul sau de vanatoare de la Balc, judetul Bihor, o partida de vanatoare la care au luat parte, pe langa oameni politici romani - fostul premier Adrian Nastase si ex-ministrul Agriculturii, Ilie Sarbu - si o serie de oameni de afaceri de pe trei continente. Seful Directiei Cinegetice din Garda de Mediu, Marius Barbulescu, ne-a declarat ca ancheta are la baza informatiile aparute în presa. Am primit diverse date. Acum am auzit ca vînatoarea nu ar fi avut loc pe fondul de vînatoare, ci într-un tarc. Trebuie sa verificam, abia dupa aceea ne vom pronunta, ne-a spus directorul Barbulescu. Adrian Tibau, seful Biroului de presa de la Ministerul Agriculturii, Padurilor si Dezvoltarii Rurale (MAPDR), ne-a declarat ca a început o ancheta privind atribuirea Fondului de vînatoare de la Balc de catre ex-ministrul Ilie Sîrbu. Tiriac a primit 12.000 de hectare pentru 49 de ani, cu o taxa de 9,3 de milioane de lei, fara a participa la licitatie, asa cum prevede legea. Ordinul a fost emis de fostul ministru Sîrbu, participant si el în weekend la carnagiul de la Balc. Ministerul pregateste un comunicat legat si de vînatoarea condamnata de asociatiile pentru protectia animalelor. Precizam ca seful Biroului de Vînatoare al MAPDR, Ilie Manolache, ne-a declarat în exclusivate ca a fost depasita de sase ori cota alocata domeniului Balc. Acest fapt constituie infractiune si este prevazut în Codul penal. Reamintim ca Tiriac avea voie sa vîneze pe fondul sau 30 de mistreti, iar grupul sau, în frunte cu Adrian Nastase, a împuscat 185. Avocatul lui Tiriac revine asupra declaratiilor Nicolae Mîndrila, avocatul magnatului Ion Tiriac, ne-a precizat luni ca vînatoare nu a avut loc în tarc. Pai, ce fel de vînatori sînt cei care omoara animalele astfel?!?. Ieri, aparatorul familiei ne-a declarat ca, de fapt, partida a avut loc într-un loc împrejmuit. Depinde ce întelege fiecare prin tarc. Subliniez ca vînatoarea nu a avut loc în partea de padure în care sînt hranite animalele. Pe scurt, avocatul vrea sa-si scape clientul de infractiunea privind depasirea cotei de vînat alocate de minister. Ideea nu este rea, pentru ca uciderea animalelor în captivitatea este pedepsita de Legea nr. 205, privind protectia acestora, doar cu maximum 20 de milioane de lei. Articolul de lege spune: Se întelege prin cruzime omorîrea animalelor din perversitate. Daca Mîndrila va dovedi ca 12.000 de hectare reprezinta un tarc, atunci îsi va scapa clientii de la o amenda de maximum 150 de milioane de lei sau de la închisoare de la 1 la 2 ani. Forumul Civic Român someaza MAPDR Asociatiile membre ale Forumului Civic Român solicita MAPDR raspunsuri la o serie de întrebari legate de macelul de la Balc. În primul rînd, se cere pozitia oficiala a ministrului Gheorghe Flutur, pornind de la atribuirea fondului de vînatoare si terminînd cu identitatea membrilor si a participantilor la vînatoare.
