[QUAD-L] Finland forum ..a moron there.
Hey freinds..dunno if you remember a post i made awhile back about flying to Finland to be with my girlfriend and get married. I need to get a residence permit in order to stay there more than 90 days. She has 3 kids and it wouldnt be right to take them from their dad and his side of the family ..plus theycant speak english so her coming here isnt really an option at this point. She was here for a couple of weeks over the 4th of july ..loves America but ..we just cant live here until the kids grow up a bit and choose to live with dad or come with mom here. Anyway ..we decided to go to a forum and get advice on the best way to get a residence permit for me to live in Finland and you will not believe the first reply i got . This moron thinks if youre in a wheelchair your useless .. plain and simple ..dont come here cripple and leech off me!I couldnt believe my eyes ..he has no idea who i am . Yet because i mentioned the chair ..i'm a useless leech! I argued a bit with him and my g/f asked me to stop because it was upsetting her. So ..i did and i'm about to explode. He's still spewing his ignorant views even though others in the forum have told him what a rude ass he's being . I thought some of you might be interested in seeing the height of narrow minded views of the handicap and the use of the word cripple ..he's probably anti American too. Anyway ..go have a look if you want ..feel free to let him know a few things as i was told to stop way before i was done. RE: [QUAD-L] Court: disability laws protect those unable to have sex
wow that prints really small ..hmm size does matter.. ..this is weird..all i know is sex is way more than just intercourse..Darel- http://www.myspace.com/spacetripper Date: Wed, 23 Jul 2008 03:20:24 -0700From: [EMAIL PROTECTED]: quad-list@eskimo.com; [EMAIL PROTECTED]: [QUAD-L] Court: disability laws protect those unable to have sex http://www.chron.com/disp/story.mpl/nation/5902097.html Court: disability laws protect those unable to have sex Mcclatchy-tribune WASHINGTON — A South Carolina breast-cancer survivor has beaten the State Department and convinced judges in Washington that the inability to have sex is a disability protected under federal anti-discrimination laws. The new appellate-court ruling gives Piedmont, S.C., resident Kathy E. Adams another potential shot at serving overseas. More broadly, the ruling cracks open the courtroom door for additional legal challenges by those who are sexually incapacitated. 'I think it's a major victory for former cancer patients, and for anyone who has had their sex life disrupted,' Adams' attorney, David H. Shapiro, said Tuesday. Adams wants to compel the State Department to hire her as a foreign service officer and provide back pay. She'll now go before a jury and trial judge, unless the State Department relents first. In its 2-1 decision, issued Friday, the U.S. Court of Appeals for the District of Columbia Circuit ruled that Adams has a case against the State Department. Most significantly, the D.C. circuit court ruled for its first time that laws that protect people with disabilities from discrimination cover 'sexual relations.' The ruling overturns a trial judge who'd dismissed Adams' case. 'At the risk of stating the obvious, sex is unquestionably a significant human activity, one our species has been engaging in at least since the biblical injunction to 'be fruitful and multiply,' ' appellate Judge David Tatel wrote. Tatel concluded that sex is the kind of 'major life activity' that Congress considered when it passed the Rehabilitation Act in 1973. The law, like the better-known Americans with Disabilities Act, prohibits discrimination against people with disabilities. Lawmakers defined a disability as an impairment that 'substantially limits' a major life activity. Courts still struggle to explain what that means. Last week, for instance, the D.C. appellate court determined that 'sleeping' is a protected major life activity. Walking, seeing and hearing, among many other activities, likewise have been identified as 'major.' The new ruling comes from what's sometimes called the nation's second-highest court, meaning that many lawyers will be parsing its words. 'As a basic physiological act practiced regularly by a vast portion of the population, a cornerstone of family and marital life, a conduit to emotional and spiritual fulfillment, and a crucial element in intimate relationships, sex easily qualifies as a major life activity,' Tatel wrote. A State Department spokeswoman said the department was still reviewing the decision. Adams couldn't be reached for comment Tuesday. The Russian-speaking Adams aced the State Department's Foreign Service written and oral exams in 2002, ranking seventh out of 200 candidates. Living about 15 miles south of Greenville, she was in line to start training in January 2004. Before her training started, doctors diagnosed her with breast cancer. She underwent surgery, but the State Department subsequently denied her entry into the Foreign Service. 'The department could not guarantee (her) access to the required medical follow-up and surveillance at all overseas assignments,' a State Department nurse testified. State Department officials added, and the dissenting appellate judge agreed, that the department didn't know about Adams' sexual disability when it declined to hire her. The court majority, however, reasoned that 'it makes no difference whether an employer has precise knowledge of an employee's substantial limitation' so long as the employer knows about the impairment. In this case, the State Department knew about Adams' breast cancer but didn't know how the cancer treatments impaired her sex life. Adams underwent a mastectomy, had her ovaries and fallopian tubes removed, gained weight and felt her libido wither. 'I now find that the prospect of dating and developing an intimate relationship is just too painful and frightening,' Adams, who is single, stated in a declaration. _ Stay in touch when you're away with Windows Live Messenger. http://www.windowslive.com/messenger/overview.html?ocid=TXT_TAGLM_WL_messenger2_072008
RE: [QUAD-L] Finland forum ..a moron there.
Well youre right..and i'm not disputing that..i probably should have asked the question differently but i was being direct ..something the finns appreciate . It wasn't so much as what he said but how he said it ..and his views are not shared by most others in that forum. I also retract that last thing i said in my post here ..i mainly just am interested in getting the opinions of other disabled people on this. Not really asking you to join my fight ...but i wont discourage it either if someone wants to voice something . The man totaly judged me as useless at the mere mention of a chair. and yes ..i'm appalled. It isnt the views of all finns . I really dont want to go there ..i love my country and dont care to leave it . It's been very good to me . But this is a matter of the heart ...and well ..i'm going for that reason alone. I dont think i blame him for not wanting people to come in and leech his tax euro's..we have that unpleasant problem here. I do have a problem with how he can think thats my sole intention just because i'm in a chair. But thanks man .. We American have a way of telling other countries how to lead their lives, government and establish their laws. Maybe that is why we are often considered Ugly Americans as we travel abroad. When you leave the protection of American soil, you also lose the protection of the Americans With Disabilities, along with many other laws of our country. It is also pretty common with the human population that what we don't understand, we fear. And that which we fear, we reject. I personally don't know the person in Finland who has chosen to respond to your posted question in a Finland newspaper. Actually, I don't know you that well, with all due respect. I do know that long before July of 1992 there were many people in this country that felt the same way and would have responded to your posting in an American Newspaper in like fashion. That is purely... human nature. Granted, its not very nice, but very human. For me personally, I choose my battles here in the USA. I'm not going to go abroad and tell those in another country that I wish to enter their country and live as I did in Good Ole USA. To some personalities, it is considered baiting and you will received some emotional responses as you have witness. Could you possible imagine someone in South America, in a wheelchair, posting in an American Newspaper inquiring about Quick Entry into the United States. I would imagine the very same kind of response as you witnessed in Finland. I wish for you the very best and much success in your endeavor to live in Finland. But I won't hop the International Band Wagon and challenge those in other country about their laws and practices. I sincerely hope that you and your new spouse will do well and that you will find a rewarding occupation while a member of the Finland Population. But getting involved in your argument... no thanks.
