My understanding is that the VFW chapter that was party to the contract is now defunct. The state VFW is claiming rights as a successor in interest, but that claim is disputed and have not yet been adjudicated. Doesn't the VFW of California have rights pursuant to the contract that the Ninth Circuit invalidated (for purchase of the land on which the cross sits)?
