  L'essentiel 
 
Des décisions notables ont été rendues ces derniers mois en contentieux 
administratif.
 
Le tribunal des conflits a rappelé les critères traditionnels de répartition 
des compétences entre faute de service d’un agent et faute personnelle, 
celle-ci devant rester absolument exceptionnelle (I).
 
Du nouveau aussi en matière de « délai raisonnable » : la jurisprudence Cazbaj 
est conforme à l’article 6 § 1 de la Convention européenne des droits de 
l’homme, mais ne peut être appliquée aux instances en cours (II.1). Et ce délai 
raisonnable est susceptible d’interruption, le Conseil d’Etat en ayant défini 
de nouvelles causes (II.2). Le Conseil d’Etat oscille par ailleurs entre 
souplesse et rigueur dans la formation des recours. Il reste très souple quant 
à l’exigence de production de la décision attaquée, lors de l’introduction de 
l’instance (II.4). Mais il a estimé qu’un recours prématuré, pourtant censément 
susceptible de régularisation, pouvait être rejeté par simple ordonnance 
présidentielle (II. 5). Il a néanmoins réaffirmé qu’un pourvoi formé sans 
ministère d’avocat aux Conseils ne pouvait être rejeté sans invitation à 
régulariser présentée à la partie elle-même (II.6).
 
Le Conseil d’Etat a également apporté des précisions en matière de médiation 
(III).
 
Du nouveau, enfin, en matière de pouvoir d’injonction accordé au juge 
administratif, en action de groupe et REP : il peut l’exercer, mais dans le 
respect de la séparation des pouvoirs (IV).



  I – Séparation des pouvoirs : faute personnelle et faute de service



  T. confl., 4 décembre 2023, n° 4296, Centre d’activités sociales, 
familiales et culturelles
 
Le tribunal des conflits rappelle par cet arrêt un  principe bien connu depuis 
la jurisprudence Pelletier (T. confl., 30 juillet 1873, Pelletier, GAJA n° 2), 
en matière de responsabilité des agents : aux juridictions administratives la 
compétence en matière de faute de service et aux juridictions de l’ordre 
judiciaire de connaître des conséquences d’une faute personnelle.
 
Traditionnellement, la faute personnelle reste exceptionnelle, étant rappelé 
que la voie de fait (T. confl., 8 avril 1935, Rec. CE, p.  1226, Action 
française) et l’infraction pénale (T. confl., 14 janvier 1935, Rec. CE, p.  
224, Thepaz) n’entraînent pas forcément cette qualification. Mais il est 
toujours difficile de tracer la frontière.
 
Le tribunal des conflits rappelle la ligne directrice (la faute personnelle est 
exceptionnelle) et l’exclut en l’espèce, en s’appuyant à la fois sur un critère 
objectif et un critère subjectif : pas de faute personnelle,  car les agents 
publics et l’administrateur mis en cause avaient agi uniquement « dans 
l’exercice de leurs fonctions, avec les moyens du service [élément objectif] et 
sans être animés par aucun intérêt personnel [élément subjectif] ».
 
Un rappel donc des principes traditionnels en la matière.



  II – L’instance



  1 – Délai raisonnable : conformité à l’article 6 § 1 de la Convention 
européenne des droits de l’homme

Par décision d’assembl
