Green Effect—a proposed film about a large-scale, cataclysmic

In the wake of Peter Jackson's rift with the studio, the "Spidey" 
director may be next in line to take over fhe franchise.

In a move that would have ramifications for several major 
multi-nationals, and millions of fans, "Spider-Man" maestro Sam Raimi 
has been telling associates, as well as his corporate masters at Sony, 
that he is thinking of directing "The Hobbit," the prequel to J.R.R. 
Tolkien's masterwork, "The Lord of the Rings." At least two top-level 
insiders – who declined to be named -- have heard the words out of the 
director's mouth.

A year ago, such a swap of franchises would have been unthinkable, given 
that Peter Jackson co-wrote and directed the Oscar-winning "Rings" 
trilogy, but that was before the slugfest erupted between the 
once-rotund director and New Line honcho Bob Shaye.

Jackson is suing the studio over money he says is owed to him from the 
the "Rings" films, which grossed more than $3 billion at the box office 
and another $1 billion on DVD. In the last few weeks, Shaye has declared 
Jackson persona-non-grata at New Line, stating publicly that, "He will 
never make any movie with New Line Cinema again while I'm still working 
at the company."

According to a New Line source, the studio isn't just contemplating one 
"Hobbit" movie, but two. The prequel tells the story of hobbit Bilbo 
Baggins and how he first discovers the magical but sinister ring, the 
very object that drives the action in "Lord of the Rings."

Still, while Raimi might be an irresistable replacement for Jackson, his 
ascension to the directing chair is far from a sure thing. New Line says 
it doesn't have a deal with the director, and Raimi hasn't met with 
Shaye or production president Toby Emmerich. More potentially 
problematic is the fact that MGM owns the distribution rights to the 
film. An MGM spokeman insists that MGM remains firmly in the Jackson 
camp: "We support Peter Jackson, and when the dust settles, we believe 
he is the one who will be making this movie."

A call to Raimi's office was directed to his agent, Richard Lovett, at 
CAA. The agency did not comment.

For Sony, losing Raimi – who gave "Spider-Man" its distinctive visual 
theatrics – would be a blow. Studio chief Amy Pascal has said she wants 
to make six installments of the "Spider-Man" tale. Just this week, the 
studio announced it was rehiring David Koepp, who wrote the first film, 
to write "Spider-Man 4."

McAdams is not a bad actress. Hopefully the Dawes character will be written to 
be a little stronger in this film. I find the notes here funny, the supposed 
desire for an "Elizabeth Pena" type Latina cop. Well, hell--get Elizabeth Pena! 
Is the age *that* frickin' important!

Oh--the author here is nuts in saying the other actors in "Batman Begins" are 
responsible for making Katie Holmes' performance look bad. That was a 
combination of an underwritten role, and her own underwhelming screen presence.

y’all that Katie Holmes would not return -- it just wasn’t clear whether 
or not the “Rachel Dawes” character was gone too.

LR also says that there are roles for: "Eastern European Heavy - tough 
bad guy mobster, 40s-50s, Female Cop - Latin, 30s. 'Elizabeth Pena' 
type, and an Asian Accountant - male, 40s." Latin female cop? Rene

Nolan-directed sequel to 'Batman Begins.' Christian Bale, Michael Caine 
and Gary Oldman are locked for returns, and Heath Ledger is set to play 
the Joker in the pic, which begins shooting this spring."

The now confirms what BOF reported weeks ago: Katie Holmes would not be 
back. Now, if she dropped out, is the role being recast as reported by 
LATINO REVIEW? The scuttlebutt is that Rachel McAdams is set to take 
over the role. Now, I have heard McAdam's name mentioned in conjunction 
with TDK. We'll soon see if she is the "New Rachel" or not I guess.

SEMI-EDITORIAL: All you Katie Holmes fans can stop with the emails, OK? 
Yes, I did say that she was the weak link of the cast in BATMAN BEGINS. 
But I also said that was more due to the other actors and not her 
performance. I also said that I was all for Katie and the “Rachel Dawes” 
character returning -- as long as she served an important role in THE 
DARK KNIGHT. Frankly, I’ve yet to see why “Rachel” should return -- and

I liked Surface. However, the lesson I hope the producers of Surface and 
Invasion learn is that they do not have time to build suspense slowly.  
They have to hit you in the first episode like Heroes, Eureka and dare i 
say it?  Lost. 

Heroes and Lost had every body's minds spinning and offices buzzing the 
next day.  Surface did not start really moving until the last 4 or 5 
episodes.   They needed that type of action in the first episode to keep 
the short attentions of American audiences

Loved Now and Again.  I don't think that it ever had a chance.

To start, even though she is a fictional person, I'm sure she wouldn't 
appreciate being hated on so. And you might have a point there. In the 
beginning, I thought that she was merely playing both ends against the middle 
in earch of the story, like any reporter would. Now, she seems to have ripped a 
page out of the Rupert Murdoch School of Journalistic Integrity (an oxymoron so 
powerful that black holes pale in comparison).

kidnapped and murdered a 2-year-old girl and her mother, stuffed them in a 
trunk and set the car on fire. But only 10 of the 12 jurors voted to give 
Harris the death penalty, so his life was spared.
Some Georgia legislators are hoping to change state law so people like Harris 
could be condemned to death even
if only nine jurors agree on the sentence — doing away with the unanimous jury 
requirement in death penalty cases.
House Majority Whip Barry Fleming (R-Harlem) cites the Harris case in 
introducing House Bill 185.
The bill, which was filed Friday, would give judges the discretion to impose 
the death sentence on nonunanimous jury verdicts in which at least nine jurors 
voted for execution.
That means verdicts of 9-3, 10-2 and 11-1 could lead to a death sentence. HB 
185 does not change the requirement of a unanimous jury needed for conviction.
Prosecutors say the change will help them secure death penalty verdicts, which 
are increasingly difficult to get as questions mount over the imposition of 
capital punishment in the United States.
Defense lawyers say such a change would put Georgia in a category of only a
few states that allow elected judges to impose a death penalty without a 
unanimous verdict.
Fleming said prosecutors, including the district attorney in Augusta near his 
hometown, sought the bill.
He said that during jury selection some people will say they can impose the 
death penalty if necessary, but later refuse to do so on moral grounds.
"People morally opposed to the death penalty obviously aren't opposed to 
fibbing," Fleming said Monday.
Other key lawmakers, including House Majority Leader Jerry Keen (R-St. Simons 
Island), have signed on to the bill.
Gwinnett County District Attorney Danny Porter cheered HB 185. His office tried 
the Harris case.
"One juror said she could not vote to put another black man on death row and 
that was the end of that case," Porter said of the case.
In interviews following the Harris verdict, one juror backed up Porter's 
assertion that the holdout was based on race, although other jurors said they 
weren't sure why the black woman held out. The other holdout was Asian.
Harris was sentenced to life in prison without parole.
Porter said he thinks in death penalty trials defense attorneys try to pick 
jurors based on race and gender who are less likely to impose capital 
punishment.
Veteran death penalty attorney Jack Martin dismissed such claims by prosecutors 
as "urban myth." Martin did not represent Harris.
Martin said there can be many reasons why jurors don't impose the death 
sentence: They might find something redeeming about the defendant; there might 
be a lingering question of guilt; there might be a mental illness that could 
help explain the crime.
"Before you impose the ultimate sentence, there needs to be a consensus of the 
community — not a majority," said Martin. Majority verdicts could allow 
minorities, particularly African-Americans, to be ignored during jury 
deliberations, he said."It would be venturing into uncharted waters under the 
U.S. and the Georgia Constitution," Martin said.
Stephen Bright, a senior lawyer at the Atlanta-based Southern Center for Human 
Rights and a nationally recognized expert on death penalty law, said the bill 
represents a "marked" departure from current law.
Juries in Alabama and Florida currently make only a recommendation on the death 
penalty, and the decision is ultimately up to the judge.
In those states, the jury recommendation does not have to be unanimous.
Bright said leaving the decision to elected judges in nonunanimous verdicts, as 
proposed in HB 185, is particularly troublesome.
In other states, he said, judges have been more likely to choose the death 
penalty if there's an election coming up.
"There are political considerations that are going to come into play that don't 
come into play when you have a largely anonymous jury ... and no one person is 
the lightning rod for the decision," Bright said.

Amen. It's why, whenever I let myself argue the future of Iraq and such with 
people, I always cast that blame where it's due. Usually I get that mighty 
mature attitude "What's done is done. Let's quit focusing on the past and work 
to change the future".  That's often teh position of someone who's screwed up 
royally and doesn't want to dwell on it. I think we must continue to remind 
those who supported Bush what they've done to us and the world. I think that, 
in the midst of a planning session to discuss how to save Iraq, someone should 
always say "Of course, if you hadn't gone in without justification, we wouldn't 
be in this mess".

Like the Sankofa bird that looks back even as it moves forward, we can't ever 
forget this one--lest we repeat it the next time fear and xenophobia run 
rampant in America.

[scifinoir2] OT: Positive Changes in Hollywood?

Well, I know most of you (me included, for the most part) don't get into the 
awards show thing. But I will say, a few things are coming out of the mix that 
are pretty cool:
Maybe now Eddie Murphy's got a chance to do something besides endless Dr. 
Doolittle/Norbit-type movies for the rest of his life. Not sure he deserves an 
Oscar, but he was great
Jennifer Hudson almost--almost--makes me think "American Idol" actually 
features people with talent. Of course, she was eliminated from the contest...
Maybe Hudson's rising star will cause the studio to recut the "Dreamgirls" 
trailers that erroneously make you think Beyonce Knowles is the star...
Forest Whitaker is *finally* getting recognition after years of quality work.
Hollywood keeps creeping ever slowly toward giving Black actors more respect, 
as evidenced by the number nominated for--and winning--awards.
The surviving cast of "The Mary Tyler Moore Show" were all trotted out on stage 
together at the SAG Awards. How cool is that??
Best of all, some actresses' successes are helping in a small way dispel the 
obsession with skinny blondes in the entertainment industry. People like 
Hudson, and "Ugly Betty" star America Ferrara, who's said in the past,  "...To 
me, the tragedy about this whole image-obsessed society is that young girls get 
so caught up in just achieving that they forget to realize that they have so 
much more to offer the world."..."I think it's hilarious when people call 
Jessica Alba or Eva Longoria curvy. Come on. They're not curvy. They're small. 
I'm curvy."
Love Ferrara's comment on what Hollywood calls a curvy woman. I agree!  Maybe 
actresses like this can help re-establish young girls' self-image. Of course, 
it can be argued it was Hollywood and Madison Avenue that destroyed it in the 
first place...

The first felony convictions of two Cleveland poll workers stemming
from Ohio's stolen 2004 election confirm that the official recount
in that contested vote was, in the words of county prosecutors,
*"rigged."* The question now is whether further prosecutions will
reach higher up in the ranks of officials who may have been involved
in illegalities throughout the rest of the state.

The convictions have come down in Cuyahoga County, where Democratic
candidates traditionally run up huge majorities. Suspicious vote
counts and other irregularities cut deeply into John Kerry's margins
in 2004. Official vote counts gave the state---and thus the
presidency---to George W. Bush by about 118,000 votes out of 5.5
million counted.

A statewide recount, paid for by the Green and Libertarian Parties,
was marred in *87 of the state's 88 counties by the types of
illegalities that led to this week's convictions. Only in Coshocton
County was a full, manual recount performed.

Throughout the rest of the state, under the direction of Republican
Secretary of State J. Kenneth Blackwell, mandatory *random sampling*
was not done, as prescribed by law. Instead, poll workers illegally
chose sample precincts for recounting where they knew there would be
no problems, and then routinely recounted the rest of the ballots by
machine, rendering the *recount meaningless*.

Blackwell simultaneously served as state co-chair of the Bush-Cheney
campaign. This fall he was defeated in his campaign for governor by
Democrat Ted Strickland.

County Prosecutor Kevin Baxter opened the Cuyahoga trial by charging
that "the evidence will show that this recount was rigged, maybe not
for political reasons, but rigged nonetheless." Baxter said three
election workers "did this so they could spend a da y rath er than
weeks or months" on the recount. "This was a very hush operation."

Jacqueline Maiden, the county election board's third-ranking
employee, and Kathleen Dreamer, an assistant manager, have each been
convicted of a felony count of negligent misconduct and a
misdemeanor count of failing to perform their duties. Rosie Grier,
the board's ballot department manager, was acquitted on all seven
counts raised against the three. Sentencing is scheduled for late
February. Defense attorneys have indicated they will appeal. The
felony conviction carries a possible sentence of six to 18 months.

The county prosecutors have not yet alleged vote fraud. No do they
say mishandling the recount affected the election's outcome.
Dreamer's defense attorney, Roger Synenberg, said the defendants
"were just doing [the recount] the way they were always doing it."

But Cuyahoga's precinct-by-precinct vote counts and turnout numbers
varied wildly and improbably. Several predom inantl y black
precincts showed turnouts of less than 30% in a county where overall
turnout was around 60%. One ward showed a 7% turnout as compared to
surrounding precincts with turnouts nearly ten times as high.

Further prosecutions may now hinge on what Maiden and Dreamer might
tell prosecutors about the role played by higher-ups. The assumption
is widespread that the decision to consciously designate test
precincts, rather than choose them at random, must have been at
least tacitly approved by Secretary of State Blackwell.

In Cleveland, Robert Bennett, chair of the state's Republican Party,
also served as chair of the Cuyahoga County Board of Elections.
Cuyahoga BOE Executive Director Michael Vu was chosen by the county
Democratic Party. Under Vu's direction, the county's elections have
been rife with chaos, irregularities and apparent fraud. When the
Democrats recently tried to remove him from his post, *Vu was
supported by Bennett and the Republican Part y. He kept his job when
Blackwell strategically abstained from a key removal vote.

There is growing evidence that what happened in Cleveland was the
rule, rather than the exception, in Ohio's 2004 presidential
recount. Sworn testimony at a public hearing in Toledo indicates
Diebold technicians were involved in picking "random" precincts to
be recounted there. A memory card was apparently lacking from at
least one optiscan machines.

Miami County election officials admit they merely ran the optiscan
ballots through the ES 550 counter, rather than doing the prescribed
random recounts. Free Press reporters have found recount results
varied signficantly from official results, which should have
triggered a hand recount of all the ballots in the county. This was
never done in Miami

first season.

We were just discussing the two brothers here in Atlanta who pleaded guilty 
to killing a dog and other charges. I mentioned the frightening side-effect 
that a Republican state congressman wants to change the law so that an 11-1 
verdict is all that's needed to convict in a felony case.  Well, check the 
following. This comes up every couple of years here in Georgia, and chills 
me in more ways than i can count.

A Gwinnett County jury in 2005 unanimously concluded that Wesley Harris 
kidnapped and murdered a 2-year-old girl and her mother, stuffed them in a 
trunk and set the car on fire. But only 10 of the 12 jurors voted to give 
Harris the death penalty, so his life was spared.
Some Georgia legislators are hoping to change state law so people like 
Harris could be condemned to death even
if only nine jurors agree on the sentence — doing away with the unanimous 
jury requirement in death penalty cases.
House Majority Whip Barry Fleming (R-Harlem) cites the Harris case in 
introducing House Bill 185.
The bill, which was filed Friday, would give judges the discretion to impose 
the death sentence on nonunanimous jury verdicts in which at least nine 
jurors voted for execution.
That means verdicts of 9-3, 10-2 and 11-1 could lead to a death sentence. HB 
185 does not change the requirement of a unanimous jury needed for 
conviction.
Prosecutors say the change will help them secure death penalty verdicts, 
which are increasingly difficult to get as questions mount over the 
imposition of capital punishment in the United States.
Defense lawyers say such a change would put Georgia in a category of only a
few states that allow elected judges to impose a death penalty without a 
unanimous verdict.
Fleming said prosecutors, including the district attorney in Augusta near 
his hometown, sought the bill.
He said that during jury selection some people will say they can impose the 
death penalty if necessary, but later refuse to do so on moral grounds.
"People morally opposed to the death penalty obviously aren't opposed to 
fibbing," Fleming said Monday.
Other key lawmakers, including House Majority Leader Jerry Keen (R-St. 
Simons Island), have signed on to the bill.
Gwinnett County District Attorney Danny Porter cheered HB 185. His office 
tried the Harris case.
"One juror said she could not vote to put another black man on death row and 
that was the end of that case," Porter said of the case.
In interviews following the Harris verdict, one juror backed up Porter's 
assertion that the holdout was based on race, although other jurors said 
they weren't sure why the black woman held out. The other holdout was Asian.
Harris was sentenced to life in prison without parole.
Porter said he thinks in death penalty trials defense attorneys try to pick 
jurors based on race and gender who are less likely to impose capital 
punishment.
Veteran death penalty attorney Jack Martin dismissed such claims by 
prosecutors as "urban myth." Martin did not represent Harris.
Martin said there can be many reasons why jurors don't impose the death 
sentence: They might find something redeeming about the defendant; there 
might be a lingering question of guilt; there might be a mental illness that 
could help explain the crime.
"Before you impose the ultimate sentence, there needs to be a consensus of 
the community — not a majority," said Martin. Majority verdicts could allow 
minorities, particularly African-Americans, to be ignored during jury 
deliberations, he said."It would be venturing into uncharted waters under 
the U.S. and the Georgia Constitution," Martin said.
Stephen Bright, a senior lawyer at the Atlanta-based Southern Center for 
Human Rights and a nationally recognized expert on death penalty law, said 
the bill represents a "marked" departure from current law.
Juries in Alabama and Florida currently make only a recommendation on the 
death penalty, and the decision is ultimately up to the judge.
In those states, the jury recommendation does not have to be unanimous.
Bright said leaving the decision to elected judges in nonunanimous verdicts, 
as proposed in HB 185, is particularly troublesome.
In other states, he said, judges have been more likely to choose the death 
penalty if there's an election coming up.
"There are political considerations that are going to come into play that 
don't come into play when you have a largely anonymous jury ... and no one 
person is the lightning rod for the decision," Bright said.
