用語の定義、後半です。
“License” - Means this license agreement and is both a license of rights such as copyright and Database Rights and an agreement in contract. 「ライセンス」とは、このライセンス契約を意味し、著作権及びデータベース権などの権利のライセンス契約並びに契約合意の双方をいう。 “Licensor” - Means the Person that offers the Database under the terms of this License. 「許諾者」とは、本ライセンスの条件に従ってデータベースを提供する者をいう。 “Person” - Means a natural or legal person or a body of persons corporate or incorporate. 「人（者）」とは、自然人若しくは法人、又は、法人格を有するかどうかにかかわらず、団体をいう。 “Produced Work” - a work (such as an image, audiovisual material, text, or sounds) resulting from using the whole or a Substantial part of the Contents (via a search or other query) from this Database, a Derivative Database, or this Database as part of a Collective Database. 「製作著作物」とは、本データベース、派生データベース、又は集合データベースの一部分としての本データベースについて、そのコンテンツの全体又は実質的部分を使用することによって発生した著作物（画像、視聴覚資料、テキスト、又は音声など）を意味する。 //----メモ（ここから↓）----------------------------- Workには「作品」の訳語もありますが、データベースとの区別を明確化するために「著作物」の訳を当てました。ODbLの文脈で頭にProducedと付いているのは、データベースを元に製作された著作物の意味合いがあります。この用語もかなり重要で、例えば画像としてのマップ(Mapnikのタイル画像など)を指し、データベースではないのでODbLの継承条項は及びません。製作した人が、自由にライセンスを設定することができます。記憶違いでなければOSM地理データベースがODbLに移行した後も、OSMのMapnik画像はCC BY-SA 2.0のままであったかと思います。日本ではヤフーさんがOSM地理データベースを元に独自にレンダリングしたタイルを配信されていますが、このタイルのライセンスは何であっても構いません。 Leagal FAQ (http://wiki.openstreetmap.org/wiki/JA:Legal_FAQ/ODbL) の3c.を参照ください。 (参考: http://wiki.openstreetmap.org/wiki/JA:Open_Data_License/Produced_Work_-_Guideline ) ------メモ（ここまで↑）---------------------------// “Publicly” - means to Persons other than You or under Your control by either more than 50% ownership or by the power to direct their activities (such as contracting with an independent consultant). 「公衆に」とは、あなた以外の者に対する公開、又は50%以上を所有することによって、若しくは活動の指揮権を保有することによって（例えば、独立的立場の顧問との契約など）、あなたが支配する者以外の者に対する公開を意味する。 //----メモ（ここから↓）----------------------------- ODbLの継承が必要となる要件のひとつです。派生データベースをいわゆる「一般公開」した場合には、ODbLの継承が必要ですが、例えば社内LAN上で公開する場合には不要です。 ------メモ（ここまで↑）---------------------------// “Re-utilisation” - means any form of making available to the public all or a Substantial part of the Contents by the distribution of copies, by renting, by online or other forms of transmission. 「再利用」とは、複製物の頒布、貸与、オンラインその他の送信方法によって、コンテンツの全体又は実質的部分を公衆に提供することを意味する。 //----メモ（ここから↓）----------------------------- ODbLの継承が必要となる行為のひとつです。 ------メモ（ここまで↑）---------------------------// “Substantial” - Means substantial in terms of quantity or quality or a combination of both.
