Now when I go back to 3.5.0.17 its always unticked for the preview pane between restarts, so I'd still say that the setting doesn't stick. You can also use: Options - Preferences - Viewer/Editor - Use smileys in Has a kind of logic, your default is being set in the preferences, but you can temporarily change it.
