Re: [tips] Can you say chiropractic is bunk?
?A follow-up to my previous posting. This is an article published *before* the recent appeal court judgement in favour of the science writer Simon Singh: Furious backlash from Simon Singh libel case puts chiropractors on ropes One in four chiropractors in Britain are under investigation as a result of campaign by Singh supporters, reveals Martin Robbins As the British Chiropractic Association's battle with Simon Singh continues to work its way through the legal system, chiropractors are counting the financial costs of a major backlash resulting from a libel action that has left the Lord Chief Justice "baffled". What was originally a dispute between the BCA and one science writer over free speech has become a brutally effective campaign to reform an entire industry. http://www.guardian.co.uk/science/2010/mar/01/simon-singh-libel-case-chiropractors Incidentally, in a pre-trial hearing England's most senior judge, the Lord Chief Justice, had criticised the BCA’s reluctance to publish evidence to back up claims that chiropractic treatments could treat childhood asthma and other ailments: “I’m just baffled. If there is reliable evidence, why hasn’t someone published it?” http://www.indexoncensorship.org/2010/02/simon-singh-chiropractic-bca-libel-appeal/ Allen Esterson Former lecturer, Science Department Southwark College, London allenester...@compuserve.com http://www.esterson.org --- You are currently subscribed to tips as: arch...@jab.org. It has become clear that the original judgement was not legally correct. When Singh was granted leave to appeal last year the appeal judge, Justice Laws, stated that the original judgement by Mr Justice Eady had been "legally erroneous". Index on Censorship described Justice Laws statement as a "scathing rebuttal" of Mr Justice Eady’s previous judgement in the case. http://www.indexoncensorship.org/2009/10/simon-singh-wins-leave-to-appeal-in-bca-libel-case/ The judgement of the appeal court confirmed that Justice Eady had erred on two crucial issues of law: http://www.guardian.co.uk/media/2010/apr/01/simon-singh-judgement Given these circumstances, the British Chiropractic Association is likely to be advised not to bother to appeal to the Supreme Court.
