  The brightness up down buttons shows the overlay brightness icon going
  up and down but it does not change the brightness (backlight).
  
  I have tried adjusting the kernel options acpi_osi=x and
  acpi_backlight=y (that did work with 12.10) to make it work but to no

I got this message in the kernel log:

acer_wmi: Brightness must be controlled by acpi video driver

So I edited GRUB_CMDLINE_LINUX_DEFAULT in /etc/defaults/grub to look
like this:

GRUB_CMDLINE_LINUX_DEFAULT=quiet splash acpi_backlight=vendor

and now it's now working.

I installed http://kernel.ubuntu.com/~kernel-ppa/mainline/v3.10-saucy/
and noticed the following message in the kernel log upon booting:

[9.293508] acer_wmi: Brightness must be controlled by acpi video
driver

So i added acpi_backlight=vendor to the kernel boot parms, and now it's
working fine.

I'm effected by this problem or a similar issue as well. Give this a try
and see what you get; when using your hotkeys continue to hold down the
hotkey (for example if your stuck all the way up, use your hotkey to
turn it all the way down and continue to hold the down hotkey for a
period of usually 15 seconds or so). On my machine this will eventually
change the backlight brightness, leading me to believe the problem is
something to do with when the kernel is checking for changes in the
control files. Incidentally I can also get the backlight to change to,
at least close, to what I want by toggling back and forth between the
level I want, and the level above or below it, for example if I want it
set at 3, I can toggle back and forth between 3 and 4 and eventually it
will change to one of those two levels, not how its supposed to work but
better than all the way up or all the way down.

Would it be possible for you to test the latest upstream kernel?  Refer
to https://wiki.ubuntu.com/KernelMainlineBuilds . Please test the latest
v3.10 kernel[0].

If this bug is fixed in the mainline kernel, please add the following
tag 'kernel-fixed-upstream'.

If the mainline kernel does not fix this bug, please add the tag:
'kernel-bug-exists-upstream'.

If you are unable to test the mainline kernel, for example it will not boot,

I have installed 3.10.0-031000rc2-generic.

I am not sure exactly what to report for the following reasons:

1. I am now getting /sys/class/backlight/intel_backlight which I didn't have 
before, and adjusting the brightness by echoing to 'brightness' in that folder 
works.
2. The hotkeys shows the brightness overlay but doesn't change the brightness.

So it's kind of fixed in that I can change the brightness, but at the
same time the hotkeys don't work.

I haven't messed with acpi_osi and acpi_backlight kernel parms.

Let me know what you think I should do for the next step.

My /etc/default/grub is:
