Yes, happens every boot on Hardy. I have seen that /sbin/fsck tool is in e2fsprogs package. I have a workaround based on this comment post before fix for ext2/3 : https://bugs.launchpad.net/ubuntu/+source/sysvinit/+bug/38303 Look at attached patch.
