Update finally worked .. more packages were added... from 89 to 131
packages.. anyway ..it installed... problem gone..installed update to
2.6.37.11 generic AMD64

NO longer a bug issue
the updater added 30 some more files and then completed a partial upgrade... 
and the software is now working
