Compiz has configuration option called Focus prevention level (run ccsm → General options → Focus Raise Behavior → Focus Prevention Level). It may be related to this issue. Just for reference, i just updated to empathy 3.1.91-0ubuntu1 and the problem did NOT appear the first 1-2 times i called the window via the messaging menu.
