I am using Oneiric, and Empathy 3.2.0.1. I don't think this is an Empathy bug, as the behaviour seems specific to the messaging menu. Not reproducible in Precise. As far as I know, there were some issues regarding this in Natty from the Empathy side itself. Are you running Natty?
