The kernel should (imo) return -EBUSY when when asked to disconnect a mounted nbd device. It'd be trivial to do. But consensus is that it'd be refused because it should behave like all other disks. Kvm's qemu-nbd.c *could* detect the condition as well. But the check there would be racy.
