Yes that is the feature film PAPER CLIPS. I am not sure if you are looking
for a copy which per above are widely available or are trying to track down
rights. It was briefly released by Miramax  but I believe the filmmaker took
it over directly and probably controls any exhibition rights.

 I believe it is a documentary about a middle school in TN that collects paper 
clips as a holocaust project.  I thought it was called the Paper Clip Project.

Interesting.  I was just in Barnes and Noble yesterday, and I was asking
the clerk about their av sales.  The Blu-Ray is way down - the shelf
area is only a little bigger than the cd area.  Sales of Blu-Ray - maybe
2 titles a day.  DVDs are steady, but dropping, and cds are steady but
dropping.

wanted to use it as a previewing tool.  Are there any libraries out
there that have Netflix but do not use the service for their patrons but
only for previewing.  (which probably also violates the non-commercial
aspect of the contract but ...)

I think this is kind of what I'm getting at. When libraries buy
something, they have the right to turn around and lend it. But since
libraries are not buying DVDs from Netflix, they don't inherit the right
to then lend them. It's because it's a difference can o' worms that, I'm
thinking, makes it illegal. As with the situation with software:
"Software companies also routinely attempt to avoid the first sale
doctrine by characterizing their transaction with the purchaser as a
license rather than a sale"

First Sale has to do with commercial property transfer exclusively, I 


think.  In other words, it has to do with the rights of legal buyers. 
The
NetFlix transaction is a rental--a temporary "lease"?--and is, I would
imagine, a different can o' worms.  But then again, I'm in no way
positive.

The terms of agreement are pretty clear that you

I think this is kind of what I'm getting at. When libraries buy something, they 
have the right to turn around and lend it. But since libraries are not buying 
DVDs from Netflix, they don't inherit the right to then lend them. It's because 
it's a difference can o' worms that, I'm thinking, makes it illegal. As with 
the situation with software: "Software companies also routinely attempt to 
avoid the first sale doctrine by characterizing their transaction with the 
purchaser as a license rather than a sale"

First Sale has to do with commercial property transfer exclusively, I
think.  In other words, it has to do with the rights of legal buyers.  The
NetFlix transaction is a rental--a temporary "lease"?--and is, I would
imagine, a different can o' worms.  But then again, I'm in no way
positive.

Dear Oksana,

Netflix Canada is just getting started. In a few weeks there'll be a lot
more films including some from Milestone. And I haven't seen the contract,
but there are a few titles for Canada that the US don't have from us.

Netflix streaming was introduced in Canada yesterday with much 
fanfare. I was just reviewing the terms of use on the Netflix.ca 
site. It only offers a streaming service for $7.99/month.  At this 
point all of the films I checked that are available for streaming in 
the U.S. are not available for streaming in Canada, and I checked 
about a dozen.


Here are some interesting quotes from the terms of use:

TO THE EXTENT ALLOWABLE BY LAW, WE AND OUR LICENSORS DISCLAIM ALL

At William Paterson University, it's a shared role.  As the media
librarian, I oversee the collection making sure there are not gaps and
we have subjects that bring different perspectives.  However, the
subject librarians meet regularly with their faculty and know the
curriculum.  I work with them on finding out what they needs are and
then make recommendations.  In order for us to have a collection, both
print and media that supports the curriculum, we need to share the
responsibility.  The subject librarian will then know what to suggest to
faculty in both formats and they will have more of an ownership of the
collection.  Being one person, I cannot spend the time with individual
faculty, but with the assistance of the subject librarians, we succeed
in obtaining titles they need to support their teaching.  

 

There is education that is needed and I have spent many workshops with
the subject librarians in educating them about media and the sources to
check for titles in their disciplines.  It's ongoing, but I feel that it
works for us and I am not overwhelmed since I too take care of all the
computer and media equipment support in the classrooms.
